>> i think right now there are a lot of different voices in addition to them that are speaking -- >> harris: anybody getting as much attention as they are? a ton of ads anti-pelosi. i'm curious, who's really atop the food chain here. they're oppositional in their poll six. >> -- in their politics. >> currently in my view, obviously leader pelosi is the head of our caucus in the house. what happens after the elections, again we have to first take the majority before we can even talk about the speakership. and then after that, we can talk about who has the most compelling vision to connect to the economic issues of working families. one thing i want to point out, which is mr. o'connor has come very close to winning the north carolina republican chairs the gop study committee and sits on house oversight, great to see you, thank you for being here. could you hear what that congressman was saying? he wouldn't definitively say -- i mean, you won't say you'll vote for nancy pelosi? a lot of democrats are saying they won't. >> no, and you will see more and more of that. i know raja, represents well from his particular part of illinois there. but more and more discussions are now coming forward. we know about these discussions. the democratic party in the house are beginning to implode under nancy's leadership. raja talked about bread and butter issues, economically. miss pelosi calls them crumbs. she's continued to emphasize her out of touch positions. now, i believe it's finally coming to the forehead. the interesting thing in the past, in the background, she has bank rolled a lot of the candidates when they arrive there, their allegiance was to nancy pelosi. here's the interesting fact, harris, now ocasio-cortez is running so far to the left of nancy pelosi it's undermining her own authority, emploeding over the last couple of months. >> harris: that's what i was asking the democrat congressman about. they're oppositional in their politics and they skew very differently. we saw with bernie sanders, senator sanders taking on formerly presidential candidate hillary clinton, those audiences for voting are very different. >> oh, no question about it. if you look at nancy pelosi, which has the highest unfavorables of elected political officials, when you have somebody even going further extreme radical left than her positions, i think it's very frightening for a lot of americans and it may be one of the deciding factors that allows republicans to keep the house majority for an unprecedented term in the mid-term elections. >> harris: congressman walker you have been around the hill and bipartisan relationships you're known for. i want you to help me do a deeper dive. how in the world did the party get to the point for democrats where their choices are the woman with the highest unfavorables for leadership, versus a woman who struggles to even name who the leadership is, doesn't understand the middle east, really, probably left the bronx not anticipating she would be asked about a broader economy. what happened to who is in the middle? >> well, we think it is a simple solution here. let's look at it for just a moment, i'll take 10 or 15 seconds breaking it down historically. these last two elections are the first time in history that 240 or more republicans have been elected to the u.s. congress since 1913 when we expanded the 394 to 435. now, on top of that, if you go back to 2010 this is now could be 8, 10 years of republican control, we believe it's the reason that the american public do not want government control of their lives. a lot of the democrats specifically the social is particular minded democrats believe that the answers and solutions are in the federal government. that's not the solution and i believe the american people continue to reject that. >> harris: so, republicans have something on their plate now, all of you, that you might not have anticipated, everybody has seen in past presidencies in the first term sometimes the house will flip. you actually have an opportunity, because of where democrats and a split party to not let it happen. why the president wants to be on the campaign trail. your thoughts? >> no question about that. in fact, historically, you lose an average of 29 seats. if we lose 22 nancy pelosi would become potentially the speaker, even though we have more and more people, more and more democrats jumping off that ship. that's very important to remember. let me say this, republicans shouldn't be running just on the negatives of nancy pelosi and socialist wing of the party. we should be running on what we believe in. we are better off now. there is data and facts to show the last two to four years the american people are better off economically f we continue to message that, we believe that's important to get to all demographics, even changing demographics, republicans shouldn't be afraid of their message of opportunity. >> harris: well put, representative walker, great to get both sides, happy were you on the program. thank you. >> thanks, harris. >> harris: fox news alert, immigration back in the hot seat a federal judge with a is threatening to hold leading members of the trump administration in contempt of court. after halting the deportation of a mom and her daughter who were put on a plane in the middle of