understanding of will of law is risk. >> wall street journal editorial board calling out president obama after those remarks on the michael flynn case. rob: it was stunning to read that he misstated the proposed crime and ignored the history of his own administration in targeting mister flynn. we wonder what he is really worried about. >> joining us to weigh in his former federal prosecutor doug burns, thanks for being here this morning, appreciate it. with everything you've seen so far, what is your opinion? >> i was very surprised the former president would jump into that for a couple reasons, one, just protocol, why would he inject himself into a criminal case after he has left office but i agree with wall street journal editorial board that explores the history and context of the entire matter that the doj which stands credibly charged with violating protocol, setting up the general, not warning him of his rights, and the other thing, to call it scott free, really surprises me, having done white-collar and other criminal law for 35 years, scott free, financial devastation, loss of career, loss of reputation, the scot-free seemed to be a surprising comment. rob: it is not a case of perjury, talk about that and you say there is a lot of hypocrisy in anybody from that administration upset about flynn's case being dropped as it has happened to people before on their side. >> under federal law if you make a false statement to federal agent it is a crime even though you are not under oath, that is a distinction worth noting, that's not the case in many state contexts so to call it perjury is not technically perjury. might be slightly unfair to draw that distinction, he should know it is not perjury, it is a false statement case. as far as hypocrisy, is breathtaking hypocrisy. you have andrew mccabe weighing in saying he can't believe the flynn matter is kane being dropped, he came this close to being charged with lying himself in the hold background of the flynn matter pretty disgraceful and an embarrassing prosecution wishes, analyzing politics, weapon rising politics. there was no underlying crime that in my 9 years of the department of justice, i talked to many of my friends, charging somebody with 18 usc 1001 without an underlying crime. makes it surprising to double back that president obama would weigh in. shannon: bill bennett, former education secretary on special report and we will get your opinion on the other side. >> institutional norms, really? want to talk about institutional norms, the fbi, basic violations of law, new about this investigation going on for the new president who decided not to tell him, they fear something really big and tough on them is coming. >> curious if you do hear the same thing, something they fear something big and tough is coming in your opinion on sources st. john's are removing full throttle on the russia probe deal. >> i saw that and there is a lot of information they are looking at about this very topic and i don't want to necessarily jump full bore with the notion that the reason president obama did that was out of fear but at the same time let me address that, there's no question they are at the very least concerned, all the way up to worried and really concerned that some seriously little jeopardy is going to emerge from the durham probe, william barr, they cascade him and so on but he's going to look at this thing extremely closely and extremely fairly and you don't need me to tell everybody that there was a lot of misconduct when donald trump came into office, literally the day he came in you head people scrambling, susan rice writing that memo to do everything by the book and all of that and the reality is that they were absolutely committed damaging if not trying to remove a duly elected president. you heard many other people say that but it is true. they should be very concerned that that is what durham is looking at very closely. >> thank you. >> a desperate bid to be set free, a sheriff can't believe what he saw in one jail. >> very disturbing to think people would do this to themselves deliberately and in an attempt to somehow force our hand to release that. talk about people doing the cuts, the styling, these people haven't worked in a couple months, how important was this for them to finally get back to work and make some money? >> so important. we have been checking on our professionals weekly, daily, denise works hand-in-hand with every single one of them to help see what is best for government assistance and see them open their doors yesterday was something. this industry in general has fallen through the cracks with unemployment, most are self employed and different rules so they really need to get back to work and we were so happy that we could when we did. rob: a lot of people have not been getting the same kind of assistance. let's look at guidelines. in florida, to reopen, no drop in blood, you can only do appointments, leave 15 minutes between appointments to disinfect the station, no group appointments and must where the masks. let's talk about what you are doing beyond that, screening people for recent travel or illness, you got disinfectants, guests waiting outside, no magazines or common touch items, don't feel safe? do people feel comfortable when they come in? >> absolutely. people feel really safe. we are all wearing masks, we are asking clients to wear masks although that is not in the mandate, we are providing it, we are allowing extra time between appointments, 15 minutes extra to disinfect the rooms, one thing, in suites, one client at a time, one stylist at a time. it is easy to accommodate a lot of guests in separate spaces. rob: are you optimistic for the future? you think things will continue to be busy? >> the phones have been ringing off the hook. we are opening our doors with big bear hugs and smiles galore, happy to be open and back in. rob: love to see a business survive this thing and get back to working again, looks like a beautiful salon, appreciate it. rob: nice to see business owners so happy. 