The petitioners placed reliance on a judgment of the Supreme Court which held that the High Court must ascertain whether any part of the cause of action arose in jurisdiction.
The Court said that the amended clause(e) of Section 10(2) of the Motor Vehicles Act had replaced all types of commercial vehicles with 'transport vehicles', which includes goods vehicles and passenger-carrying vehicles.
The claimants before the High Court stated that the tribunal did not decide the case in accordance with law and has granted a meager amount of ₹50,000 compensation.