appealing their removal. doug mcelway has more from washington. >> hi, harris. judge emmett sullivan came down hard on prosecutors who play loose with the rules. he let the government have it yesterday when he learned that the fredz had already commenced deporting an illegal immigrant, named carmen and her daughter, before an agreed-to deadline. judge sullivan tore into the government, it's outrageous, i'm also directing the government to turn that plane around now or when it lands, turn that plane around and bring those people back to the united states. he also threatened attorney general jeff sessions and dhs secretary nielsen with contempt of court, quote, it is further ordered that in the event the defendants do not fully comply with this order they shall be required to appear in court to show cause why they shouldn't be held in contempt of court. in compliance with the court order upon arrival, the planists did not disempark and promptly were returned to the united states. there has been no response from jeff sessions who spoke this morning at the u.s. attorney's office in houston. he took no questions addressing the administration's man to withhold federal funds from swaut cities. >> some people have sde sided to take us to -- decided to take us to court, we're fighting that resolutely, we plan to win. we have received support from the people in texas. >> yesterday's courtroom drama occurred as part of a lawsuit brought by the aclu, it allegation that carmen fled el salvador to seek asylum from sexual abuse by her husband as well as death threats from a gang. the government has argued that victims of domestic violence are not eligible for asylum as are victims of political persecution. the suit is one of several challenges to the trump administration -- immigration policy which have left border security in utter legal limbo as we speak. harris, back to you. >> harris: thank you, doug. on a busy friday let's get to this, fox news alert, after a surprise recess, we are now just minutes away we're told from the start of day nine in the trial of former trump campaign chairman paul manafort on tax and fraud charges. the prosecution was expected to rest its case as early as today. but the trial has been delayed all day long for hours. peter doocy is live at the federal courthouse in alexandria, virginia. are we closer to learning what the delay is all about? pd. >> it's closer to 1:45 when the recess is supposed to end. but the proceedings were supposed to start 2 1/2 hours ago and they didn't. all that's happened today is the judge warned everybody in the courtroom before the jury even came in, that if they try to look at papers on the counsel tables they will be kicked out. then the jury came in and the judge really emphasized in a way he has not done yet, his daily instructionles that it is really important they do not talk to anybody including other jurors about this case. that it's really important they keep an open mind. and remember, paul manafort is presumed innocent unless the prosecution can prove him guilty of tax and bank fraud. after that, they broke for lunch which wiped out half of a day that the mueller team had been planning to use to rest their case. now it's not clear that they're going to be able to do that. something the mueller team has done, though, for the second day in a row, is file a motion complaining that the judge said something that could hurt their case. yesterday they got him to apologize for admonishing them for breaking a rule regarding a with it that he never imposed. today, though, the special counsel's office is upset that the judge told their team not to focus so much on loans paul manafort was denied and that they should focus on loans he was rewarded with. the mueller team wrote this in the motion, the court's suggestion that the government was unnecessarily spending time on a loan that manafort did not receive undermines the well-established law on conspiracy, undercuts the charge in count 28, and is likely to confuse and mislead the jury. the mueller team wrote in that motion they wanted the judge to come in first thing this morning and correct the record in front of the jury. he did not do that. and it's not clear if that's coming when they resume about a half hour from now. >> harris: peter, thank you. let's get to alex little, defense attorney and former assistant federal prosecutor. great to see you. >> good afternoon. >> harris: did you catch that list of reminders, don't talk with people outside the court, that's basic. paul manafort is innocent until proven guilty, why do they need to be reminded? that's the second time m two days he's done that. >> federal jurors are required to not have any contact with really the outside world about a case. so if one of the jurors came across a news story or commentary -- >> harris: we get that. why do they need to be reminded that paul manafort is innocent until proven guilty? >> sometimes if a juror is exposed to that they may say this stuff was really damning or really do some sort of deliberations before they're supposed to f that happens it can be serious. the judge has to talk to the jurors individually. don't know if that's what happened. but that thing does happen in these sorts of long trials. >> harris: in the last hour we had a former