president obama steered clear of the controversy, as he helped swear in his new fbi director. but the white house is saying u.s. intelligence gathering is under review. >> the president clearly feels strongly about making sure that we are not just collecting information because we can but because we should. >> reporter: besides being embarrassing, spying on allies could have economic consequences, as washington works to negotiate a major trade deal with the european union. >> reporter: former state department analyst james louis said the u.s. won't stop the program because in a post-9/11 world, the information is too valuable. >> this makes us safer. less surveillance means more successful attacks. >> reporter: the white house hopes to complete its surveillance review by the end. year. danielle nottingham, wjz eyewitness news. >> some u.s. lawmakers are defending spying practices. they argued places like france are safer because of the nsa's surveillance. three families tonight are still trying to come to grips with a double murder and suicide that has rocked glen burnie. vic is in the newsroom with the latest this tragedy. vic? >> the violence has also rocked the city fire and police departments. police believe christopher robin, a baltimore police officer, followed his ex- girlfriend, maria hartman and her boyfriend home from a party sunday morning. robinson killed them both before turning the gun on himself. hoffman is a city firefighter, as are many members of his family. today, they released a statement today, saying it's hard to imagine going forward without him. but we know andy died a hero. marie hartman leaves behind a 6- year-old son. >> hartman broke up with him in august. and family members say he was having a difficult time accepting that breakup. just a short time ago, grammy winning singer chris brown appears in court in washington, d.c. brown was accused, along with his bodyguard, of punching a man, who tried to get in a picture with the singer this weekend. he was in washington, d.c., performing at a nightclub, as part of homecoming for howard university. this could jeopardize brown's freedom. he remains on probation for assaulting his ex-girlfriend, rihanna, in 2009. a maryland state trooper is in critical condition after his cruiser is hit in baltimore county this morning. you can see the damage to the rear end of the cruiser. the trooper was investigating another accident on the beltway, near route 702, when he was struck. an investigation will determine if the 63-year-old driver who struck the trooper should face charges. $60 million. that's how much penn state is paying to the victims of jerry sandusky. the former assistant football coach was convicted in june of 2012 of child sex abuse. the university will pay $59.7 million to 26 young men who claim they were abused by sandusky over the years. sandusky was sentenced to between 30 and 60 years in prison. it has been one year since super storm sandy barreled through maryland and up the east coast, causing billions of dollars in damage and killing dozens of people along the way. as marlie hall reports for wjz, the effects of sandy are still being felt, every day. >> it's sand. but i see something. >> reporter: it's been a long haul for marie lopresty. a year after she lost her husband, she lost her home, when super storm sandy slammed into breezy point, new york. >> i have a lot of memories from my husband that i wanted to keep. they're all gone. >> reporter: sandy delivered a direct blow to new york city and the jersey shore, destroying communities, flooding the new york transit system, and tossing a roller coaster into the ocean. all 2800 home negligence breezy point suffered some damage. about half of those families are still not back in. richard resner considers himself lucky. he was flooded out, but his ocean front home is still standing. >> there's not a day you don't talk about it, think about it, a lot of sleepless nights. >> he spent $150,000, fixing his gutted house. >> when do you think you'll be back in your home? >> you know, i've been saying next month and this month and that month, i don't even plan it anymore. >> reporter: there's an empty lot, where marie's home once stood. it was more than 100 homes that burned do -- to the ground during the storm. she said her neighbors have made the last year bearable. >> they all came and helped. but you know, it's still, i'm here alone. >> reporter: marie's prefabricated home is scheduled to be delivered by christmas. >> reporter: in new york, marlie hall, wjz eyewitness news. >> 350 homes in breezy point were completely destroyed. and although sandy did cause some damage here in maryland, it could have been much worse. a live look outside now. a much different picture than this time of the last year. wjz is live with first warning weather coverage. meteorologist chelsea ingram is live in fells point with the wjz mobile weather lab. but first, bob is in the weather center, updating our conditions. >> what difference a year makes. beautiful afternoons out there. mild temperatures right now. we're looking at 65 here. 65 in d.c. 63 in ocean city. and the coolest spot, oakland at 54 degrees right now. we are 4 degrees warmer than we were yesterday at this time. most places, several degrees warmer than we had over the last couple of days. in fact, today is one of the warmest days we've seen in a while. it was chilly, 33 at the airport. 