tracing the group to this restaurant outing earlier in the evening. it's believed it was a 25th birthday party involving a group of archbishop wood high school grads. the victims tell police they're attackers men and women punched them repeatedly while shouting homophobic slurs. >> somebody said as we crossed 16th, what is that your f'ing boyfriend? i look at him and i said it is my f'ing the handle fan since 09 posted the restaurant photo and coc contacted police. >> just seemed like the right thing to do. something that disgusted me that would happen in our city. if i'm going to have a lot of twitter followers i might as well do something good with them. >> reporter: one local defense attorney involved in this case has told fox 29 that the events that is to say the comments and actions leading up to that first punch may not be as clear cut and one sided as we had first been told. the district attorney tells fox 29 this case would not or will not be charged as a hate crime because under the pennsylvania statute sexual orientation is not a covered category. iain. >> all right, bruce, thank you. we continue to track developments in a deadly attack on two troopers at a pennsylvania state police barracks. these are just released pictures of eric frein the suspect authorities are trying to track down. today many schools in the area were closed to the safety precaution while the manhunt for the gunman continues. police believe the attacker frein is anti government and very dangerous. frein is accuse evidence ambushing two troopers killing one and critically injuring the other last week and police releasing new information of their investigation a short time ago as they prepare to lay corporal brian dixon to rest. jennifer joyce is in scranton tonight with the latest. jennifer? >> reporter: well, iain, as many as 150 members law enforcement from three states have been aggressively tracking down leads and staking out a large wooded area where they believe 31 year old eric matthew 14 may be hiding. police just released updated photographs of the man accused of ambushing corporal dixon friday night as he was walking out of the blooming grove police barracks. police tell us he's a survival list who has weapons, knows how to use them and has a major hate tread to law enforcement. with frein the loose people in the area remain on edge. two school districts as you mentioned, iain, closed for the day as the search for the suspect continues. state police top brass are serious about this manhunt. >> i'd like to directly address eric frein again. hadn't recently been transferred to pike county from the belmont barracks in philadelphia. dixon leaves behind a wife and two young children and, again, he will be laid to rest. his funeral service is scheduled for tomorrow morning at 10:00 a.m. lucy. >> thatching jennifer. in delaware county an accident on i-95 southbound sent a trooper to crozer chester medical center. skyfox over the scene in tinicum township near the prospect park and essington skit. traffic was backed up to philadelphia international airport right around 11:30 this morning. bad news there. state police are not releasing details about what exactly happened. but they are saying the trooper has non-life threatening injuries. tragedy in philadelphia's university city. an eight year old girl has died after falling nine stories from an apartment building. police are investigating exactly what happened but all signs point to an accident. fox 29's dave schratwieser is live at the scene tonight. dave, such a sad story. >> reporter: lucy, a very sad day here at the fairfax apartments at 43rd and locust after that young lady -- young girl plunged nine floors to her death early this morning. police tell us now they have completed a thorough investigation and they do believe this was an accident. police say it was just before 8:00 wednesday morning when an eight year old girl fell from the window of a ninth floor apartment she shared here with her 11 year old sister and father. >> the father is a awakened to the 11 year old screaming the sister had fallen from the window. the father raced downstairs to find his daughter sprawled on the ground. he raced her to children's hospital where the child died. >> young father caring for two kids. 11 year old is extremely distraught from this. >> it's just a 2-dollar a pack cigarette tax in the city to provide for more money for the schools. a vote today was put off. lawmakers removed unrelated tax hikes and tax credits that had been added to the bill. arguments over those additions has delayed the legislation it must pass the state senate as well. >> new jersey lawmakers unveiled a series of 21 bills aimed at curbing heroin and prescription drug abuse. the state's senate health committee says new jersey needs treatment and education and prevention efforts and that includes requiring health insurance plans covered drug treatment programs when deemed medically necessary. another of the measures would increase the state's medicaid reimbursement for drug treatment programs. >> the house select committee investigating at tack on the us consulate in benghazi libya heard some testimony today. >> the first open hearing since it began investigating what exactly happened and why. it zeroed in on 40 reforms recommended by independent doctors. >> reporter: jenny davis had just learned she was five weeks pregnant with her third daughter brantly when she felt it, a lump while breast feeding her other baby seven month old nolan. >> i thought it was milk, and i wasn't worried about it. >> reporter: doctors were worried. but because she was so early on in her pregnancy, they had to wait to biopsy the mass. >> during that time just a couple of months the tumor had doubled in size. >> she was 27 and diagnosed with the most -- one of the most aggressive types of breast cancer we see which is triple negative. >> i was very scare. i was scared for brantly. and for my family. >> we always have to make a decision on whether to delay therapy or treat right away. jenny's oncologist dr. jonathan bender felt they had to start treatment right away. four rounds of chemo during her second and third trimester. two more after the baby was bo born. the idea to jenny was terrifyi terrifying. >> trying to save my life and trying not to harm her life was very hard. >> reporter: dr. bender says even doctors are surprised that pregnant women can be safely treated with chemo using a combination of drugs that is less toxic to the fetus. >> the studies have shown that as long as you wait till the second or third trimester after most of the baby's organs are already formed, that the potential birth defect risks are a lot