NEW ORLEANS (AP) — A federal appeals court says a Hispanic Iraq War veteran can revive his lawsuit over a beating by two New Orleans police officers who he said called him a “fake American.” The Times-Picayune/The New Orleans Advocate reports that the 5th U.S.

The Times-Picayune/The New Orleans Advocate reports that the 5th U.S. Circuit Court of Appeals ruled in favor of Jorge Gomez on Nov. 18.

A circuit court ruled in favor of Jorge Gomez, who alleges that two New Orleans police officers lied about their off-duty status before beating him in 2018.

Ferguson was booked with charges of trespassing, simple assault, criminal damage to property and two counts of battery of a police officer, court records show.

"This incident is being treated as any other incident of this nature would be," a spokesperson with the New Orleans Police Department said.
