The Bombay High Court has said probe into a case cannot be transferred from police to a special agency merely because the investigation is "not appealing" to a party concerned.
The Bombay HC said an investigation cannot be shifted from the police to a special agency simply because it doesn't satisfy one of the concerned parties.
The HC order had come on August 3, 2022, after Pansare’s family had approached it with a request to hand over further probe in the case to the ATS in view of the fact that the SIT had failed to apprehend the two absconding alleged shooters in the case and the masterminds of the conspiracy.
The high court had earlier this month transferred the investigation to the ATS. The case was earlier being probed by a special investigation team (SIT) of the Maharashtra Criminal Investigation Department (CID).
