now. defense attorneys make one last appeal to the jury this morning in the george zimmerman trial. >> and later this afternoon, they are finally expected to go behind closed doors and begin deciding zimmerman's fate. abc's preeti arla has more on this highly emotional case. >> reporter: the george zimmerman trial wrapped up today with closing arguments from the defense. it's their last chance to convince the jury of six women that zimmerman acted in self-defense when he shot and killed 17-year-old trayvon martin. the prosecution took an emotional approach during closing arguments yesterday. >> a teenager is dead. he is dead through no fault of his own. >> reporter: the prosecutor called zimmerman a wannabe cop who took the law into his own hands. he said zimmerman profiled martin as a criminal. and it's because he acted on that wrong assumption that martin is dead. >> it was raining. he was wearing a hoodie. last i heard, that's not against the law. but in this man's eyes, he was up to no good. he presumed something that was not true. >> reporter: zimmerman stared blankly in court. but the prosecutor seemed to strike a cord with one juror, who looked away as jurors were shown pictures of martin's body. >> do you believe that there's an innocent man sitting over there right now? >> reporter: the jury could convict zimmerman of either second-degree murder or a lesser charge of manslaughter. though in florida, manslaughter convictions carry tough penalties, and zimmerman could still get life in prison. the third option, the jury finds him not guilty. the state of florida is preparing for possible violence if zimmerman walks out of that courthouse as a free man. police are ready to react. and they've been working with local religious leaders, calling for a peaceful breaking news from russia on efforts to return edward snowden to the u.s. several human rights groups are meeting with snowden today at the moscow airport where he's been hiding for three weeks. snowden has asked for asylum in more than 20 countries. but "the new york times" reports that the u.s. is pressuring countries in latin america not to give snowden asylum. also, investigators looking into asiana flight 214's doomed landing in san francisco, say they're making progress. but their work has only just begun. the big job of clearing the damaged tarmac is under way, with crews removing a huge section of the fuselage overnight. it's said to be stored in a hangar where investigators can zero in on a possible cause. so far, they say they have no evidence of mechanical or electrical failure in that plane. that means they'll be focusing more closely, now, on what the pilots did and said before and during that deadly crash. former new york governor eliot spitzer has taken another step toward a political comeback. just days after announcing plans to run for new york city comptroller, spitzer met the deadline to submit the petition signatures required to run. a prostitution scandal forced spitzer to resign in 2008. now, he's asking new yorkers to give him a second chance. egyptians are bracing for another round of possible clashes today, as supporters of their ousted president called for more protests. the muslim brotherhood wants people to rally in the streets for the reinstatement of mohamed morsi. morsi is believed to still be in the country, held up at a military compound in cairo. and it's a big day for the pakistani schoolgirl who nearly died after she was shot in the head by the taliban for promoting education for girls. malala yousufzai will give her first public speech this morning, taking place at the united nations. the address to a special gathering of young people actually comes on her 16th birthday. an emotional meeting last night in newtown, connecticut, as residents discuss how to divide the $11 million in donations after the sandy hook shooting. a preliminary plan would give $7 million to the victims and their families with the rest goes to the community. some residents say they don't like that. >> why isn't all of the money going to the victims? the american public gave very generously out of their hearts because they saw those people who were killed so violently, so tragically. >> i don't want to criticize anybody because this town has been overwhelmingly wonderful to all of us. so, it is what it is. it's almost over. six months later. i'm happy it's almost over. and we'll go on. >> under that plan, each family who lost a loved one in the shooting would get $281,000. the families of 12 surviving children who witnessed the shooting would each get $20,000. and two teachers who were injured would get $150,000 between them. investigators may have cracked one of the nation's biggest unsolved mysteries. the man long believed to be the boston strangler has apparently been linked by dna to the strangler's last victim. albert desalvo confessed to the murders that terrorized boston in the '60s. but it was inadmissible. dna testing wasn't around back then and he was never prosecuted. the family of that final victim who is 19 years old is thankful that detectives never gave up. >> i've lived with mary's memory every day. my whole life. and i didn't know nor did my mother know that other people were living with her memory, as well. and it's amazing to me today, to understand that people really did care about what happened to my aunt. >> in 1973, desalvo was stabbed to death in prison where he was serving a life sentence on other charges. his remains will now be exhumed to look for an exact dna match. 24 bodies have now been found in the aftermath of that canadian train derailment. investigators say they believe at least 50 people died in the accident. so, the search goes on for more remains. the u.s. owner of the runaway train has been heavily criticized for not visiting the site until four days after that accident. you may wonder just what the hubble telescope is up to out there in space. well, get this. it actually revealed the existence of a distant, deep blue planet, 63 light years from earth. this is an illustration what blue planet may look like. hubble actually found it back in 2005, but the telescope observations just now helped nailed down its color. though it may be a pretty color, you wouldn't want to live there. that's because daytime temperatures run about 2,000 degrees fahrenheit. that's hotter than arizona. >> i'll stick around in new york where it's about 70. >> yeah. we'll take that. thankfully it's a lot cooler here on earth. today, you can expect morning, a good samaritan takes down a runaway thief. and welcome back. wall street kicks off this morning in brand-new territory after benchmark indices soared to record highs. the dow hit 15,460. the nasdaq hit its highest level in nearly 13 years. and the s&p closed at its highest level ever. the rally is fueled by federal reserve chief chair ben bernanke promising to keep the money policies in place as long as it's needed. and those historically low mortgage rates are really history. the average rate on a 30-year fixed rate mortgage is now at 4.51%, a two-year high and more than a full percentage point higher than just six months ago. but experts say it's good news. higher mortgage rates are actually a sign that the economy is doing better. also on the climb, gas prices, thanks to rising crude oil prices and also a drop in u.s. supplies. the price at the pump is now up 4 cents in the past week to a national average of $3.52 a gallon. and experts say it could climb another 15 cents or more over the next two weeks during the annual july peak. things aren't looking so rosy for paula deen, who is scrambling now to save her crumbling empire. she fired and replaced her legal team, after cutting ties last week with her long-time agent, who helped launch her into food network stardom. it's the latest fallout from her admission that she used racial slurs in the past. and welcome to mornings on 2. it's saturday july 13th. >> we go straight to rosemary to take a look at how the weekend is shaping up. good morning. >> reporter: good morning to you. we have another comfortable day in store for most of us. we remain parked with high pressure to the east and a low parked over the coastline. the ridge will pull this way just a little bit. that will lead to a few degrees of warming for the inland areas especially for the afternoon. this morning we are starting out with some low clouds and it's a cool start. we will look at the current conditions and the afternoon highs. >> police are investigating a deadly attack at a san francisco gold and jewelry store. alex savage joins us live from the scene with the dramatic ending that led to the suspect's arrest. >> reporter: and this morning police aren't say figure this was a robbery that ended violently or a personal dispute but the two women were found dead inside the jewelry marte at 888 brandon street and both of them were employees of the jewelry store located onto basement level of this building. police say a man was seriously wounded in the attack and witnesses say that he is the store's owner. the man police say was responsible for this deadly attack was taken in to custody yesterday but he didn't give up without a night. this man who was covered in blood opened fire on the first officers who arrived to this scene. eventually the man ran out of ammunition and gave up. police were searching the building for possibly a second shooter. police evacuated about a hundred or so stores inside the jewelry marte and for those who work in this building and know the victims, they are devastated. >> our building is a kind of family. we know each