33 in elkton. and 30 ocean city. 30 in oakland. we had a let of frost the last couple of days, but looks like a warmup is on the way. eventually heading this way. let's check in with meteorologist chelsea ingram, live at fells point with the wjz mobile weather lab with a look at tomorrow. >> reporter: hey, thanks, bob. it is a gorgeous day out here. take a look at some of our numbers. we're looking at a temperature here, coming at 61.7 degrees. so far, the high today with the weather lab, right around 63, which is what we had in the forecast. take a look at this graphic. we have a warmup headed our way. however, it's not going to get in here until let's say maybe wednesday. but for tuesday, thanks to a cool front passing through tonight, we'll see temperatures around 60. we are going to be cool and dry, with high pressure under control. plenty of sunshine, though, in the forecast. bob will have more of those details and the details on the warmup, coming up in his exclusive first warning forecast. for now, i'm in fells point with the wjz mobile weather lab. back to you on tv hill. >> thank you, chelsea. for now, we're going to kristy breslin with a first look on the roads. >> hi, mary. hi, everyone. well, we're starting often with a little congestion. traffic will start there from the jones falls expressway to harford road. west side inner loop, watch for a slowdown as well. beginning at 70, going over to liberty. average speed, about 45 miles per hour. northbound 295, very busy at this hour, with delays running from 32 past 100. couple of complications as well, after a slow delay, northbound 95, just approaching whitemarsh boulevard. then in owings mills, watch out for some construction work, actually. eastbound reisterstown road, at green spring valley. it's block the right-hand lane. also one accident to watch for, richie highway at crain highway. let's take a live look. you can see, not too bad there. the bend at reisterstown road. this bend is reported by united healthcare. stepping up for better healthcare. back to you. >> kristy, thank you. contributes continue today for lou reed, the rock and roll legend passed away at the age of 61. susan mcginnis takes a look back at his remarkable career. >> lou reed was the driving force behind a legendary cult band, velvet underground. the band never achieved widespread commercial success. but many credit the group with revolutionizing rock in the '60s and 'cents and -- '70s and having a major influence on rock. walk on the wild side was his only top 20 hit. but songs like sweet jane and pale blue eyes became reed standards. ♪ [ music ] the singer led the way as the velvet underground collaborated like none before. including filmmakers and artists like andy warhol. >> that's why nothing got changed. because andy said, don't change anything. leave it alone. >> reporter: the velvet underground was inducted into the rock and roll hall hall of fame in 1996. the new york native was an admitted hard drinker and drug user. he underwent a liver transplant earlier this year, and later called himself a triumph to modern medicine. susan mcginnis, wjz eyewitness news. >> the velvet underground's first four albums are all in rolling stones, the 500 greatest albums of all times. still ahead on wjz eyewitness news at 4:00. free man, dr. conrad murray released from prison early. why fans of michael jackson are outraged. [ inaudible ] there are people bleeding really bad. >> terror at the state fair. the person facing charges after half a dozen people are hurt in that accident. we're very scared. i didn't think we were going to make it out. >> surrounded by flames. the cause of this firestorm in california. and warmer temperatures make a return. bob is updating the first warning weather forecast. just gorgeous out there right now. ,,,,,,,,,,,, it is mostly sunny. 65 degrees in central maryland right now. the complete first warning weather forecast is coming up. in california, two people are injured, after a big rig crashes and catches on fire. the truck crashed into the side wall of a freeway, and moments later, exploded into flames, closing lanes in both directions. the truck was carrying 8,000 gallons of oil. the driver of the truck managed to escape. the cause is under investigation. a worker is in the hospital after being injured while taking down a ride at the north carolina state fair. the 35-year-old is being treated after part of the ride struck him on the leg. police are investigating this as an industrial accident. no reports on the worker's condition at this time. this ride is not the same one that left five people injured last week. speaking of, one person is in custody after that accident. alina machado has the story for wjz. . >> we're at the state