BUCKHANNON — The second open magistrate position has been filled by an Upshur County native.
Alan Suder was appointed Tuesday by 26th Judicial Circuit Judges Jake Reger and Kurt Hall, according to a joint press release.
Suder will fill the term of Kay Hurst, who resigned Jan. 20, just three weeks into serving her second term. The release from the judges cites Suder being a private business owner for 30 years and his three terms serving on the Upshur County Board of Education.
“I’m very appreciative,” Suder said of the appointment. “I am looking forward to serving the citizens of Upshur County. It is very humbling.”

BUCKHANNON — The same day that a new Upshur County magistrate was appointed, Upshur County’s Division 2 magistrate submitted her resignation.
Kay Hurst, who was re-elected to a second term in the June primary and served nearly three weeks of that term, submitted her resignation to Judge Jake Reger effective at 4 p.m. Wednesday.
When The Inter-Mountain had checked with Reger at 3:45 p.m. Wednesday, the circuit judge had not received a resignation letter and could not confirm the resignation.
“I don’t have any other comment about it,” Reger said Thursday morning. “If you want to talk to Mrs. Hurst, you can. She resigned and we are going to have to replace her.”

BUCKHANNON — The man who was arrested for allegedly shooting another man in Buckhannon last week is facing two more felonies after it was discovered he gave police a false identity.
Lavar Anthony ONeal, 39, of Newport News, Virginia, originally gave the name of Marvin Sills to Upshur County Sheriff’s deputies and was arraigned and booked into jail under that name, according to the criminal complaint in the Upshur County Magistrate Clerk’s office. ONeal forged Sills name to the Upshur County Magistrate Court documents and uttered them to be his own.
Sgt. Rodney Rolenson received confirmation from the FBI Fingerprint Division and West Virginia State Police that ONeal was not Sills.