other, everybody is friendly to -- it's just sad it'll be hard for the people they see the scenery to stay in their mind, i don't know how they will live with it. it's not easy. >> reporter: the man accused of this attack so far is not being identified by police. officers recovered a hand gun and a folding knife from this scene yesterday. the store own erin juried is in the hospital in critical condition but we are told he is expected to survive. now police say that surveillance video from this area suggests that the gunman in this case acted alone and that the chief also added yesterday this was not the first time this man had been seen here in this building. we are live in san francisco >> a father of a missing child is out of jail this morning and he says he is distraught about his daughter's disappearance. the 49-year-old john webb was arrested on suspicious of child endangerment after his daughter went missing on wednesday. last night webb was released from jail after prosecutors decided not to file charges against him. he told police that he left his daughter in a car with his mother who he said has dementia while he went inside a store. the girl was gone when he returned. >> my daughter is missing i have to live with that even though i'm out of jail i'm still not free >> reporter: he said both he and his wife had nothing to do with their daughter's disappearance. a vigil was held last night in the neighborhood where she was reported missing. >> new this morning san jose police are investigating a deadly shooting. it happened about 9:45 last night on state and archer street. the victim was talking to someone on the sidewalk when a gunman walked up and shot him. he was rushed to the hospital where he later died. no arrests have been made. new information now about the man killed in a large apartment fire in redwood. the san mateo coroner identities him as a 48-year-old darron michael demello pine. more than 20 were hurt and nearly 100 were left without a place to live. the cause the fire is under investigation but officials believe it started in the victim's third floor apartment. cal ocea is investigating after a janitor was crushed and killed at a grocery store in redwood the 43-year-old was found inside a machine used to crush card board boxes. septemberors are inspecting that machine the janitor worked there for five-years >> now to the crash of flight 214, all four runways at sfo are open this morning. runway 28 opened yesterday. it was closed for nearly a wekas because of last saturday's crash. workers laid down a thousand tons of new asphalt, replaced navigation lights and removed jet fuel that had spilled from the plane. the airline and it's insurance agents will pay for the repairs. >> we will submit a claim. >> the estimate? >> reporter: yeah. this crime troubling. many business owners here knew the victims. there is about a hundred or so stores, at 888 brandon street. it'll be opening back up later on today. yesterday's attack left two women dead and we are told they were both employees at the jewelry store located on the basement level. police also say a man was seriously wounded and witnesses say that he is the store's owner. investigators right now aren't saying whether this was a robbery that just ended with violence or some kind of personal dispute between the attacker and the victims. the man police say carried out thea falk was eventually taken into custody but he didn't give up without a fight . the man opened fire on officers . none of those officers were hit by gun fire. eventually the man ran out of ammunition after ducking inside a restaurant and eventually gave up. one neighboring business own told us about the two women who were killed. >> they are very friendly. peace fly. they don't bother nobody. always smiling. talking to people. >> reporter: so far police are not identitying the man they took into custody yesterday accused of carrying out this attack but police will say they recovered both a hand gun and a folding knife from the scene. the store owner hurt in the attack remains in the hospital in critical condition but we are told he will survive his injuries and police do believe that the gunman in this case did act alone in this attack and that the chief also did say yesterday -- the chief said this man had been here to this building in the past. it's not clear what his connection was to the victims >> poisonous meat balls found in two neighborhoods could pose a threat to humans. the tainted meat balls were found in the twin peaks and diamond heights areas. they have levels of poison that could be lethel for humans. it also can be absorbed through the skin. they advice anyone who comes across anything suspicious to call the police. if you think your dog ate one call a vet immediately. san francisco animal care and control said a dog has died after eating one of the meat balls. his owner said he ate one in their diamond heights neighborhood on july 3rd. police found dozens of other tainted meat balls and continue to look for the person responsible. it's containing in those meat balling a highley toxic pesticide. >> and now to the crash of flight 214. sfo runways and once again operational. it reopened just after five the airport had to work quickly to workers put down new asphalt and removed jet fuel that had spilled from the airplane. officials say the insurance agent will pay for the repairs. >> doctors say they did everything they could but a third crash victim, another girl has died. as the family mourns they ask the hospital not to release details about her such as age, name or her injuries. she had been in the intensive care unit since the crash. a group of students in south korea gathered to pay respects to the victims. it included bowing their heads and holding a flower. there was also a photograph of two of the teens killed on the day of the crash. a student read a letter that will be sent to the teen's families. the group then went to the chinese embassy to offer messages of support. >> a tour bus driver arrested at san francisco on drunk driving charges is scheduled to be arraigned later this month. the 60-year-old was arrested last friday near stockton. he was driving a deluxe sightseeing tour bus when he was arrested. he faces charges that include driving under the influence and driving with an open container of alcohol. a teen boy is recovering from serious injuries after falling through a sky light at a funeral home. the 13-year-old broke through the glass on the roof of fernwood last night. he felll 15 feet and suffered deep cuts from the glass. firefighters say he lost a lot of blood but was in stable condition. they are trying to find what he was doing on the roof and how he fell. >> a jury awarded a south bay family a million dollars in a civil lawsuit filed against the city of san jose. the case is from the 2007 death of steve solinas who died in a confrontation with police after an officer tazed him multiple tiles. he was high on pcp but the attorney said he was unarmed and argued that the taser use was excessive and contributed to his death. >> there is wrongful death out there. a lot of cases aren't proven but we took this to trial and i'm happy that we did. >> san jose city attorney said the city is disappointed in the ruling and is considering an appeal. oakland city workers could get a pay race after the city and two of its unions reached a possible deal on a new contract. it would give some 3500 workers a 2% race. last week workers staged a one day strike during the contract negotiations. >> it's a wait and see game for people in the bay area who depend on bart to get to work as the possibility of another strike looms. both sides did meet for several hours in oakland to continue negotiation. worker contract extenses expired at the beginning of next month and if they do not reach a deal they say they will strike again talks aren't scheduled to resume until monday morning >> bart police are look for people caught on video having sex in a train car. it's believed a third person use aid cell phone to take pictures. lewd activity is ill legal. the video is a little grainy but they hope that someone can still identity those involved. >> a temporary fix proposed that could let the new eastern span of the bay bridge open by labor day. it was delayed after the finding of cracked bolts in march but now they are proposing a temporary solution. long interest they have asked to review the proposal and though the opening day of the new span is on hold some finishing touches are being made. yesterday cruise paved the suspension span with special asphalt with a high strength epoxy glue. it's only two inches anybody and is designed to announce he would seek asylum. it could be a temporary move before going to countries that have offered him protection. the president spoke with the russian president yesterday about snowden. the white house said that russia gave him a platform by letting him meet with activists. a panel is pushing for more safety after last year's -- fire at the chevron refinery. the panel is suggesting a task force be created as part of the state epa and use existing regulators from other agencies. the force would have greater control over penalties related to refinery accidents and would develop a lot of booze to the waterways. last year more than 3,000 people took part in the event and 23 people were arrested. authorities say fights break out on the riverbanks after rocks were thrown at the live from the scene with the dramatic ending that led to the suspect's arrest. good morning. >> reporter: good morning. it was a scary scene