26 after they are, china's efforts to hide information about the virus, live with the new warning about beijing stealing american research on vaccines. >> controversy the thing before today a special election in california after a new voting syndicates added in a democratic part of the district. for a california gop chair predicts democrats will still lose in this big district in a big flip. he joins us to explain coming up. >> good morning. a new cluster of coronavirus cases popping up in wuhan, china, the original at the citizens lifting the city's lockdown. >> group of state attorneys general person congress to investigate china's deceit in this pandemic. >> a lot of developers overnight in the us china relationship. in the city of wuhan, new cases being reported, that is where the outbreak first began although it is a small number of new cases but there are concerns about the second wave, this comes 30 days after lockdown restrictions started to be lifted in this area of the country, china continues to face scrutiny for concealing early information about coronavirus. on monday a group of 18 state attorney general siler letter calling for congressional hearings into china's role in the outbreak. in the us the director of the national intelligence and security center told npr there are real concerns about china and others trying to steal coronavirus vaccine research but washington and beijing have discussed finding a vaccine first, donald trump address the was relationship with china in the rose garden yesterday when asked about specifically the trading relationship between the two countries. >> we signed a deal, i heard the too, they would like to reopen the trade talks to make it a better deal for them, china has been taking advantage of the united states for many many years, decades. >> amid all the talk of trade and back and forth jabs of change between the united states and china there are thousands of people around the world dying as a result of covid-19, and areas that were really previously considered reopening see a new spike in cases. >> thousands of fake dana loesch war tests and protective equipment seized by customs shipping from china, busted at the port of harrisburg in pennsylvania. panicked people are buying products from overseas without knowing the risks and warning the public not to buy anything that's not fda approved. >> inmates car trying to infect themselves with covid-19 to get out of jail. the los angeles county sheriff's office releasing video of people drinking from a shared cup and breathing from the same mask to try to catch the virus was 21 inmates got sick within a week and calls the behavior deeply disturbing. >> the mistaken belief among the inmate population that if they tested positive that there was a way to force our hand and somehow release more inmates out a jail environment. that is not going to happen. >> the scheme was uncovered well officials were investigating a spike in cases that county jails. >> i live in california where republicans are trying to flip an open congressional seat but at the last minute democrats added a polling place in a highly democrat voting area. gavin and gavin newsom mail the balance of every california voter for the 2020 presidential election. >> are these eleventh hour changes a product of the pandemic or taking advantage of it. joining us his former chairman tom dell, good to see you, thanks for joining us. what do you think, what is your take on this? >> the democrats for use in the state have either been exploiting a writing law that greatly benefits the mental to the field and all of these elections in california whether it is the top two format or what the nation knows is ballot harvesting or in this case voting centers, they wrote the law so that these voting centers which means when you go into a precinct you can go to any of these centers but what they have done is place them since they need to be in near transportation hubs or where there's a lot of transportation, what does that mean? that usually means the city and since the beginning of time cities have been more liberal in the countryside so they have the law to help them and make it easier for their constituents to vote and that is why 9 centers already in this district that benefited the democrats and this is yet another. >> it is interesting because you have these numbers on the mail in ballots, republicans are winning as far as sending them back and voting in that style. does that surprise you and is this why they have had this panic move? >> back when i was chairman i visited this district several times, there's a reason why republicans are doing better, this seat only flipped a democrat in 2016. it had been a republican seat for some time. there was the scandal with the prior democrat who was only in the seedier and had a colorful lifestyle, that is hurting the democrats and then the democrats haven't been able to do their ballot harvesting because of covid-19 so this is an even playing field and that usually helps the out party, in special elections when i was chairman of vice chairman we won two special elections in the state because the minority party only is more motivated. that is why i think democrats are going to lose this seat this time because republicans are more motivated and the problems they have with their candidates, she hasn't really worked hard and the fact that the scandal is why i think republicans can win this. >> monday night, 40% of gop voters mailed in the balance compared to 7% of democrats for 20% of independents according to political data. let's look at the statement hear from the democratic congressional campaign committee rejecting this, donald trump in washington, republicans know the more californians with access to the ballot, the worse their chances are, that is why they are falsifying sal on the weekend before the special election, your reaction to that? >> more than 24,000 californians will get double ballots because they have two active. there are 458,000 people that have died or moved. 