fair. and the ride went upside down and dumped everybody out. there's people bleeding really bad. >> reporter: a fer feeing scene -- terrifying scene on a north carolina state ride. this morning, the ride operator, timothy tutoro is in custody. >> this ride was tampered with, critical devices were tampered with and compromised. >> reporter: authorities aren't releasing details about the alleged tampering, but they say this is a critical investigation. tutoro's attorney says his client is distraught and devastated by what happened. witnesses say the vortex ride had stopped, and people were getting off it thursday when it suddenly restarted. >> the ride broke loose and five people fell straight from the sky, 25-feet drop. >> five people fell. and three remain in the hospital. family members are mad. >> it makes me mad to think that anybody would put people's safety in danger like they have. i'm not mad, i'm furious. >> reporter: the company released a statement in part saying, it has never before experienced an incident with any of its rides like this one. the company purchased the vortex earlier this year. and a spokesperson says tutoro has been operating it since then. >> reporter: three people from the accident remain in the hospital. mixed news to start the week on wall street. [ stock bells ringing ] >> the dow lost a little bit of ground today. let's take a look at those numbers. dow is down a little more than a point. s&p up 2. and nasdaq is down 3. let's go to new york right now, where alexis christoforous has tonight's cbs money watch update. stocks were mixed, as investors digested some mixed earnings news. home builder stocks fell, after a new report showed the number of people who signed a contract to buy a home, fell to a nine- month low in september. analysts attribute the drop to higher mortgage rates andirizing home prices. japanese automakers top consumer reports' latest reliability survey. followed by lexus, toyota, acura. consumer reports surveyed over a million of its subscribers for that. burger king cut costs and added more customers overseas. it is also attracting more customers with its new lower- calorie french fries. meanwile, mcdonald's is dropping heinz ketchup. it will no longer use heinz because the company is now headed by the former ceo of burger king. watching shows on television and smart phones, has grown so much, that nielsen will begin counting mobile viewing in its traditional tv ratings. the company will use codes embedded by networks to collect the information. the move sell significant, since nielsen's ratings are used to set advertising rates. that's your money watch. for the latest on business news, that just a minute. right now, a lot of sunshine. high clouds out there. you're not really obscuring much of the sun. we're at 65 now. very light, west wind at 3. barometer at 30.20 inches. dew point is way down. this is very dry air once again. 36 degrees. humidity, only 34%. this morning, we were just above freezing at the airport. 63, ocean city. and out in oakland, at 55 degrees. locally, temperatures right around 60. a normal high today is around 63. so we're very close to slightly above that. lessen, tomorrow, very slightly cooler than today. there's a weak front going through the area. we can barely see it. that's why we had the clouds. tomorrow, the winds more out of the north and northeast. temperatures tomorrow, maybe 4 or 5 degrees cooler than today. but all in all, a very nice tuesday headed our way. out to the west, it's a lot different. you can look at these temperatures. really cold air, coming in from canada, to the northern rockies. denver has just dropped to 33. west. look at that. salt lake city, 68. there's a big contrast in temperature. because of that, low pressure developing out there. a big snowstorm expected for the northern rockies. much of wyoming, the dakotas, and montana. will see heavy to moderate snow. further south and east,&this warmer and humid air. some severe weather could break out in kansas over the next couple of days. what's happening is that low pressure is going to break way out to our west. and in essence, this warmer air will be coming up the east coast. we'll have a big warmup before any of that cool air gets to our region. snow here in the northern rockies. it's just going to get heavier. big upper level low. see that big circulation out there. here in the east. and a weak front. you can barely see it across new york state. that's going to come through the area later tonight. and as it does, temperatures tomorrow, just pleasant. but a little cooler. and then we warm up again. maybe even into the low 70s. however, it looks like the front is close enough, halloween evening. we could see some showers that may linger into friday, unfortunately. east winds on the bay, at 10 to 15 knots. bay temp, around 59 koch. >> and i'm vic carter. >> four people are killed, by falling trees as a super storm roars through great britain. people in england are just beginning to assess the damage from the hurricane forced winds and rains. alphonso van marsh reports for