off the ballot, the primary ballot in colorado, including especially these military voters who will have begun casting their ballots by then? you take a look at that calendar again, on february 12th is when other mail-in ballots begin going out. the first in-person voting begins on february 28th. so, again, a lot of us certainly when we starred hearted hearingh amendment challenges, the idea the former president would be kicked off ballots in states because of the section 3 of the 14th amendment which, you know, again declares him to be an insurrectionist seemed very far fetched but here we are, right. these challenges have gone much further than anyone thought, and so here we have the supreme court having to weigh in. it really does kick off what we're looking at, a historic period where the supreme court for the first time since bush v. gore in 2000 is set to play a
former president engaged in an insurrection, answer that narrow question. but then have it be able to be broadly applied to these other states. you have more than 60 lawsuits. you have more than 30 states there are engaging in these questions. they're not going to want to litigate each and every states particular electoral code as we are in an election year, as the primary season is underway. so, i do think it will be both narrow in terms of the question that they're answering, but also able to be broadly applied to the other states. one note on the timing in colorado at least, donald trump's certified to be on the ballot. and by the time of this argument, the deadline for the county clerks in colorado to mail ballots to the military and overseas voters, that's generate 20. with hill already be on that ballot. the next deadline is february 12th through the 16th. that's the period when the county clerks have to actually
trial court judge had said itten wouldn't apply to a president, but the colorado supreme court reversed that and said it does so you haves questions such as was january 6th an insurrection. did donald trump incite that insurrection. can states enforce this provision? i should remind everyone, but this has not been tested and there's so many other questions that the justices will be deciding what should they address and when shall they address it. >> do we have any -- i'm told the supreme court can act when itments to act. is there time pressure here? >> yes, and this is why i think there is a chance we could see a signal today or early next week because the parties that have come in have said the colorado voters want a decision as early as february 11th because on february 12th colorado mails out its ballots that need to be returned by march 5th super
it. as to whether they'll decide it by february 11th, voters in colorado receive their ballots on february 12th. we've asked the court to work quickly here to issue a briefing schedule schedule that allows them to complete a decision by february 11th so that those voters in colorado and elsewhere on super tuesday have the benefit of knowing whether donald trump is disqualified. >> if they do take it, how tough do you think the fight is going to be for your side? >> i think this court has shown a willingness to step aside from sort of the partisan frame on these hard issues that are important to our democracy. we're optimistic that as did the colorado supreme court, that when you look closely at the legal arguments and evidence presented here, there really isn't a close case here. donald trump engaged in an insurrection against the constitution, and therefore under the constitution, he cannot be our president again. >> we'll see what the courts
it tells you about when where looking ahead to what the supreme court is going to do, do you think that they will take this case up? and if so, are you still hoping to get a decision as soon as february 11th? >> we certainly expect they will take the case. every party to the case has urged them to take it. we disagree a little about what questions they should take, but every party has urged them to take it. and if they don't take this one, there's more behind, there's lots coming from maine, and perhaps other states. so the court will need to address this case quickly. this is an ideal vehicle to do it. as to whether they'll decided by february 11th, you know, voters and colorado receive their ballots on february 12th. we've asked the court to work quickly here to issue a briefing schedule that allows them to complete the decision by february 11th, so that those voters in colorado and elsewhere on super tuesday have the benefit of knowing whether donald trump is disqualified. >> if they do take it, how tough do you think the fights
how and what questions they resolve. but i think because of what happened in colorado and what has happened in maine also to keep him off the ballot, these justices are going to have to weigh in. tomorrow they will meet for the first time in the new year, privately in their conference room, to look at several cases that have been pending. i can't imagine that they would not give this a first look together. and we could know by the end of friday or a few days into next week exactly what questions the justices will take up and a timetable. and i want to just give one other thing about the timetable. the colorado voters who started all this, have asked the supreme court to rule by february 11th. because on february 12th, that's when ballots start to be mailed out to colorado voters who have until supertuesday, march 5th to submit those. so they want a decision by then. the colorado republican party said just as long as you decide
to military and overseas ballots. february 12th, first day ballots can be sent to other colorado voters. that's coming up very very fast, and the printing does take some time. garrett haake, thank you very much. joining us now, msnbc legal analyst, lisa rubin, so you watched the court. what is your expectation of when and if they will take this up? >> katy, i think they will take this up, and the decision by maine secretary of state, sheena bellos to disqualify trump for her state ballot, increases the likelihood that john roberts and his colleagues will make a decision with respect to his cert petition from donald trump. the question is when, however, and that's one that the court and only the court can decide. you noted at the outset that the decision is stayed right now. which means donald trump will appear on the colorado ballot unless and until there is a decision from the united states supreme court either upholding
up for the supreme court earlier. now the court is kind of jamd into this. and andrew was absolutely right. there are ways for the court to rule tomorrow afternoon on whether to hear the case and ways to try to undo some of the uncertainty, but the fact is on january 20th, there's going to be mail-in ballots sent to military and overseas voters and then on february 12th active registered voters will get their ballots. so there's a need for the supreme court to resolve this as quickly as possible. i do blame the trump team taking that long to file that brief. now the court is a little jammed. >> the clock is ticking. thank you so much. when we come back, the ex-president is turning his very busy legal calendar into one big spectacle. we'll look at the legal and political strategy that is behind that. plus with president biden marking january 6th anniversary
above calendar demonstrates, expedited resolution of this case will ensure the colorado voters cast ballots in the presidential primary election, knowing whether trump is qualified to serve as president. providing the certainty is important both for the candidates and colorado's republican primary and most importantly for the millions of republican and unaffiliated voters in colorado who will be casting ballots in that election. the urgency, it is palpable, barb. >> i think she's right. she makes the argument in colorado, they are a super tuesday state. she said her deadline drop dead is something like february 12th. in the iowa caucuses, they're going to go cast their votes on january 15th and people could be disinclined to vote for donald trump. in donald trump's defense, if they think he might not be a viable candidate, and so to protect his interests, the court really needs to decide this very quickly. >> and here is the thing, there are the legal arguments going to