member of the d.o.j. tom dupree on with us, he said bob mueller and the russia investigation, i asked the question why is he watching this. you can't talk about the case, the court trial doesn't have anything to do with that. except for the fact that paul manafort worked for the campaign. dupree said something interesting, he said if mueller sees a loss here in terms of manafort being acquitted, it is a hot mess going forward. what are your thoughts on it? >> on the one hand if he -- he has a case which is pretty straightforward and direct. if he loses it it calls into question some of what they've been doing in the dark for the past few months. alternative, this is the first time the american public gets to see the work of the special counsel and the legal team. it takes what has been commentary about how prosecutors work and put it in the public eye. the first verdict, i think, will be somewhat of a statement as to what has been going on in the special counsel's office. >> harris: should we be looking closer at why bob mueller chose to do this case himself? he's passed on others to new york federal prosecutors. why this one? why is this one different, why did he want to keep this in his own hands? >> i suspect it has to do with rick gates. he's a central with it to the trial, also apparently a central with it to the larger russia investigation. obviously, paul manafort is sort of at the center of this web of the different strands of the investigation. i suspect because all of these pieces fit together, it made sense for them in terms of the efficiency of investigation and keeping the right people on the right issues to do it in house. >> harris: can you give us a grade now, on how the manafort defense team is doing and how you think this might shake out? we've seen a lot of evidence so far, you have stuff to work with. they're not doing much, not much they can do. this is a pretty straightforward trial, our guy didn't know anything and he was downed by the associates. you go into any federal court you will get that defense. they're doing a on commendable job but nothing extraordinary. >> harris: alex little, appreciate the expertise. >> thank you. >> harris: a controversial start to the nfl pre-season, it's so early. some players continue to kneel during the national anthem. how president trump is responding and whether the protests could ignite the republican base headed into the mid-term elections. the gop primary in kansas, just got a little bit chippy. you know i like to borrow a hockey phrase. it prompted a pledge of recusal. what's that all about? >>le the governor's race between jeff collier and the secretary of state, chris kobach, remains in a dead heat. so far about 311,000 votes counted, and 10,000 absentee and provisional ballots remain to be tallied up. kobach is claiming a .04 lead but is recusing himself from the role overseeing the results. his opponent says it's about time. >> i appreciate any sort of recusal, probably should have happened a long time ago. >> and accusing kobach of funny business. >> secretary kobach's office was instructing counties not to count ballots in the mail. those clearly have to be counted under kansas law. we want to make sure the law is followed and everybody who has voted that they get their vote counted. >> now, with secretary of state kobach chief elections officer and has been managing the ongoing effort to sort through tallies for several counties where inaccuracies were reported. he led the charge alongside president trump against what he believes was widespread voter fraud during the 2016 presidential election. but he's punching back against colyer insisting this makes him better qualified. >> it's interesting, my on poen whoent demanded recusal, doesn't understand the process. the counting is done at the county level not at the state level. my office doesn't actually do any counting of ballots. >> after discrepancies in two counties have been officially rectified, kobach just 125 votes in the lead. >> harris: all right, gillian, thank you. dnc chair rona mcdaniel, there was a visual, the optics if you will with kobach. i heard republican members saying maybe he steps aside. that's happened now and it is squeaky tight. what do you think is going on, on the ground, that will help kobach win? >> he did the right thing rec e recusing himself. it gives assurances to the kansas voters that everything oigs the up and up. and they want to make sure that everything is done properly. and i know chris kobach wants to make sure the voters feel good about the process. he did the right thing. it'll come down to the provisional and absentee ballots and the voters will make themselves clear. we'll see what the final vote tally it is, as you said it is razor thin. whoever the candidate is is going to be the next governor of kansas, we will support them, both candidates support the president, and we'll see what happens. >> harris: i want to talk just more in general about the primary season and kind of on this friday, how it's all shaking out going forward. >> sure. so, we have had nine house special elections. the republicans have won eight of those in the house special elections. think about it, harris, the national media has desended on. races, brought outsized attention and money to the