wjz from london. >> reporter: the powerful storms with winds 90 miles an hour. winds that tore trees out of the ground. rescue teams battled dangerous conditions as they searched for a 14-year-old boy, swept out to sea. they later called off their search. a 17-year-old girl was also killed when a tree fell off her trailer home. in london, a massive crane crashed down on the government's cabinet offices. nobody was hurt. here in west london, a tree fell on that home, triggering a gas explosion. >> unfortunately, two bodies have been found. bodies of a male and female. >> reporter: the storm dubbed stormagedon has left more than a quarter million people without electricity. nationwide, some train service was suspended, over concerns trees could land on the tracks. about 130 flights were delayed or canceled at heathrow airport. the airline officials say flights are now running a reduced schedule. authorities say the storm did less damage than feared in part because they sounded the alarm well ahead of time, about a possible catastrophe. in london, alphonso van marsh, wjz eyewitness news. >> the storm is making its way through france and holland. transport -- transportation officials are asking for airline changes. conrad murray is released today. the man convicted in the death of michael jackson is released from prison. >> reporter: conrad murray left an l.a. jail, just after midnight. he served about half of his 4 1/2-year prison sentence for involuntary manslaughter. murray prescribed michael jackson the surgical anesthetic prop fol. and an overdose killed the pop star. some of jackson's fans are fuming about murray's release. they gathered outside the jail. >> i don't feel anything. i don't feel anything. he's getting out. he murdered michael jackson. and he probably won't ever have a day of peace. he should suffer. michael is not here anymore. michael's kids don't have a father. michael was their whole world. and he took it away from him. >> reporter: murray's future is uncertain, at age 60, his medical license has been suspended or revoked in three states. back to you, vic. >> thank you. murray is out because of a change in california law, allowing his jail time to be significantly reduced. five members of one family, including four children, are murdered in their home in new york. as scott thompson reports in brooklyn, police are charging a relative of the victim. >> reporter: a gruesome scene, discovered late saturday, at a home in brooklyn, new york. police found five members of one family, stabbed and unconscious. >> a mother, two males and two of her sons and two of her daughters that were cut and butchered, with a kitchen knife. >> reporter: three of the children were pronounced dead at the scene, while their mother and 5-year-old sibling died at a new york hospital. kenny lee witnessed paramedics removing the bodies and said it was a bloody sight. >> i saw the little girl. all with blood. >> the children ranged in age from 1 year old to 9. the woman's husband has been charged in the case. police say he had been staying in the home and had made statements implicating himself in the crime. >> we believe that he acted alone. and we are now trying to determine what caused him to create the act that he created. >> reporter: police are piecing together what happened, but may never answer what happened of why so many young lives are taken. i'm scott thompson, reporting. >> the brought is telling police he killed his family because he was envious of what they had. prince george's county police released a murder. surveillance video shows a frightening scene at the counter monday night. the suspect demanded money. then there was a confrontation. and scresesica -- jessica chavez was shot several times. he died at the scene. police say deanne dray wings is the gunman. they say the other suspects watched for police and drove the getaway car. the howard county police officer shot and wounded last week is back home today. police say 29-year-old stefon prather opened fire on hawk. prather was caught after an overnight manhunt and is charged with attempted murder. the healthcare reform website takes another hit this weekend. the glitch is linked to a data services hub that crashed. americans trying to enroll are getting frustrated. >> reporter: everyday americans had said it for weeks. now, finally in washington, it's conventional wisdom. new hampshire senator jean shaheen, on "face the nation." >> the rollout has been a disaster. >> the obama administration has said it will need until the end november to make it work. that's close to two months. >> we have heard many say they want to enroll in health insurance but they can't because of problems with the website. >> reporter: for many, their introduction to the affordable healthcare act has been shocking. they have had new sticker pries for the -- prices for the plan. >> you like your insurance plan, you will keep it. no one will be able to take that away from you. >> reporter: but people across the country are finding out, they're losing their existing insurance plans over obama