for a lot of the other store owners. one man told me that essentially he was two doors away, heard the gun fire inside of 888 brandon street this is the gift center and jewelry area. some shop owner was returning to close up shop because yesterday they left in a hurry. two women were left dead in this attack. they were both employees of a jewelry store located on the basement level of this building. polices say there was a man who was seriously wounded and witnesses are telling us that he is the store's owner. investigators right now aren't saying what the motive was for this crime. the man police say carried out this deadly attack opened fire on the first officers who showed up at this scene. this was outside on the street . none of them were hit and when the man eventually ran out of ammunition he gave up. police right now are not releasing the gunman's name. s.w.a.t searched the building yesterday for any other possible shooters but they believe this man acted alone. i talked to a store owner who said he hid out during the attack. >> scary, i was actually about two stores away from the incident and we heard a really loud gun shot and we started hiding. you know, 30 seconds later we heard more shots and you can just imagine it was really scary >> reporter: police recovered a hand gun and a folding knife from the crime scene. that store owner who was injured in the attack remains in critical condition in the hospital but we are told by police that he is expected to survive. surveillance video from this area suggests that the gunman did act alone and that the chief of police here in san francisco also said that this is not the first time this man had been inside this building. while police aren't saying what the connection was between the attacker in this case and the victims, some of the other store owners i talked too said this doesn't seem like it was a robbery. they believe that this was some kind of personal dispute that led up to this deadly attack. live in san francisco, alex savage. >> a father of a missing oakland child is out of jail this morning and he said he is upset about his daughter's disappearance. he was arrested on suspicious of child endangerment after his daughter went missing on wednesday. last night he was released from jail after prosecutors decided not to file charges against him. he told police that he left his daughter in a car with his mother who he said has dementia as he went inside a store. he said the girl was gone when he returned. >> my daughter is missing and i have to live with that even though i'm out of jail i'm still not free. that's how i feel. >> he said both he and his wife had nothing to do with their daughter's disappearance. last night a vigil was held where she was reported missing. >> new this morning san jose police are investigating a deadly shooting. it happened at about 9:45 last night on state and archer street. the victim was talking to someone on the sidewalk when a gunman walked up and shot him. he was rushed to the hospital where he later died. so far no arrests have been made. and we know the identity of the man killed in a large apartment fire in redwood. the san mateo coroner has identified him as a 48-year- old. more than 20 people including several firefighters were hurt and nearly 100 tenants were left without a place to live. the cause is still under investigation but it's believed to have started in the third floor. cal rocea is investigating after a janitor was crushed and killed. the 43-year-old was found about ten thursday night inside a machine used to crush card board. investigators are inspecting that machine. the janitor worked there for five-years. grief counselor s will be there today. >> all four run yeahs at sfo are open this morning. we talked to the airport duty manager who said there are minimal delays. one rey 2-8 left opened two day as head of schedule. it was closed for nearly a week because of the crash. workers laid down nearly a thousand tons of asphalt and removed jet fuel that had spilled from the fuel. the airlines and it's insurance agent will pay for the repairs. passengers are confident things are getting back to normal. >> don't have any reservations, i'm confident in the pilots and the flight staff. i'm looking forward for him to have a good trip >> the first plane to land on it was a southwest airlines flight just a little after five. the burned out fusel aps being kept in a fenced off area, sfo said it'll probably stay on the property for at least another week. the plane has been attracting on lookers. people have driven by and stopped to take pictures with the air craft. >> i cannot even believe i'm here watching this. i can't believe i can stand here and see this wreckage up close and personal. >> sfo officials say it's up to asiana to dispose of the wreck inland wreckage. >> doctors at san francisco general said they did all they could but a third crash victim has died. as the family mourns they have asked the hospital not to release details like her age, name or her injuries. doctors do say she had been in the intensive care unit since the crash. >> we habeen asked by the family to provide them with time and space to appropriately mourn this tragic loss. >> san francisco general treated a total of 67 people from flight 214. 36 adults and 31 children children. two patients listed in critical condition. stanford hospital has one patient in serious condition. san francisco police chief confirms that one of the teens who died on the day of the crash was run over by an emergency vehicle. he said the body of the 16-year- old was found on the ground covered with foam that the fire crews used to put owl the fire. the coroner is still trying to determine her cause of death. >> a deadly crash near vacaville is being investigated. it was reported on pleasant valley road. early reports indicate a vehicle overturned and at least two people were inside that vehicle. the chp said one person died at the scene. >> your time is 8:08 and than 2,000 demonstrators filling the capitol in austin. the governor texas said he will sign it the next few days. it bans abortions after 20 weeks and requires them to take place in surgical centers. democrats who delayed it last month say they plan to take that issue to court. >> california attorney general calls a petition to stop gay marriages in california baseless. the state started allowing them two days after the court dismissed proposition 8 but measures supporters have filed a petition claiming that the proposition should still be law since the court didn't specifically rule on the constitution ality of gay marriage. the filing also argue that the suit against proposition eight only named two counties, and so the ban should still apply in the other 56. the governor is urging the initial collapse but when they got to him they could actually see him for a little bit, tried to dig him out and the total collapse happened. >> the boy was taken to the hospital. he was playing in an area that was closed for restoration. a lunchtime dare is likely to blame for making more than a dozen sick in san diego. school officials say 22 elementary school students dared each other to drink an attack at a jewelry marte. what witnesses say they heard during the chaos. good morning. welcome back. >> san francisco police are investigating a deadly attack at a san francisco gold and jewelry store. it happened yesterday at about 2:15 located in basement of a gift marte. two women were killed and a man injured. other shop owners say the women were employees and that the match is the store owner. the suspect is in police custody. he was arrested after firing shots at officers. >> there was a lot of screaming and just people running up and down the hallways, frantic. >> we ducked into a room and then they started locking the doors, from there they told us to get in the back of the building. >> suspect was treated for superficial rooms. the male victim is in critical condition but is expected to survive. investigators found a foldable knife and gun at the scene. they say they don't know the motive right now. the owners of 888 brandon said we are saddened by the shootings at 888 brandon. we extend our sympathies. the attack caused scary moments. police evacuated the stores inside the jewelry marte. other office buildings nearby were locked down. people were finally allowed to leave about four hours after the shooting. we talked to a store owner who said she knows the two women when were killed and said one victim was in her 30s, the other in her 40s. >> very nice people. i mean, two nice girls and the owner, very nice person. >> the identities of those victims have not been released. >> poisonous meat balls could pose a threat to humans. the tainted meat balls were found in the twin peaks and diamond heights neighborhoods. they contained levels of poison that could be lethel for humans. they warn that poison could be absorbed through the skin. police are advising anyone that comes across anything suspicious call the police and if your dog eats one contact the vet immediately. san francisco animal care and control said a dog named oscar died after he ate one of the meat balls. his owner said oscar ate it in their diamond heights neighborhood on july 3rd. police say they have found dozens of other tainted meat balls and continue to look for the person responsible. >> now to the crash of flight 214, sfo runway 2-8 left is operational again. it reopened just after five last night. two days ahead of schedule with only three runways in service. the airport had to work quickly to reopen due to continued