democrats, given the democrat a home court advantage with more money going to those candidates. we won. now we're shaping up toward these mid terms. the rnc has put in place the largest field program we've ever had. we have trained over 20,000 volunteers to knock doors, engage with our voters, to talk about issues. in 28 states, we have 540 staff on the ground. we know what history tells us, the party in the white house usually loses seats in the mid terms. we're ready to defy history. >> harris: i talked moments ago with congressman mark walker of north carolina, i said it's conceivable that you might not see as much of that happening because what's happening on the other side of the aisle. he said yeah, with the democrats trying to figure out who they are right now, it does give be a opening for republicans. what's your take on that then i want to go deeper on the issue with nancy pelosi. >> voters are looking at issues. they're saying what are the visions that these parties are putting forward for me and my family, what's going to make my life better. every voter right now, taking stock of their lives, are saying i am better off than i was a year and a half ago. republicans went to washington, they have lowered taxes, lowered regulations, wages are up, jobs are coming back, they have delivered on promises they made in 2016. maybe we should return them. we absolutely should return them to the majority. the democrats are running on a different message, anti-trump, obstruct, resist, abolish i.c.e., they have gotten extreme. they're not promoting a vision that helps everyday americans. we're going to win with that message. >> harris: congressman walker said don't let it be anti-pelosi, he said it's got to be something other than that in a positive that you're listening. the democrats are struggling. the democratic congressman who i had on atop of the hour, wouldn't profess his loyalty to nancy pelosi, he kept saying, well after the election we'll take a look and blah, blah, blah. i said we've talked long enough, we can talk straight together. he still wouldn't say whether or not he would support her. >> i'm glad you're pushing them and asking them to go further. i think they've all decided we can say we're not going to be for nancy if we come in we can do whatever we want. nancy has given them a free pass. she wants the majority, she's saying say whatever you need to say to get elected, when you could many to washington i know you'll support me, e funded your race. the democrats are caught in the conundrum and people like you are pushing them to say who are they going to vote for, who is the speaker, they won't have the peek speakership, who's the leader you would support. they won't answer. we have to talk about more than nancy pelosi. we know what a horrible speaker she would be. she would lead our country down a terrible path, raise taxes, that's a number one priority. we need to talk about what we have done to turn the country around. this is not a time when we want to go backwards. we want to go forward. >> harris: my last question for you, it's interesting, both congressmen and i were talking about how she, nancy pelosi, has the highest unfavorables. you flip the switch and it seems like democrats are focused on alexandria ocasio-cortez, she's popular but she hasn't done anything. is there no one in the mid? how dolls that help republicans? >> pointing out alexandria ocasio-cortez, the new shining star of the democrat party, is a socialist. what does that mean for the country. when you dial in to what socialism means, it means more government control, less innovation, lower standard of living. look at conveniences well a, people are -- venezuela, people are starving under a social interest regime. she's saying these things. she doesn't know how to pay for it, she's not trained in the media interviews to understand the policy she's pushing and what tle mean for america. i think as more and more americans look at the leaders of the democrat party they don't have a vision, they don't have a plan, they don't have a path. what republicans are going is working. lives are better because of republican policies. the president wants to work with democrats but we know one thing, we are on the right path as a country with the gdp, unemployment, e low unemployment, with jobs coming back work the military being funded, with the veterans being taken care of. this is a time when america is rising. why do we want to hand it over to democrats with no vision. >> harris: 88 days until the election. >> i know. >> harris: coming fast. rona mcdaniel, chairwoman of the rnc. power panel is next. congestion and pressure? >> i'm uncomfortable with a couple of things. one of the things i thought ocasio kor nez did really well during her primary was she didn't get drawn into these kind of twitter battles with the president or anybody else. she stuck to the issues of the people of the 14th ticket of new york to whom she wants to represent. that was, i thought, a really good practice on her part. so i was a little, a little disappointed that she responded to this at all. because i see this as a publicity stunt on the part of ben shapiro. i know you want to talk about the money later. but the idea he would offer her money, i know he pulled it back and then it was