California s Enrolled Bill Rule Challenges

The EBR provides too much deference to the legislative branch of government and does not comport with the constitutional doctrine of separation of powers among three, co-equal branches of government. At least for California purposes, the EBR principle should be limited.

Jacinda Ardern superimposed over US Constitution Photo: VNP New Zealand’s own constitution shifted a little in a similar direction in 2015 (though not so seismically), and Parliament is now exploring how to adjust to the new landscape. The change was caused by a court case between a prisoner and the crown (Taylor v Attorney General) about the right to vote. In its decision the High Court decided it had the right to declare a law inconsistent with another nominally ‘higher’ law, the Bill of Rights.  The then government appealed that adoption of a new power but the Supreme Court agreed with the earlier decision. And hey presto - slightly different constitutional landscape.
