A recent amendment in the Elections Act 2017 has created a significant loophole that allows a candidate to claim that the spending was made by 'someone' without his consent.

The Election Commission of India (EC) has defended the EVM-VVPAT system against a petition seeking 100% data cross verification, stating that it is an attempt to cast doubt on the functioning of the system. The EC has highlighted the technical and administrative safeguards in place to prevent manipulation or tampering of the EVMs and VVPATs. It has also cautioned against extensive data verification, as it could lead to human intervention and manipulation.

The Supreme Court has adjourned the hearing on a plea by an NGO seeking cross-verification of votes cast through the Voter Verifiable Paper Audit Trail (VVPAT) until November. The court stated that there is no urgency in the matter, despite the advocate for the NGO arguing that elections are approaching.

In the current appeal, the NGO has asked the poll panel and the Centre to ensure that voters may verify their vote has been counted as recorded using VVPATs.