lower. >> i went through three types of chemo. all at one time and i went every three weeks, and since i had one lymph node involved i had to go through six rounds of chemo. >> reporter: during her infusions jenny could feel brantly kicking. brandly was diagnosed in utero with a clef lip and palate. birth defects not related to the cancer or the chemo. on jenny's 28th birthday, brantly was born. spending her two weeks in a neonatal intensive care unit. >> a big weight was just lifted when -- we knew we got to bring her home and we were altogether and that, you know, i've got to do this. i've got to do these last two chemos. >> because she positive for a gene in raises her risk of breast and ovarian cancer she chose to have both breasts, her uterus and ovaries surgically removed. >> when you see someone like jennifer davis whose gone through all the obstacles and she's still shining brightly, it brings a big smile to my face. she's a success story that keeps you getting up in the morning and doing this job. >> reporter: brant system now five and doing really well. so is jenny. cancer free, five years, four months and counting. >> i'm so fortunate to be here and i get to live out my dream to watch my kids grow up and to take care of them. >> our dawn timmeney with that amazing story. they say a dog is a man's best friend and a homeless veteran from chester county most certainly agrees. anthony weatherly and his dog sheba helped him through a lot living in squaller, battling the freezing cold. both were in despite need of help and medical attention. veterans affairs tried to help him get into shelter but no dogs allowed. he just couldn't leave the dog so a local non-profit stepped in. and teamed up with stoney creek veterinary hospital to take in sheba. they separated for bit and both got the help they needed. >> it changed everything. it changed me. change thed -- gave me a future back. >> unbelievable feeling when you turn's live around. >> now both are on the road to rare and very difficult to treat. ford became actually made international headlines last year after acknowledging using crack cocaine in a done ken stooper. he returned to work in june after a fall preview continuing across our area. the low this morning in philadelphia 56 degrees. the afternoon high 75. we should be at 78 for this time of year so just a few degrees below average but we'll take it. because look at the record for today's date, 94 degrees set back in 1991. once again we're not talking about 90-degree heat in that seven day but we are looking at a warmup coming up. 74 degrees right now in center city. you can see a beautiful skyline. we have sunshine. a few high clouds look at the low humidity at 37%. and the winds are currently ca calm. ultimate doppler it is scanning the area we're not looking at any rainfall so now is a good time to wash your car. because we are talking dry conditions with that high pressure in control. but take a look at the north around canada and the border with the us. we're talking about a colder push of air arriving by friday morning. some locations get this could end up in the mid 30s for lows by friday morning. we'll talk about that in minute. but high pressure settled overhead and we're looking at dry conditions. as we roll the clock. you can see pretty quiet overnight. so another cool start for your thursday morning. a lot of sunshine across the area as well. but then a frontal boundary that front from canada arrives thursday night into friday morning dropping our temperatures so 70s right now in philadelphia. 60s pretty much north and west but you can see behind that front we're talking about those numbers already dipping into the 40s for most. so we'll watch how things play out for tonight. similar to last night. those temperatures dropped by tomorrow morning into the mid and upper 50s around philadelphia. we're looking at 50 in pottsto pottstown. upper 40's north and west and then by tomorrow afternoon, temperatures recover nicely. but watch the clock. friday morning, we're looking at upper 40s in trenton and look north and west. upper 30s in allentown, 36 degrees in the pocono mountains. so things are getting chilly as we move into friday morning. the tropic still watching that heavy rainfall moving into sections of arizona and new mexico. some locations could receive up to a half a foot of rainfall and some devastating flooding there, of course, we'll continue to watch that. for us tonight we're looking upper 40s in the suburbs. mid 50s in the city and then for your thursday, those temperatures rebound nicely. we're looking at a high of 76 degrees and then cooler for friday. only highs in the low 70s. the temple game beautiful weather upper 70s and then sunday we warm things up for the eagles at home against the redskins temperatures will be in the low 80s. >> perfect. thank you very much, scott. >> it will be perfect at the linc for those washington redskins. quarterback robert griffin the third. but this time there is more to this game. and that would be desean jackson. this is the first time he's going against his former team. now, last week, desean jackson suffered an injury to his ac joint in the shoulder. but said today he's playing in the game. now, i'm sure it would take a lot for desean to miss this game. he's doing something different than he did with the eagles. he says he's putting his team finally ahead of himself. >> i feel put on the line when i played there. what i've done to help that organization win games. as far as congratulating me or boo me, whatever the case may be, i'm ready for whatever it is. >> do the eagles have an advantage this week? >> remember, they used to practice against desean. >> practice means nothing, man. nothing. game speed is totally different than a practice tempo, man. so i expect him to be at his best and i'll be at my best and going to play it like that. as far as i'm concerned practice has nothing to do with how well he's going to play in the game because i know he's a gamer. >> eagles will try to hit him hard, too. eagles also know what they have with darrin sproles and for the first time in his rear career he receive the offensive player of the week. he was a big reason for the eagles win on monday night. one of the eagles offensive lineman filling in for the injuries andrew gardner saw how good the combination of sproles and lesean mccoy back when he first saw them on the field. >> i marveling at those guys in the ota's. i was just -- i was excited to get chance to play with them and i've been a big fan of both of them for years. really watching what shady did here last year in particular and i remember sproles all the way back to what he did in that