flight delays. workers put down new asphalt, replaced navigation lights and removed jet fuel that spilled from the plane. officials say to be arraign the later this month. the 60-year-old was arrested last friday near stockton and poe streets. he was driving a delux sightseeing tour bus when he was arrested. he faces charges that include driving under the influence and driving with an open container of alcohol. his arraignment is set for july 22nd. and a teen is recovering after falling through a sky light in a funeral home. the 13-year-old broke through the glass. he fell 15 feet and suffered deep cuts from the glass. firefighters say he lost a lot of blood but is now in stable condition. they are trying to find out what he was doing on that roof and how he fell. >> a jury awarded a family one million dollars in a civil lawsuit filed against the city of san jose. the case stems from the 2007 death of steve solinas. he died in a confrontation after an officer used a taser on him. families say he was high on pcp at the time but the attorney said he was unarmed and argued that the taser use was excessive and contradicted to his death. >> there is wrongful death out there. a lot of cases aren't proven but we took this to trial and i'm happy that we did. >> san jose city attorney said the city is disappointed in the ruling and is considering appealing. oakland city workers could get their first pay race in six years. that's after the city and two of its largest unions reached a possible deal on a new contract to give the workers a 2% race this monday and a 1% raise next july. workers staged a one day strike during the negotiations. >> it is a wait and see game for people in bay area who depend on bart to get to work and get around every day and the possibility of another strike is still looming. now both sides metaphor several hours in oakland yesterday to continue labor negotiations. worker contract extensions expire at the beginning of next month. and if they do not reach a deal the unions have said they will strike again. they aren't available for the weekend so talks aren't scheduled to resume until monday morning. bart police are also looking for a couple caught on video having sex in a train car. officers believe a third person used a cell phone to take pictures of them. lewd activity is illegal, violater cscope be banned from riding. investigators say the video is grainy but they are hoping it'll help them identity the people involved. >> a temporary fix is being proposed that could let the new eastern span open by labor day. it was delayed after the find of cracked bolts but now a solution is being proposed. it would install shims to for more safety oversight following last year's fire at the chevron refinery. they suggested a task force be created as part of the epa and use existing regulators other agencies. the task force would have later penalties and would have a realtime monitoring system. month -- jerry brown has declared a state of emergency more than a month after a devastating fire. it's called the power house fire. it burned 47 square miles of brush . the fire started on may 30th. it was contained two weeks later. it lets the county qualify for federal funds, that would be used to prepare roadways damaged by the blaze. > the homeland security secretary is moving to be the next president of the university of california. she stepped down yesterday as secretary of homeland security. she would be the first woman to lead the ten campus uc system. the lieutenant governor who sits on the board said her abilities as a leader trump her lack of experience. >> outside the box choice. we get someone with a fresh cost almost twice as much as it does now. california prison officials report a break-in a statewide hunger strike. they say about 7700 refused to eat yesterday. that's down from more than 12,000 on a strike thursday and 30,000 earlier this week. the state considers it a hunger strike after they skip nine meals. prisoners are protesting solitary confinement. >> limited dining hours, closed offices and reduced flying time. that's what workers at travis air force base had as the first day of furloughs took effect. more than 1500 civilians at the base took the dayoff yesterday. furloughs caused by budge cuts will be in effect every friday through september 21st. during that time civilian employees cannot exceed 32 hours a week. city leaders in concord will celebrate a 2 million- dollar grant to 2:15 at the store located in the basement of the gift center and jewelry mart at 8th and brannon. two women were killed and a man was seriously hurt. other shop owners say the women were employees and the man is the store owner. the suspect is in police custody. he was arrested after police say he fired shots at officers. >> there was a lot of screaming and just people running up and down the hallways, frantic. >> we ducked into a room. then they started locking the doors. from there, they told us to get in the back of the building. >> the suspect was treated for superficial wounds. the male victim is in critical condition, but is expected to survive. investigators say they found a foldable knife and revolver at the scene. they also say they do not have a motive right now. the owners of 888 issued a statement saying, in part, we are truly saddened bit shootings. we extend our sympathies to the families of those involved. yesterday's deadly -- [ no audio ] >> two very nice girls. owner, very nice person. >> there was a short evacuation, but eventually people were allowed to come back in. it lasted about four hours after the shooting. one store owner you heard from says she does know the two women killed and says one of the victim was in her thirties, the other in her forties. new this morning, a fatal accident near vacaville right now under investigation. it was reported shortly before 5:00 this morning on pleasant valley road near foot hill drive. early reports indicate that the vehicle may have overturned. there were at least two people in that vehicle. the chp says one person died at the scene. the father of a missing oakland toddler is out of jail this morning and he says he is distraught about his daughter's disappearance. 49-year-old john webb was arrested on suspicion of child endangerment after his 21-month- old daughter daphne went missing on wednesday. last night, webb was released from jail, after prosecutors decided not to file charges against him. webb told police he left his daughter in a car with his mother, who he says has dementia, while he went inside a convenience store in oakland. he says daphne was gone when he returned. >> my daughter is missing, and i have to live with that, even though i'm out of jail, still not free. >> webb says both he and his wife had nothing to do with their daughter's disappearance. last night, a vigil was held in the east oakland neighborhood where daphne was reported missing. san jose police are investigating a deadly shooting. it happened 9:45 last night on state and archer street. the victim was talking with someone on the sidewalk when a gunman walked up and shot him. he was rushed to the hospital, where he later died. so far, no arrests have been made. new information about the man killed in a large apartment fire in redwood city. the san mateo county coroner's office identifies him as 48- year-old darren michael pine. more than 20 people, including several firefighters, were hurt. nearly a hundred tenants left without a place to live. the cause of the fire is still under investigation. but officials believe it started in the victim's third floor apartment. happening now, all four run ways at sfo are open this morning, and we just talked to the airport duty manager, who says there are minimal flight delays. runway 28-left opened last night, two days ahead of schedule. it was closed for nearly a week because of last saturday's crash. workers laid down a thousand tons of new asphalt, replaced navigation lights, and removed jet fuel that had spilled from the aircraft. asiana airlines and its insurance agent will pay for the repairs. passengers are quite confident things are getting back to normal. >> don't have any reservations at all. i'm pretty confident in the pilots and the flight staff. you know, i'm looking forward for him to have a good trip. >> the first plane to land on the repaved runway was a southwest airlines flight, a little after 5:00 last night. minutes ago, the associated press quoting chinese state media released the name of the third person to die in the crash of 214. the girl died yesterday morning at san francisco general hospital. chinese state media have identified her as lia yi pang and say she was a student who went to the same school as the other girls who died in the crash. her grieving family has asked the hospital not to release information about her, but doctors did say she has been in the intensive care unit since the crash. >> we've been asked by the family to provide them with some time and some space to appropriately mourn this tragic loss. >> san francisco general treated a total of 67 people from flight 214. 