care. that's because requirements in the law, like prenatal and prescription drug coverage, means their old plans aren't comprehensive enough. in california, kaiser permanente terminated policies for 160,000 people. in florida, at least 300,000 people are losing coverage. >> when i get this bill, i was outraged. >> reporter: that includes 56- year-old diane baret. last month, she received a letter from blue cross, blue shield, informing her, as of january 2014, she would lose her current plan. baret paid $54 a month. the new plan she's being offered would run $591 a month. >> why do i have to be forced into something else? >> now, health secretary kathleen sebelius is expected to testify on capitol hill this week, about the problems plaguing the and it's not going to get here until wednesday. for tuesday, it's going to be another seasonably cool day, if you take a look at this graphic. it will be cool and dry, with high pressure in control of our forecast. and that's going to bring us plenty of sunshine, as we head into the afternoon. and as for that warmup headed our way, bob will have those details coming up in your exclusive first to jump on route 1, or even route 40, as your alternate. other accidents include richie highway at crain highway. we have construction slowing your drive down. eastbound reisterstown road. right lane is blocked in that direction. as far as your delays go on the top side inner loop, watch for slowing there, from stevenson road to charles street. west side inner loop, also very slow there from 95 to 70, with an average speed of 35 miles per hour. traveling 70 westbound. stop and go there, from 29 to marriottsville road. and northbound 295, delays stretching from 32 to 100. let's now take a live island is filled with visitors for the first time since super storm sandy swamped it. alex demetrick reports, as the first visitors came ashore. >> reporter: boats filled with tourists returned to ellis island for the first time since super storm sandy slammed the historic site last october. jace and lisa chenko came from cleveland. >> my father passed away about a month ago. it's nice to trace the roots of where he came through. ask see to see where he first stepped foot in this country. >> reporter: vincent brought his daughters from france. >> this is the river, part of new york. >> reporter: lob lore brings-- rob lore brings groups of students from wales every year. >> last year, the students were absolutely gutted they couldn't see it. it's great to bring them today. >> reporter: ellis island and neighboring liberty island, needed $77 million in repairs after super storm sandy left it in need of repair. here, the registry hall, as many as 5,000 immigrants entered the united states every day. now, about that many tourists visit every day. some of the benches of more more than 100 years old. >> reporter: while buildings are fixed and upgraded. the 27-acre property is expected to be fully restored early next year. alison harmelin, wjz eyewitness news. >> today is also the 120th birthday of the statue of liberty. it was a big success for the making strides for breast cancer walk this weekend. 6,000 people came out to walk around lake montebello yesterday, including many breast cancer survivors. the american cancer society walk raised more than $300,000. the money will be used for research and will support money for breast programs for patients. wjz is proud to be a sponsor of making strides for breast cancer. >> and we have a whole group of our staff after their plane plummets into the water in florida. small plane crash-landed into the water, as it was approaching the everglades air park. the four people on board all escaped and were rescued from the water by a passing boater. suffered minor injury. the faa is investigating the crash. caught on camera. we are getting a look at dash cam video, that shows the moment when a pennsylvania officer saved a fellow trooper's life. >> that's right, denise. this chilling video shows when trooper timothy stromyer heads into gunfire to stop an active shooter. here you can even see the gunman, jeffrey michael's truck, crashed into a state trooper. inside that, trooper kevin campbell was trapped. that's when he rams michael's truck, diverting the gunman's attention and taking him down. stromyer was wounded but saved by his bulletproof vest. his actions ended the shooting spree in december. >> stromyer was given one of the highest honors a law enforcement officer can receive. the international officer of the year award. a 12-year-old florida girl will soon appear in court to face felony stalking charges. she stalked another girl so badly, she committed suicide. >> reporter: attorney jose baes is used to the attention of high-profile cases. and he knows they're not argued just inside the courtroom. a 12-year-old accused of bullying rebecca sedgewick so much, she killed herself. >> maybe i am, i don't think so. i have not seen anything that rises to the level of criminal conduct. especially that of a felony. >> reporter: he said his client is not only accused of a crime. she's
