Two Boston police officers who opened fire on a man who had what appeared to be a real gun near a city hospital three years ago, and who was later shot and killed by police following a car chase, were justified in their use of force and should not face criminal charges, according to the results of an investigation released Monday.

Officers shot and killed 41-year-old Juston Root while he was on the ground unarmed and seriously injured, the lawsuit states. In March, the district attorney determined the six officers involved were justified in their use of deadly force.

Tuesday marks three years since police shot and killed 41-year-old Juston Root in Chestnut Hill. His sister, Jennifer Root Bannon, maintains that police mishandled his case.

Juston Root was shot and killed on Feb. 7, 2020. Members of his family visited the site of his death Tuesday.