36 adults and 31 children were included. there are still six crash victims in the hospital, one male adult and five females, including a girl. two patients are listed in critical condition. stanford hospital has one patient in serious condition. san francisco police chief greg suhr confirms that one of the chinese teenagers who died on the day of the crash was run over by an emergency vehicle. he says the body of 16-year-old yi among wen was found on the ground, covered with foam that the fire crews had used to extinguish the fire on the plane. the san mateo county coroner's office is still trying to determine her exact cause of death. happening now, jurors in the george zimmerman murder trial are deliberating for a second day. they will decide whether the neighborhood watchman committed a crime or acted in self defense when he shot and killed 17-year-old rosemary. a big race on san francisco bay is finally scheduled to take place today. the world's most famous sailing competition, the america's cup has had problems up to this day. but two challengers hope to put the troubles behind them and give sailing fans a san francisco treat. ktvu's alex savidge has more with what we can expect at the waterfront. >> reporter: mike, there have been a couple of races involving just a single boat out on the bay, but today, the competition really heats up. we'll have our first head-to- head race involving two america's cup challengers. before that all happens, there's going to be quite a bit of activity at the america's cup pavillion, starting about an hour or so from now, when fans will be making their way in here. there will be a marching band, trophy on presentation as well, and then eventually at noon, 12:15 to be precise, two america's cup challengers will finally square off against each other out on the water. italy's luna rosa team will face the emirates team of new zealand at 12:15. this is the first head-to-head matchup in the louis vuitton cup, a preclude to the america's cup that happens this september. these boats will be going fast today, close to 46 miles per hour. both the emirates team and the luna rosa team have only sailed in solo races so far. that's because their scheduled opponent is still working to get back on the [ applause ] >> lawmakers passed the legislation just before midnight central time. democrats strongly opposed the bill, with more than 2000 demonstrators filling the capitol billing in austin. but the governor of texas will sign the bill in the next few days, banning abortions after 20 weeks and requires all abortions take place in surgical centers. democrats who successfully delayed the bill last month through a late night filibuster plan to take the issue to the courts. in ohio, the man accused of holding three women captive for a decade now faces nearly a thousand criminal charges. prosecutors have filed a 977- count indictment against suspect ariel castro. charges include rape, kidnapping and aggravated murder. castro is accused of starving and punching one of his victims who was pregnant until she miscarried. prosecutors have not yet decided whether to seek the death penalty. in france, investigators are looking into whether a faulty switch may have caused a train derailment last night that killed six people near paris. nearly 200 people were hurt in the crash and nine are still in critical condition. the packed train had just left paris, with 385 passengers on board when it crashed right into a station platform. investigators say human error has already been ruled out as a cause. it is france's deadliest crash in years. it has been one week since a train derailment devastated a small town in canadian quebec. these photos show what is left after 72 tanker cars carrying crude oil jumped the track last week and exploded. 50 people are presumed dead and 28 people are confirmed dead. the chair of canada's transportation safety board says it could be months before investigators know what happened. operations are back under way at london's heathrow airport, but an investigation is being launched after an empty boeing 787 dreamliner caught fire. officials say the fire started on an ethiopian airline 787, more than eight hours after it had landed. now, the fire was not near the lithium batteries. remember, the batteries were the issue that caused the grounding of the dreamliner fleet back in january. in a separate incident yesterday, a florida-bound 787 was forced to return to england after it developed an unspecified mechanical issue. california attorney general kamala harris calls a petition to stop gay marriages in california quote, baseless. the state began allowing same- sex marriages two days after the state dismissed prop 8, but a petition has been filed with the california supreme court, claiming prop 8 should still be law since the high court did not specifically rule on the constitutionality of gay marriage. governor brown is urging the california supreme court to reject these arguments. lawyers for brown and harris filed a brief in state court. in it, it says after years of litigation, there is now a final determination that proposition 8 is unconstitutional. plenty of people will likely head to the state in a nearby creek. police say they will be clearing the camp on tuesday. more than a month after a devastating wildfire, california governor jerry brown has declared a state of a emergency in los angeles county. it is called the power house fire. it destroyed 53 structures and it burned 47 square miles of brush, all in a rural section of northern l.a. county. the fire started on may 30th and it was contained two weeks later. the emergency declaration will allow that county to qualify for federal emergency highway funds to repair roadways damaged by the blaze. a new study is linking fracking to earthquakes. fracking involves blasting chemicals, water and sand deep into the earth in order to extract oil and gas. researchers say southern and eastern parts of the u.s. had more than 300 earthquakes in the last three years. they suspect the quakes may have been triggered by the injection of waste water into deep underground wells. they say the process can destabilize fault lines. the study is published in the journal of science. in this morning's weekly address, president obama says overhauling the nation's immigration system can provide a big boost to the economic recovery. basement of the gift center and jewelry mart, which is all at 8th and brannon. two women were killed and a man seriously hurt. other shop owners say the women were employees and the man is the store owner. the suspect is in police custody. he was arrested after police say he fired shots at officers. >> there was a lot of screaming and just people running up and down the hallways, frantic. >> we ducked into a room. then they started locking the doors. from there, they told us to get in the back of the building. >> the suspect was treated for superficial wounds. the male victim is in critical condition, but he is expected to survive. the investigators say they found a foldable knife and revolver at the scene and they say at this point, they don't have a motive. the owners of 888 brannon issued a statement staying in part, we are truly saddened by the shootings at 888 brannon. we extend our deepest sympathies to the families of those involved. yesterday's deadly attack caused very scary moments for business owners and shoppers. police evacuated the 20 or so stores inside the jewelry mart. other office buildings nearby were locked down and people were finally allowed to leave four hours after the shooting. we talked to one store owner who says she knows the two women killed. one victim was in her thirties, the other in her forties. >> very nice people. two nice girls and the owner, very nice person. >> the identities of the victims have not yet been released. now to the crash of flight 214. the duty manager at san francisco international airport tells us any delays at the airport are about 15 minutes or less this morning now that runway 28-left is once again operational. it reopened last night, two days ahead of schedule, with only three run ways in service the airport had worked quickly to reopen 28-left due to continued flight delays and cancellations. workers put down new asphalt, replaced navigation lights and removed jet fuel that had spilled from the aircraft. sfo officials say asiana airlines and its insurance agent will pay for the repairs. the burned-out fuselage is being kept in a fenced-off area at the airport. sfo says the wreckage will probably stay on the property for at least another week. the plane has been attracting onlookers. some people have driven by and even stopped to take pictures with the aircraft. >> i cannot even believe i'm here watching this. i can't believe i can stand here and see this wreckage up close and personal. >> sfo officials say it is up to the airline to dispose of the wreckage now that ntsb investigators say they have completed their onsite investigation. well, just about 30 minutes ago, the associated press quoting chinese state media, released the name of the third person to die in the crash of flight 214. the girl died yesterday morning at san francisco general hospital. chinese state media identified her as lia yi tang and says she was a student who went to the same school as the other two girls who died on the day of the crash. her grieving family has asked the hospital not to release information about her. doctors did say she had been in the intensive care unit since the crash. a group of students in south korea gathered to pay their respects to the victims. the service included mourners bowing their heads and holding a flower. there was also a photo of the two chinese teenagers killed on that day of the crash. the south korean student read a condolence letter that will be sent to the teens' families. a south korean group went to the chinese embassy in seoul to offer sympathy. a janitor was crushed and killed at a grocery outlet store in redwood city. 43-year-old mindy uto was found 10:00 thursday night inside a machine that is used to crush cardboard boxes. investigators are now inspecting the machine. grocery outlet chain says uto worked with the company for about five years. grief counselors are going to be at the store today. a teenage boy is recovering from serious injuries after falling through a skylight at a funeral home in mill valley. the 13-year-old broke through glass on the roof of fern wood last night. the marine independent journal reports he fell 15 feet and suffered deep cuts from the glass. firefighters say he lost a lot of blood, but was in stable condition at marin general. they are still trying to figure out what he was doing on the roof and how he fell. a tour bus driver arrested in san francisco on drunk driving charges is scheduled to be arraigned later this month. 