2000 people allegedly over 105 years old getting these ballots. not in this district but throughout the state potentially so voter fraud and irregularities, we know this exists. that is how bob duren lost his seat with 3000 votes of felons in the district were they are not supposed to be doing that so we're used to this, the president is right and all republicans are right to be concerned and democrats have tilted the field but they are still behind because this is a race about mail in ballots, republicans do well in this kind of circumstance, democrats usually win on the day of elections in california, county after the election and that is where the danger lies. >> thank you, we do appreciate it. shannon: new jersey governor just extended restrictions are now he is ready to set firm dates to open the economy frustrating small businesses, live with the owners of a minor, fitness center live in who say they want to responsibly open their doors now. rob: major league baseball line of july start as nascar ramps up, live with steps that both did. it's totally normal to have constipation with belly pain, straining, and bloating, again and again. no way. more exercise. more water. and more fiber is the only way to manage it. is it? maybe you think... it's occasional constipation. maybe it's not. it could be a chronic medical condition called ibs-c, and time to say yesss! to linzess. linzess works differently than laxatives. it helps relieve belly pain and lets reason, and plans for expanded rosters in playoffs the biggest hurdle is the league asking to share half of the season's revenue with players in exchange for them taking less than normal salaries. bpa drive in, thank you for joining us. let's take a look at things that have reopened on a limited basis including parks, golf courses, marinas and boat yards, i can't understand why drive in can't reopen. >> exactly. we had plenty of patrons contact us with the same sentiment. i don't understand why we wouldn't be considered in the first wave of reopening. particularly when golf courses have reopened. we can deliver and have been able to deliver social distancing, most a patients remain within their cars, we can space them, we can be at 50% capacity, provide graded and 10 feet between cars, have 12 acres, two screens, patrons can attend is almost in a contactlast manner, order tickets online, order food and beverage online, we can deliver the feed to the patio when the patron gets a call to pick up the food. shannon: without having me contact, sounds like you have thought this through. let's talk about restaurants, restaurants can open in these states, alabama, arizona, arkansas, indiana and south carolina. as the owner of toes city diner, i'm sure you thought about different ways he would have to reopen with social distancing in mind, you had 85% drop off in sales and had to let go about two thirds of your staff, what plans have you enacted that you would be able to reopen safely if you were able to right now? >> outside dining, don't see why we wouldn't be able to have outside dining right now. we have people lining outside supermarkets keeping them 60, 8 feet, 10 feet apart and outside the healthcare industry i think restaurants as well are geared up, we are certified in safety and health and already have criteria we have to meet. >> i'm sure it is frustrating to you not to be with to reopen and have people sit outside sitting 6 to 8 feet apart or whatever you need to do. >> i think everybody is ready for. mostly restaurateurs and senators and counsel people and we are already. doesn't seem like anybody really understands, data determining the dates kind of thing is just lip service, the same thing over and over but we are ready and we know we can do it safely. >> let's go to alex. we can pull up a list of jennifer can reopen in certain states this week and you will see them on your screen, your located in cherry hill near philadelphia, your south of new york and all of new jersey, all the states haven't been hit the same so southern new jersey isn't the same as northern new jersey, you guys are only claiming you have the disinfectant and could let in fewer people, what would your plan be and how frustrating is it for you? >> pretty frustrating. it is going to be harder, we have a lot of professional fighters. it's going to be hard for them to socially distance in any capacity but with regard to our actual classes and members, i don't necessarily want to put any protocols in place because it is a fluid situation, things are constantly changing so for me to say how many members and some like that when one of the rules might be different, there's not enough clarity so i don't necessarily want to put anything in stone but we are totally ready to comply with whatever it is will allow us to open up. shannon: whatever i have to do is what i'm going to do. >> exactly. you hope the time sooner rather than later and soon. >> hoping the time is yesterday. shannon: appreciate your time, we will be right back.
