One LPD officer fired, two keep their jobs after Baker Street arrest

LANSING — A Lansing Police Department officer has been fired for escalating a situation in November.  Officer Alex Rojas was terminated after an internal investigation found he "caused other officers to use higher levels of force" during a Nov. 10 arrest, Police Chief Daryl Green said in a statement.  The other two officers, Alec Slobin and Morgan Schafer, were not fired. Asked what the internal investigation found regarding the other two officers, LPD Public Information Director Robert Merritt said he did not have the information. "You are welcome to file a (Freedom of Information Act) request," he wrote in an email. All three officers were placed on paid administrative leave while Michigan State Police and the Ingham County Prosecutor investigated the incident. The prosecutor did not file charges against the officers, but said their actions were "concerning" in March.

Prosecutors: Force LPD officers used in arrest not criminal

LANSING — Ingham County prosecutors have declined to file charges against three Lansing Police Department officers accused of using excessive force during an arrest in November.  The three officers — Alex Rojas, Alec Slobin and Morgan Schafer — were on paid administrative leave while Michigan State Police and the prosecutor's office investigated. A bystander caught part of the arrest on camera.  Prosecutors called the officers' actions during the arrest "concerning," but said it did not rise to the level of criminal charges being warranted.  "While much of the police behavior was concerning in light of our changing societal norms, and historical wrongs, the officers’ actions did not rise to the level of a violation of the criminal law, when reviewed in light of laws and policies in place at the time of this event," Chief Assistant Prosecuting Attorney Mike Cheltenham wrote in a memo to MSP. "As (the man) increased his level of resistance, the officers were legally allowed to use corresponding levels of physical control to respond."

No Charges Against LPD Officers For November Arrest

0:55 On November 10th, officers Alex Rojas, Morgan Schafer and Alec Slobin arrived at the scene of a reported fight that callers said included the use of a baseball bat. When met with resistance, their arrest of Johnathon Hardy led to the use of a TASER and closed fist strikes to Hardy’s head and face. Following a Michigan State Police investigation, the Ingham County Prosecutor’s office has determined that while troubling, there is insufficient evidence to prove beyond a reasonable doubt that the officers violated any criminal statute. In a statement, prosecutor Carol Siemon says she also will not charge Hardy with resisting and obstructing police. Siemon says her decisions “come in the context of trying to address the historical wrongs of our criminal justice system.”