60-year-old leon maynard was arrested last friday near stockton and post streets. police say he was driving a deluxe sight seeing tour bus when he was taken into custody. he is facing several charges, which include driving under the influence and driving with an open container of alcohol. his arraignment is set for july 22nd. hikers at san mateo's wunderlich county park are being warned about a mountain lion, spotted on the bear gold's trail yesterday morning about 10:30. authorities say if you come across a mountain lion, make noise, try to look bigger or throw rocks, but avoid running away. poisonous meat balls found in two san francisco neighborhoods could also pose a threat to humans. the tainted meat balls were found in the twin peaks and diamond heights area last week containing levels of strike nine that could be potentially lethal for humans. they also warn the poison can be absorbed through the skin. police advise anyone who comes across anything suspicious to call 911. if you think your dog has eaten the meat balls, contact a veterinarian immediately. san francisco animal care and control says a dog named oscar has died apparently from eating one of those meat balls. his owner says oscar ate one in their diamond heights neighborhood back on july 3rd. police have found dozens of the tainted meat balls and continue to look for the person responsible. oakland city workers could soon get their first pay raise in six years. that's after the city and two of its largest unions reached a tentative deal on a new contract. it would give some 3500 workers a 2% raise this month and a 1% raise next july. last week, city workers staged a one-day strike during the contract negotiations. it's a wait and see game for people in the bay area who depend on bart to get to work every day and the possibility of another strike looms. both sides met for several hours in oakland yesterday to continue labor negotiations. worker contract extensions expire at the beginning of next month and if they do not reach a deal, they say they will strike again. since mediators are not available over the weekend, they are not scheduled to resume talks until monday morning. bart police are looking for a couple caught on video having sex in a train car. officers believe a third person used a cell phone to take pictures of the couple. lewd activity on bart is illegal. violators can be banned from riding on transit. investigators say the video is a little grainy, but they hope it will help identify the people involved. a temporary fix is being proposed that could allow the new eastern span of the bay bridge to open by labor day. the bridge's opening date was delayed following the discovery of cracked bolts back in march, but now an independent bridge engineer is proposing a temporary solution. it calls for installing metal shims, which would strengthen the earthquake supports and allow that bridge to open while long-term repairs are made. bridge officials say they have asked the federal highway administration to review that proposal. even though the opening date of the new eastern span is on hold, some finishing touches are still being made. yesterday, crews paved the self- anchored suspicion span with special asphalt that contains a high strength epoxy glue. the asphalt is only two inches thick and is designed to flex with the bridge. they also say the special asphalt is easier to fix and maintain. google is delaying construction of its new campus at the nasa aims research center. sources say work will be delayed by six to 12 months because the company wants to improve the design. this is an artist rendering of the proposed bayview campus. google had previously said it planned to open the new campus by 2015. well, a heads-up for drivers in san francisco. a repaving project on market street is affecting traffic there. the work is taking place along market between 4th and 6th. cars, bikes and several muni lines are being detoured around the area. work is expected to be completed by sunday. repaving work will improve curb lanes and provide smoother rides for drivers, as well as bicyclists. a popular beer festival that raises money to fight breast cancer will take place from 2:00 to 6:00 p.m. at fort mason center. the event began in 2000 to support low income women. the event features dozens of bay area and west coast breweries. . we have a minor warmup in yesterday about 2:15 at the store at 8th and brannon. two women were killed and a man was seriously hurt. the motive is still unclear. and today, the search does continue for 21-month-old daphne webb in oakland. webb's father was arrested on suspicion of child endangerment after his daughter went missing on wednesday. last night, he was released from jail after prosecutors decided not to file charges. and we are just two and a half hours away from the first real race in connection to the america's cup. the skippers of the two boats say the speeds could reach nearly 46 miles an hour. ktvu's alex savidge is live along the san francisco waterfront with all the preparations. alex? >> reporter: yeah, well, a lot of excitement out here. of course you have racing fans coming here to san francisco from all around the world. and today, things are really going to sort of ramp up here, because after solo races, races involving just single boats, today we finally have head-to- head competition. two america's cup challengers squaring off out on the water. that will happen, again, just after noon today. italy's luna rosa team will be facing the emirates team of new zealand at 12:15, when the race kicks off. this will be the first head-to- head matchup in the louis vuitton challenger cup series, a prelude to the america's cup that will happen this september. these boats will be going fast today, could be sailing close to 46 miles an hour whether they near the end of the race is what we're told. now, both the emirates team and the luna rosa team have only sailed in solo races so far. that's because their scheduled opponent in both races, artimas racing is still working to get back on the water, following an accident back in may that killed one crewmember. now, a short time ago i talked with one man who works at an america's cup merchandise store. he told me that he thinks today there will be big crowds out here. [ no audio ] >> reporter: this gentleman i spoke with did tell me he thought there would be large crowds out here today, and he encouraged people to come down. he says it's a great day for a race and, uc board of regents is expected to meet next thursday and elect janet napolitano as the next president of the university of california. she stepped down yesterday as secretary of homeland security. government says it has not received a formal appeal for asylum from nsa leaker edward snowden. he did come out of hiding yesterday at the moscow airport to announce he would seek asylum. it could be a temporary move before he heads to venezuela, bolivia or nicaragua, all countries that have offered him protection. president obama spoke with the russian president putin yesterday about snowden. the white house says russia gave snowden a propaganda platform by letting him meet with human rights activists yesterday. more people have been hurt in the annual running of the bulls in spain. an american college student and two span yarred were gored. now there is word another 20 people were hurt at the entrance of the ring, after a large group of people fell on top of each other. many were crushed in the pile, but two runners were reportedly attacked by a charging bull. the nine-day street festival in pamplona ends tomorrow. the royal baby watch is in full force in london. media outlets from around the world are all camped outside the hospital where the duchess of cambridge is going to give birth. her due date is believed to be any day now. some say it's today. when the baby is finally on the way, the palace is going to announce that the duchess has been admitted to the hospital. the eight-month wait is finally over for people looking to get their fix of those twinkies. wal-mart has started selling the treats at about 1600 of its stores. the company hopes to have them available in about 3000 bay area stores by tomorrow. other retailers should get those iconic snacks confrontation at a motel after an officer repeatedly used a taser. their attorney says salinas was unarmed and argued the taser use was excessive and contributed to the death of salinas. >> there is wrongful death out there, you know, and a lot of cases aren't proven. we took this to trial and i'm really happy that we did. >> san jose city attorney says the city is very disappointed in the ruling and is considering an appeal. penn state is offering settlements to some of jerry sandusky's sex abuse victims. the school's board of trustees says it has tentative agreements. so far, none of the agreements have