The Delhi High Court recently ruled interim maintenance cannot be awarded to the wife under Section 24 of the Hindu Marriage Act,1955 when both spouses possess the same qualifications and are earning equally.

The Delhi High Court held that proceedings for maintenance under the Hindu Adoptions and Maintenance Act are not suits and that the court fees to be paid are not ad valorem (calculated according to value of suit) fees.
