it is all "happening now". first our top story, less than 24 hours to go now until election day dawns and several key races remain toss ups. welcome to the second hour of "happening now". i am jon scott. >> and i am shannon broem in for jenna lee. the control of the u.s. senate. and the republicans need a majority of six seats to have power there. >> this is one of the most expensive races in the country and we start with chief washington correspondent jeff rosen inb% less than 60 percent of the vote and finds himself tied with orman. and he trailed him by double-digits. roberts drew criticism for listing washington as his primary races. he flashed the pro-life and second amendment credentials and painting orman as a liberal. nwood wood doesn't give money to independents. but they give them to democrats. we differ and he will caucus with a democrat majority and a vote for greg orman is a vote for obama. >> princeton educated orman said he would caucus with the clear majority in the senate. but orman may not be able to seal the deal dow to the campaign donations from harry reid and barak obama and identified himself as pro-choice. and a close associate of orman landed behind bars. he talked about the broken politics. >> we'll make history and end the gridlock in washington. kansas stood up to the washington establishment and said enough is enough. and we demand better and we declare our independence. >> and kansasians only elected to the united states senate since the year 1938 republicans. and so the orman race makes it one of the closest races in the cycle. >> it is fascinating and we'll know the answer, should be tomorrow. james, thanks. >> reporter: maybe. >> and we'll talk about another race in the battle grouped state of colorado. it is the hard- fought races in the count row in the senate. incumbent mark udal is focusing on birth control and abortion than jobs and economy and the republican challenger corey gardener, and analyst are determining whether it is back firing. hi, a listia. >> reporter: the challenger is leading by a narrow margin and in the final hours, it is all about turn out. >> we'll win the race on getting out the vote and it will be a sweet win. >> colorado senator mark udal is relying on the hammering of his opponent corey gardener. >> supporting abortion laws. >> it is a one note campaign trying to do the war on woman theme, that seems to have run its course. >> gardener a rising star in the republican party has made it one of the most expensive and tightest in the nation. >> colorado is the majority maker and the way to make harry reid a foot note in history. >> not only has money poured in, but colorado has seen political heavy weights. >> that's why cory gardener needs to be elected to the u.s. saebt. >> they are running awe all of the ads to convince that mark udal is the last surviving communist. >> one person not campaigning for udal is the president. >> he votes with obama 99 percent of the time. >> and 1.4 million voters already returned their ballots and democrats are trailing republicans by more than 100,000, heather? >> thank you. the campaign crunch is on, less than 24 hours before the americans go to the polls and we'll look at the real clear politic averages and could determine the balance of power on capitol hill. in iowa republican joni ernst. over the braly. and in north carolina, kay haggin up by over a point over tom tillis. and for a closer look at the battleground states, go to mike and shera is politics editor. start with the north carolina race. this is one that republicans were confident about winning when the campaign season started 5 or 8 years ago it seems like. but it looks like it will go down to the wire and kay haggin could retain her society? >> yes, she has run a strong campaign. and tom tillis is the speaker of the north carolina legislature and it damaged his campaign in the long run. it was on the top of the target list for republicans in the start of the cycle and people were spending millions on the air waves in the state for the race a year ago. a year ago and it is probably will be the most expensive senate race. tillis had a rough summer but seemed to have closed the gap in the last couple of weeks and the other thing to remember is that early voting is important in this state and if democrats have a good operation that helps kay haggin to survive tomorrow. >> it seems like tom tillis has been on a roll in the polls? >> he's been able to make the issue of the campaign president obama and democrats in washington and the national security issues that was not what the campaign was about for the summer and fall. it was tillis own record and the so- called cuts, they were cuts in the increase for education spending and kay haggin had a lot of money and the most expensive senate race in history and most of that is on the side of kay haggin and democrats. and i think it will come down to the the wire. mitt romney won north carolina in 2012 and it was the closest state he won and it is a 50- 50 democratic and republican state. >> shera, what about georgia. mishil nun, of all of the democrats out there, she might have had the best chance to unseat or pick up a seat for the democrats that had been held by republicans, she has a famous name and father. what is the laefrt from georgia? >> a series of polls showed her in a tie with david perdue. and it looked like it was even. georgia is known to be a red state, right. two things happen. one, republican nominee david perdue made a comment of outsourcing and that didn't help him with the blue collar white voters in the state and secondly, the demographics are shifting and they are able to mobilize the african-american voters out in early votes. they have an initiatives on sunday and first time they opened called souls to the polls and moved a lot of african-american votes that way. >> there was a 50 percent requirement in georgia and could be a run off election and if that happens and if you get the libertarian out of the race, who holds the advantage? >> we