been signed. last year, sandusky was sentenced to serve more than 30 years in prison for sexually abusing 10 boys over a 15-year period. and families of the victims who died in last year's sandy hook school shooting will each receive $281,000. that's the decision of the committee in charge of distributing the donations in newtown, connecticut. according to the hartford current, families of surviving victims will get $20,000 each. two teachers who were hurt in the shooting will split $150,000. country music singer randy travis remains in critical condition, under heavy sedation at a hospital in texas. doctors performed surgery earlier there week to relieve pressure on his brain, after he suffered a stroke. it was a complication from heart failure. his publicyst is asking travis' fans for prayers and support. nelson mandela's wife says she is less anxious about his health than she was last week. she says the former president of south africa continues to respond positively for treatment. the 94-year-old has been in the hospital with a recurring lung infection for five weeks. a lunchtime dare is likely to blame for making more than a dozen students sick in san diego. school officials say 22 elementary school students dared each other to drink milk with salt, pepper, carrots and hot sauce mixed in. well, it didn't take long, as you can imagine, for the students to get sick. 18 had to be taken to the hospital, but they were later released. the city of napa says organizers for the first-ever bottle rock festival owe the city a lot of money. festival organizers had until thursday to reimburse taxpayers for using city services two months ago at the event. the city manager told the napa register some of the money has been paid back, but event organizers still owe more than $100,000. organizers say those debts will be paid. police in sacramento county are planning a big alcohol crackdown, as thousands of people rushed to the river today for this year's rafting gone wild. alcohol is banned along portions of the american river, but police say this event brings a lot of booze to the waterways and some problems. last year, more than 3000 people took part in the event. 23 people were aested. we want to tell you about an amazing rescue where a man swam five hours to save his family after their boat capsized. it happened during a storm off the coast of maryland on wednesday. 46-year-old john riggs managed to swim to shore, despite rough conditions. once on land, he ran for help, knocking on the very first door he saw. >> it wasn't an option. it had to be done. i had been out there all night. >> rescue crews eventually reached his four family members, two hours later. they were clinging to the upside down boat. following the charlie, good to be here. >> there is emotional reaction across the country after the acquittal of george zimmerman. a jury found him not guilty saturday night in the shooting death of 17-year-old trayvon martin. in hollywood 64 arrested in a protest this morning. a large group had gathered on sunset boulevard. police in riot gear broke up the crowd. >> in philadelphia, about 700 people marched to protest. we begin our coverage with don dahler in "new york times" square. >> reporter: good morning, charlie, norah, and viewers out west. new york city was a site one of the largest protests. it began downtown moving through times square and on northward to yankee stadium in the bronx. that is a distance of about nine miles. despite the size of the crowd and the emotions involved new york city police say it was a peaceful protest. protesters started gathering sunday afternoon, a day after the acquittal of george zimmerman. >> the justice system isn't looking out for us. this verdict has set us back in this country. that's why we're all out here today. >> reporter: soon hundreds of people were marching north to types square taking over city streets and bringing traffic to a standstill. many believe it was a clear case of racial profiling that led to trayvon martin's death and say the justice system failed. >> if the roles were reversed that man wouldn't have got off. >> reporter: as protesters took to the street politicians took to the air waves. >> the fact is we have the best judicial system in the world and we respect it. >> if the rule is you got to prove guilt beyond a reasonable doubt, there were plenty of reasonable doubts there. >> i worry about all those young black kids out there that see a system of justice that maybe doesn't respendond to them. >> reporter: this is just the latest in the ongoing national debate over the circumstances in trayvon martin's death. protest organizers say they're planning more action in the coming weeks. the nypd says there were only minor arrests. the protesters say this is far from over. there is another rally scheduled for 7:00 p.m. tonight in the bronx. charlie, norah. president obama's calling for calm in a statement released yesterday. the president said, quote, i know this case has elicited strong passions. i know those passions may be running even higher. we are a nation of laws. a jury has spoken. >> george zimmerman faces a new series of problems. the case first received national attention when mark strassmann reported it right here on "cbs this morning" in march of last year. he joins us now from sanford, florida. mark good morning. >> reporter: good morning, charlie and norah. there are all sorts of he perceptions of george zimmerman. now that this verdict is behind him, he's eager to step back into the world. but not everyone's eager to welcome him back. zimmerman has his freedom back. his gps ankle monitor is off. he can travel abroad and live anywhere in america. but he will never get back the life he led before he killed trayvon martin. >> i'm sure if he could weave his magic wand he would sort get his life back. >> reporter: attorney general mike o'mara defended zimmerman. me says the crime watch volunteer will have to look other his shoulder for the rest of his life. >> he has to be very cautious and protective of his safety because there's still a fringe element who have said at least in tweets and everything else that they want revenge. >> reporter: with his not guilty verdict, zimmerman is now eligible to carry a concealed weapon again. but to his critics, zimmerman's name has become a racial flash point. >> it boils down to you got a 17-year-old kid who is minding his own business wearing a hoody, and gets accosted, getsful lowgets ful followed by an individual who wants to be a cop. >> reporter: the department of justice has said it will now review the trial records for possible civil rights violations. zimmerman once dreamt of a career in law enforcement. he could again. but first he has to live with knowing he shot and killed an unarmed teenager. lawyer don west helped defend him. >> this is something no one gets other. there's no winners here. there's no monsters here. that's the tragedy. >> reporter: now that the verdict is in, the court will release all the case evidence. commarly ly charlie and norah, zimmerman could reclaim the gun he used to kill trayvon martin. >> legal analyst jack ford joins us. what's next, what might the justice do? >> they will look and decide whether there should be any federal prosecution. people may say wouldn't that be a violation double jeopardy. the answer is not necessarily. if he was tried again, it wouldn't be for murder and manslaughter. there's certain situations where the same set of facts and circumstances can give rise to different state and federal charges. here's what happens. the justice department is always very cautious when there's been a state level trial. they will look to see -- it's not enough -- >> isn't it a high standard? >> very high standard. it is not enough for people to disagree with the verdict. the justice department will jump in if there's a failure to prosecute or if there was some fundamental flaw with the first trial. there's a lot to look at. including they look at the first trial and say, is there any way to believe the second trial would be any different here? statistically, it's not probable that it would happen. but we've seen in the past the rodney king case. it's certainly possible that the justice department can say we're going to prosecute the civil rights violation, attacking trayvon because he was black. >> don't they have to show some - sort of animus? >> exactly. it would be the notion that george zimmerman violated trayvon martin's civil rights the right to be safe and not be attacked, because of his race. that's the important part. >> that's one avenue for the department of justice. what about the family in the civil case? >> the family could file a civil case. a good comparison the o.j. simpson trial. found not guilty in the criminal case. the family sued him civilly. first, you're looking for monetary damages, there's no jail involved. it's the families against each other essentially. but there are differences. the standard of proof in a civil trial is much much lower. civil trial, a mere preponderance of the evidence. in a civil trial, they can compel george zimmerman to testify. >> what kind of second guessing will there be about this trial? >> i think people have to realize -- we've talked about this, from the beginning, this was a hard case for the prosecution. i think you'll see people saying, why didn't you just go with a manslaughter charge? the reality is with trials and verdicts there's always disagreement. but here there shouldn't be real surprise. >> jack ford, thank you. nsa leaker edward snowden has documents he claims detailing how