The SFIO case involved allegations that there was fraud involved in the 2007 merger of entities belonging to Kingfisher and low-cost airline Deccan Air, which led to duping of investors and avoidance of tax.
Justice S Vishwajith Shetty noted that the investigation was complete, some accused were women, one was a 19-year-old boy and that none of the accused had a criminal background.
Justice M Nagaprasanna noted that neither a show cause notice nor a summon as contemplated under Karnataka State Commission for Women Act was issued to Kumaraswamy.
The Court made the remark after noting that a copy of the Karnataka Land Grant Rules by KLJ publications incorrectly mentioned that an amendment was done by way of substitution.