going to charity. that is uncomfortable to me. >> harris: can i press down a little bit deeper with ocasio-cort ocasio-cortez, do you think she's ready for prime time? if she took on ben shapiro or the lovely lisa boothe, we've seen her fall down on news interviews and they were asking basic questions. >> she nuz to this, she's 28 years old. she will be the youngest woman elected to congress. that said, i don't think she is under an obligation to debate anybody who comes on for publicity. >> harris: you don't think bernie sanders put her in a position -- >> she should be debating her republican counterpart in the race. >> she has every right to say no from ben shapiro. ben shapiro is itted in the exchange of ideas, he's completely not afraid to go to college campuses, to the bell live the beast in some of these places and take questions from audience members and engage some of these call to students. i think ben shapiro isn't afraid and wants to have an honest conversation about some of her policy positions. we have seen, harris you pointed out with trevor noah and margaret hoover, she cannot defend her issues, she can't explain how the policies work in practice. an exchange of ideas is healthy and seems far often the left is afraid and doesn't want to have this thoughtful exchange. >> harris: you know what is interesting, i was talking about the previous local news interviews, koontd figure out policies in the middle east and said that's not my thing. what you talk about is a furtherance. i'm curious with the democrat party why is there a thirst to take this young woman who clearly is not ready yet, put her on a national stage. do you have no one else? >> i think there are other people. i think, let's face it, she won unexpectedly against a leader in congress. >> harris: 10-term senator. >> 10-term democrat, this is a big win, impressive young lady we can can support that. my uncomfortableness, the money offer and also the fact, ben shapiro, if you want to debate somebody how about e-mailing, calling, why doing this publicly. if you want to have a serious debate, and i think he's very good at debating and i think they should, not that she needs to. but do it in a respectful manner. >> harris: why, why -- >> lisa: why go to the sexism angle? that is pathetic. we saw hillary clinton do it during the campaign as well, accused bernie sanders of sexism. there was no sexism there. i'm tired of women doing this, particularly democrat women, of automatically throwing labels, it's sexist, it's racist. there is a sad devaluing of those terms. when you label everyone with things like that, the term no longer holds value and it should. >> harris: when you see it, you don't know what you are looking at in terms of legalities. you challenged me. i want to tell you where i sit on the money. >> yes, well literally, the chickens have come home to roost for rahm emmanuel. he's talking about more police officers. what they're saying is we can't handle the situation, it's beyond us, out of control. they want to treat people like safari animals with more wardens for the safari. no, the idea is that we need resources in the communities and these assets, eliminate, get rid of chicago's historical seg re dpags that's been fought against since king marched through here in 1966. the segregation. they are a in a situation where they need to have, they have plenty of chances, they're always doing things in the heat of crisis and lie to us because they don't deliver on those promises once the heat has dissipated. >> harris: wow, we know you not to be a person to mince words. with mayor rahm emmanuel, i assume that you probably, since we last talked, may have had contact with his office. what are they planning to do, going into this next weekend? i mean, the outside of putting more police on the streets, what you're talking about, more social issues. that's about politics. >> well, i've been in contact with tanika humphries, the mother of janae patterson, shot and killed this past weekend. rahm's words do nothing for that family, at all. the crocodile tears are bloody, his hands of blood on them when he wipes them. we're looking at the situation that he didn't start the corruption but we can't allow him to perpetuate it, can't allow him to perpetuate the segregation, the resources are segregated. he has been sitting on half a billion dollars of hud money for low income housing. on the south and west sides of chicago people have nonworking toilets 3 to 6 months. we have people who have, don't have heat in the wintertime. and running water in the summertime. could that half a billion dollars make a difference, yes. he spends a million dollars a block downtown. if he spent 50,000 a block on the south and west sides i bet he would see a reduction in violence. >> harris: i want to ask quickly before i have to let you go, headed into the new weekend, i know that you're very honed in and focused on how to make a difference. long term you have democrats in office for a long time, you have president who is creating those resources that you talk about. and no matter how anybody feels politically you can't fight the fact that black unemployment is the lowest it's been. it's part of that resource that you're looking at. are you willing to maybe sit down with this president?
