The Office of the Public Protector has welcomed the Constitutional Court ruling which declared the Executive Code of Ethics invalid.

The Public Protectors office says it welcomes the Constitutional Courts ruling which declared the concealment of donations received for political party campaigns unconstitutional.

Inkatha Freedom Party (IFP) national spokesperson Mkhuleko Hlengwa is among four MPs who failed to disclose their interests before Parliament.

On Tuesday, the Constitutional Court confirmed a ruling by the Gauteng High Court that the Executive Ethics Code, in its current state, is unconstitutional and invalid.

Above and beyond the obligation to declare any personal or private financial or business interests, executive members will now have to disclose funds received for their internal party campaigns.



The Constitutional Court will on Tuesday have the last word on whether members of the executive should have to disclose donations they receive for internal political party campaigns.

The Constitutional Court has ruled the Executive Ethics Code as unconstitutional and invalid as it does not require the executive to disclose donations for political party funding.

The Constitutional Court on Tuesday morning upheld a December ruling from the Pretoria High court, which found the Executive Ethics Code was unconstitutional insofar as it doesn’t require members to disclose donations unless they personally benefited.