have seen the numbers bounce around and the same tracking poll plus 11. and you agree with that? >> i believe they bounce a round a lot. our numbers what we are seeing republicans having no matter how you ask a 4- 7 lead and on who controls congress 6- 10 point lead. that is reflected in the dissatisfaction with president obama and obama care and a lot of problems created over the past five years be fixed. >> pat, we hear about the voters out there, no one either likes either party? why is that? >> look, the country is in this decloin. people believe they will have a worse life for their children. and neither party talks about it. the voters want to chastise the democrats, but they are not in the mood for respect -- rewarding the republicans. >> and chris, let me ask you about that. one thing that pat said the republican party hasn't offered much in the way of vision. we heard about obama care and fixing that. why don't you hear that this year? >> reporter: heather, that has many observers puzzled so far. the number of races have tightened up. the 36 races, 11 are within five percentage points and five are virtual dead heat. some of the states where the toughest races are states which normally are not in play. two states that are the biggest is kansas and illinois. it is the fact that they are so close. illinois is a traditionally blue state and you should not have a close race for governor. and kansas, 22 points. normally won. >> and when it comes to the governor races republicans have a tougher job. >> the impact on the presidential election. we can't just talk about this election but look ahead two years. >> potential contenders will be involved and first win their race at home. scott walker in wisconsin has a tough battle at home as he is talked about a possible presidential contender in 2016. and here in florida between governor rick scott and charlie crist, now running as democrat. they have poured 150 million in a bitter race and part of the reason behind that money and outside attention, both parties want to control the key swing state before the next presidential election. >> steve is following this from tampa, florida. >> and his name doesn't appear on ballots, but the midterms are about president obama. many republicans are running against white house policys and many of them use the president in their ads. issues like obama care, are pretty much on the sidelines. bloomburg vow writes midterm elections have had everything but a vision for governing. allen combes and randy bruce. the question is, do they agree with that assessment? allen what do you think? is it a campaign lacking in concrete ideas? >> what are they for? >> against obama. and ted cruz wants to overturn obama care and replace with what? which will not happen by the way. >> not while the president is in the oval office. >> tell not happen anyway. if they want to a mend it. what plans? >> we thought it was interesting with the affordable care enrollment season coming up. we wanted to see how the veterans of the obama care are feeling. are they wary? and this group is feelingnah. >> and half told us they don't plan to go back in the health exchanges and over half told us they had a positive experience and half say they feel confident they will work well this time. >> is it because 51 percent say they are not going back are they covered now and don't need to go back? >> i think that is a concern we have. we are concerned that they will figure they will roll over the health plan they have because you can allow to autoenroll if you don't touch or change your current plan will be renewed for a season. there will be new health insurers participating in the exchanges. department of health and human services said 25 percent more insurers and if you don't go in, you might make a wrong choice and a better plan and lower premium and better options for you. we think that people ought to shop around again. >> it is curious. just over half. 52 percent said they had positive experiences. we heard about the roll out problems with the exchanges and 52 percent said they had a positive experience. if this were a privately run website and only 52 percent calling it positive, that website most likely would not be around too long, would it? >> no, i think it is it a concern for the obama administration. it doesn't seem like they have happy or loyal customers and at the same time people who tried the exchanges, it doesn't so many like they were left scarred by the experience either. >> they will go back to health care.goff. people if they signed up last year, they need to look at what their coverage will be. and they will not find out what the rates are until the new enrollment period. >> the state officials are going over the rate request from the insurance companies and so a lot of that will not be finalized until the new enrollment season in 2015. another concern if there are lower price option they could bring down the tax credit that lowers the cost of health plans for many people using the exchanges. and this is a reason why they ought to shop a round. it could be the price of your existing plan will go up if you do nothing not only because of normal inflation but because your subsidy will have dropped. >> it will be interesting and we hope not shocking when people see what those rates will be in the middle of this month. i forgot we are in the middle of november already. doug, thank you. nconvicted murderer jodi arias. and will the judge be right to bar the public for hearing it? our legal panel weighs in. ♪ hi. i'm new ensure active clear protein drink. >>clear huh? i'm not juice or fancy water. i've got 8 grams of protein. new ensure active clear protein. 