WASHINGTON ― The Supreme Court ruled unanimously Thursday that states can regulate pharmacy benefit managers, the prescription drug middlemen whose actions affect 250 million Americans.
The ruling is a victory for 45 states, led by Arkansas, and independent pharmacies that sought to stop so-called PBMs, which process prescription drug claims and then reimburse pharmacies, from keeping reimbursement rates low for generic drugs. That has caused thousands of independent pharmacies to close, particularly in rural areas.
The case, which was argued in October, garnered little attention compared to the major health care dispute over the Affordable Care Act that the high court heard in November. That case ― in which a coalition of states led by Texas seeks to have the law declared unconstitutional because Congress eliminated the tax penalty intended to enforce insurance coverage ― isn t likely to be decided until the spring.
In a ruling that could pave the way for increased regulations by states such as Ohio, the U.S. Supreme Court on Thursday rejected a challenge of a 2015 Arkansas law putting restrictions on pharmacy benefit managers. We have overwhelming evidence that the PBM marketplace is highly dysfunctional and exceedingly costly, said Antonio Ciaccia, former lobbyist for the Ohio Pharmacists Association who is now with 3 Axis Advisors, a company set up to expose drug-pricing irregularities. With the industry problems growing worse, it is encouraging to see the Supreme Court assert the authority of states to control their own fates, rather than leaving their prescription drug costs and access in the hands of a largely unchecked multibillion-dollar industry.

Cigna Corp. on Thursday announced changes to leadership at Cigna and Evernorth, the company s health services portfolio brand, starting Jan. 1.
Under the changes, Cigna CFO Eric Palmer will become the president and COO of Evernorth, and Cigna s President of Government Business Brian Evanko will become executive vice president and CFO of Cigna. Other changes involve Matt Manders taking on oversight of Cigna s government business; Aparna Abburi becoming president of Medicare for Cigna; and Amy Bricker being named president of Express Scripts for Cigna, according to a news release.
