Summary
Former Tetu MP Ndung’u Gethenji has lost an attempt to regain control of his family’s Sh20 billion estate in Kitisuru, Nairobi that is under the management of his elder brother, Gitahi Gethenji, and other shareholders.
The former MP wanted the Court of Appeal to suspend a High Court judgement, which declared that he had no powers to take over the management of a company known as Kihingo Village (Waridi Gardens) Management One Limited, which controls the estate.
Mr Ndung’u also wanted to be allowed back to the top management pending the hearing and determination of his appeal.

Former Tetu MP Ndung’u Gethenji is tomorrow expected in court to answer to charges of assault.
Gethenji, who is battling other criminal cases in court will be charged with assaulting a security guard in Kitisuru last Friday.
He is also engaged in civil suits over the control of a luxury home at Kihingo Village, Kitusuru.
Gethenji was picked up by DCI officers from the Gigiri Police Station on Wednesday night and briefly interrogated over the assault matter.

Summary
Justice Pauline Nyamweya said the criminal proceedings should remain suspended pending hearing and determination of a case filed by Mr Gethenji challenging legality of his trial.
The complainant in the criminal case is Mr Gethenji s brother, Fredrick Gitahi, and the genesis of the case is a dispute on control of the Sh20 billion estate they inherited from their late father, Gethenji Marekia, also a former Tetu MP (1992-1997).
Mr Gethenji was arraigned at a magistrate court in Milimani Nairobi on December 23, 2020 and was released on a bond of Sh100,000 after denying the forgery charges.