8 grams protein. zero fat. ensure. take life in. right now, an advocacy group confirms that cancer patient, brittany maynard, has ended her own life in oregon. maynard's story went viral when she posted a video online explaining the decision she had reached to take her life rather than fight an inoperable brain tumor. patti ann browne live from our newsroom. >> tough story, john. brittany maynard was 29, married and diagnosed with incurable brain cancer on new year's day of this year. doctors said she had six months to live. she and her husband took a trip to the grand canyon and checked off other items on her bucket list but she began to suffer worsening seizures, severe head and neck pain and stroke-like symptoms. with the support of her family, she consult addition nitty and dying group called compassion and choices. she moved from california to oregon, which has a law allowing doctors to prescribe fatal drugs to terminally ill patients and went public with her plan to enter her life. two days ago, as planned, maynard took the drugs and died in her husband's arms. more than 750 people in oregon used the law to die built median age is 71. brittany's case got more attention because she was so young and because of her video and her advocacy for assisted suicide. the group, priests for life, issued a statement saying, "brittany's death was not a victory for political cause. it was a tragedy, hastened by despair and aided by the culture of death invading our country." but brittany said her family wanted a mir rack al first, a cure for her cancer but "when we all sat down and looked at the facts, there isn't a single person that loves me that wishes me more pain and more suffering." john? >> tough story, just like you said, patti ann browne, thank you. >> thanks. we are getting some new details in on the sentencing retrial of the convicted killer, jodi arias. of course, happening in arizona. the judge barring journalist and the public from the courtroom during the testimony of a mystery witness last week, highly unusual. but we are learning that the witness herself was jodi arias and that her testimony will, in fact, continue. arias, of course, was convicted of murdering her boyfriend and is now fighting to convince a jury to spare her life. this is a complicated one. joining us now, talk to heather hanson, she is a trial attorney and keshia havan, a criminal defense attorney. heather, let's start with you. explain this to me, because it's a public trial, but yet, she leave -- she can testify but then everybody else has to leave so it's not a public trial? >> it's supposed to be -- crimes are supposed to be public in general unless there's an overwhelming showing there is going to be some adverse inferences for the witness or the case. here, as we new york the first trial was open to the public and it caused a lot of issues, the fact that it was open to the public. so, judge stevens said this trial is going to be open to the public but not televised live. then when it came to the defense part of the case, they pushed even further and said we don't want our witnesses to be videotaped at all. she granted that request. the press went nuts, as they should, and that's why they have that hearing today to determine whether or not that's going to continue. >> keshia, what do you think? >> there is a supreme court case down in virginia that state it is there is an overriding interest the judge, the trial court -- trial level judge can restrict the case where it's closed either partially or the entire case and it's a overriding interest has been to be decided when a witness feels that testifying in open court would be either extremely embarrassing or intimidating and in this case, i think with jodism's talk about her childhood being abusive and mental disorder that resulted from that abuse it may cause more problems and actually give her a leg up in an appeal for an unfair trial. >> interesting. this is in front of an appeals court now because the media timed a compliment and so the court will decide whether or not jody will have to testify in front of everybody or in secret again and be another mystery witness, but you both agree that this could potentially set up a mistrial of some sort? >> definitely going to set up an appellate issue. she is now forced to testify in front of everyone, when she has been allowed no to and she has a number of reasons, as keshia so well pointed out, she will have an appellate issue if they now open it up to cameras. heather, remember, the public is paying for this trial at the tune of millions of dollars. >> 2.5 million so far. >> entitled so some aspect of the trial as well. >> i get that. and that's why all criminal cases are public proceedings but you also have to look at what's the fairness in the defendant's situation here? would it be, you know, fair to say the public interest means more than this woman getting a fair sentence in trial? >> did the judge make a good or a bad decision, keshia? >> i think the judge made a good decision because they already had a deadlocked jury before, so, this judge is probably trying to avoid that at any costs at this point. >> this, by the way, is the same judge who handled the previous case, what do you think? >> i think the decision best for an appellate reason, i don't think -- i never think that cameras should be left out of the courtroom. i think we are entitle and see what happens so we can make our own decision as to what went on during the case. >> all right. so what happens if the jury is in the position where it cannot decide, because our viewers will recall, we covered this case expense civil, that they were deadlocked previously on whether or not she should be put to death or whether or not she should be given life in prison, what happens if they can't decide this time? First, Liberty-Benton High School honored their longtime hall of fame and state champion former basketball coach Steve Williman, who had over 500 wins during his career.Next, the Perrysburg Yellow Jackets went to work, defeating Liberty-Benton, 74-56, in the semifinals of the Steve Williman Holiday Tournament Classic Friday.In Saturday’s championship, Perrysburg (4-2) will take on Genoa (7-1), 55-51 winners over Wauseon (3-3) in the first semifinal. Wauseon and L-B (4-4) will open play in the consolation at 6 p.m. and the championship follows.
