Cops base their opposition to forfeiture reform on the notion that "we won't be able to do our jobs," and "criminals will run amuck." But the realities on the ground in New Mexico prove this to be either a gross exaggeration or an outright lie.

The legislation would repeal the entire state civil asset forfeiture process. If passed into law, state and local police could no longer engage in civil asset forfeiture under state law.

The proposed law would prohibit Missouri law enforcement agencies or prosecutors from transferring property seized under state law to a federal agency by way of adoption or other means for the purpose of the property’s forfeiture under federal law.

The passage of HB1101 would prohibit police from transferring at least some cases to federal authority. But property seized by a joint task force could still be transferred to the feds to take advantage of the less stringent federal forfeiture process and equitable sharing.

BOSTON, Mass. (March 16, 2022) – A bill introduced in the Massachusetts Senate would reform the state’s asset forfeiture laws to remove the financial incentive for state and local police to participate in the federal “equitable sharing” program.