the national security agency actually works. that's according to his main contact in the press, guardian columnist glenn greenwald. he claims the new revelations could show people how to evade nsa surveillance. >> snowden spoke to reporters friday for the first time since he arrived at mosscowmoscow's international airport. >> i had family a home and i lived in great comfort. i also had the ability to search for and read your communication. >> our senior correspondent john miller's with us. he's a former deputy director of national intelligence. good morning. >> good morning. >> so what -- if he had the nsa blueprints, what does that mean and how damaging could it be? >> well, what that most likely is, is for every big program in the nsa, there's a briefing document, usually a power point presentation on some level of pretty intimate detail that explains what the program is how it works, how it relates to other programs. it won't have the collection platforms, meaning if we had a bug in putin's office it wouldn't list that in the program. but it would say how we collect. if you were the adversary, you'd look at a document like that and say, oh, so this is how all this works. well, let me use countermeasures to close up those vulnerabilities. it would be helpful to enemies of the u.s. >> edward snowden has been seen some as a whistleblower. now he's saying look i know how the whole nsa works. i have the blueprint for it. what's the motivation behind saying that now? >> that's a hard question. because, you know, our story begins simply enough i want to tell americans that in the dragnet that sweeps up communications of terrorists and spies, some of their communications gets vacuumed up in that and someone may look at it. it's different to say, while we're at it here are the documents that explain how the nsa collects against foreign adversaries, whether they're terrorists in afghanistan -- >> as he's trying to seek asylum in russia. >> exactly. thematically he's made an interesting turn here. it's hard to understand. unless you boil it down to the ideology that either spying is wrong, which at what point all countries are supposed to stop or that spying should be done out in the open, at which point it's not spying. >> what's your best guest as to what happens to edward snowden? >> we're in a nightmare scenario charlie because, you know, the one likely scenario is that he -- that u.s. pressure against all the places he wants to go succeeds and that in the great law of unintended consequences we push a guy with a bag full of strategic secrets on eavesdropping into the hands of the adversary we're probably eavesdropping against an awful lot which would be russia. >> he claims he has this dead man's pack what's that? >> this is a series of encrypted data drops he has left with trusted associates that if anything happens to him, supposedly, these people have the keys -- or know how to find the keys to open those things and out spill the rest of the secrets. >> one of the top obama administration's top envoys is on the ground in egypt. the highest ranking american to visit cairo since morsi was ousted by the military. margaret brennan >> they would step in and file federal charges probably based on the hate crime act, which says a hate crime is a hate crime wherever it happens. >> the case went to trial. there was a verdict. shouldn't you accept it? >> we put our faith in our justice system, but we ultimately accept this verdict. accept this verdict, the country should accept we have civil rights laws for a reason. there is more that not just can be done but should be done. >> reporter: in a statement, the department of justice says it is looking into the state's case here in sanford to see if there are any charges that should be pursued and if there's enough evidence to support them. norah, gayle, charlie. >> thank you, michelle. asiana airlines says it will sue its san francisco area television station. ktvu reported fake and racially offensive names for the pilot in the crash this month. three people died in the crash at san francisco international airport. it damaged the reputation. the anchor who read the names apologized on air. ntsb taking the blame. it said quote, in response to an inquiry from a media outlet a summer intern acted outside the scope of his authority when ep erroneously confirmed the names of the flight crew on the aircraft. the heat is on for much of the country, especially in the east. forecasters say temperatures will reach into the high 80s to mid-90s, from the great lakes to mid-atlantic to new england. the summer blast expected to last until friday. there will also be severe heat in the west from texas to idaho. >> canadian authorities plan an autopsy today for "glee" actor cory monteith. the 31-year-old star was found dead in a vancouver hotel room on saturday. carter evans looks at the performer and his troubled personal life. ♪ just a small town girl living in a lonely world ♪ >> reporter: every since "glee's" debut four years ago, cory monteith has played fin hudson, a high school football player who also loved to sing the heart of the show's harmonious ensemble cast. >> it's a rare find to see an actor who can be credible as an athletic cool guy, jock high school kid and also have the musical chops to be credible as a musician. ♪ >> reporter: monteith was last seen entering his vancouver hotel room alone friday night after going out with friends. when he failed to check out on saturday, his body was found by hotel staff. on "glee," monteith's character fin faced a long list of problems. everything from relationship woes to a pregnancy scare. >> whatever i did, i'm sorry. >> i'm pregnant. >> reporter: but those issues paled in comparison to real life woes. monteith recently went public with his history of drug addiction. the 31-year-old said he first received treatment at age 19 and he just completed another stint in rehab three months ago. hollywood history is filled with tales of stars who this issues with drugs, kicked them and then relapsed. if that's the case here i don't think people will be too surprised. however, the fact that this could have possibly escalated to the point it would kill him, i think that's the big shock, if it's true. >> monteith's on screen and real life girlfriend is in mourning. she's issued no statement and her publicist said she's asking for privacy. [ man ] where all systems are go. ♪ ♪ last tuesday john riggs made a life-or-death decision. the fishing boat he and his family was on began sinking. he knew the only way to get help would be to swim for it. he sat down with our jeff pegues. jeff, good morning to you. >> reporter: good morning, norah. this is where john came to shore after the five-hour swim. his ordeal and that of his family began as they were fishing from their boat in the watt bhiernld me. the boat overturned. there were five of them on board ranging in age from 3 to 70. the boat was going under. they had to make a decision. it was around 7:00 p.m. land was five miles away. >> i very much knew from the get-go what kind of trouble we were in. >> it was getting dark. the storm was rolling in. >> john looked at me and said should i swim for it. i said yeah. he said you're going to owe me a pair of shoes because he had to kick off his shoes. he started swimming. >> how choppy was the water? . probably 2 to 3-foot seas. enough to keep you from getting your breath right. >> he didn't know how far the shore was. behind him his wife three children and conrad. they gripped the bow in the water while getting stung by jellyfish. >> were you overwhelmed emotionally. >> i think if conrad my son and emily wouldn't have been there, i probably would have lost it. so it was really about staying calm, reassuring. >> emily, did you know you were that good a swimmer? >> no. >> no? so what was it that kept you holding on? >> just thinking about we we could drink hot chocolate and put a blanket around me. >> reporter: as for john he had to find a way to keep himself going. >> was there any point where you felt like, okay, i don't know if i'm going to make this? >> yeah yep, a lot of times. and i'd just get thinking if something happened to them out there and i didn't do everything possible, you know i'd never be able to live with myself. >> john finally reached land at 1:00 a.m. five hours after leaving his family behind he made it to a woman's front door. it was early in the morning. they called 911. >> and your name. >> my name's john riggs. >> okay. are you on the boat now? >> no. i swam ashore. >> what? >> i've been swimming since sundown to get to shore. >> john and contessa are hearing the call for help for the first time. >> contessa, what do you think? >> amazing how calm you were. i would have lost it after they kept asking all those questions. i'd be like just do something. >> the next morning seven and a half hours after their boat had capsized, they were rescued. >> there's a part of it that doesn't seem real. like it seems like maybe it was just a dream or even worse, you know, this is just a dream and i'm still out on that boat. holding on. >> so what? you're a hero. >> i don't feel like it. a hero is superman or something like that. i'm just a family man just trying to take care of my family. >> reporter: contessa says she's going to get john that pair of shoes she promised him before he made that five-hour swim. fortunately through all this no serious injuries scrapes, and bruises, sore muscles, that's it. they really credit their life vests for saving their lives out there, and, of course, uncle john. gayle, norah charlie?
