The court took into consideration the young age of the accused as well as his willingness to pay compensation for welfare of the child born as a result of the offence
The Court opined that the accused deserved the death penalty since any other alternative was absolutely ruled out considering his “inhuman and barbaric act.”
The Bombay High Court noted that the victim was sobbing at one point during cross-examination and that was when the trial judge ought to have intervened and stopped that line of cross examination.
