The Kerala High Court has dismissed a petition filed by V4 leader Nipun Cheriyan seeking to quash a criminal case registered against him for trespassing into the land where soil excavation was being undertaken for geotechnical analysis for the proposed Water Metro project and destroying the soil samples collected.
The petitioner contended that he was only trying to prevent Kochi Metro Rail Limited (KMRL) from constructing a bund on the Chilavannur lake, violating stop memos issued by the Revenue authorities. He alleged that he was being victimised for espousing a public cause.

The police on Thursday informed the Kerala High Court that Nipun Cheriyan, leader of V4 Kochi, and the other accused had destroyed soil samples collected for a geotechnical investigation by Kochi Metro Rail Limited (KMRL) from its work site near the Chilavannoor lake, thereby causing a loss of ₹2.25 lakh to the agency.
Opposing a petition by Mr. Cheriyan seeking to quash the case registered against him, the prosecution submitted that the petitioner along with the other three accused had trespassed into the KMRL work site and obstructed drilling for collection of soil samples on September 16, 2020. The petitioner had also obstructed the official duty of KMRL officials, damaged soil sample packets and taken away 55 packets. The geotechnical investigation was meant for the water metro project.

The Kerala High Court on Monday sought the response of the police to a plea by Nipun Cheriyan, leader of V4 Kochi, for quashing the FIR registered against him in connection with a protest against what he called encroachment by the Kochi Metro Rail Ltd. on the Chilavanoor lake near Elamkulam metro station.
When the petition came up for hearing, the prosecutor submitted that the petitioner and others had trespassed into the water metro work site and introduced themselves as the workers of the Chilavannur Canal Samrakshana Samithi, threatened the workers and took away 55 soil samples kept in a box on the site. The KMRL had incurred a loss of ₹2.25 lakh.
V4 Kochi activists granted bail

Three activists of V4 Kochi, who allegedly threw open the Vyttila flyover before it was officially inaugurated, were granted bail by a trial court here on Thursday.
K.J. Anjalose, Sooraj Dennis, and P.V. Ralph were those who were granted the bail.
However, the court denied bail to Nipun Cheriyan, the leader of the non-political formation, as he was arraigned as an accused in an earlier case booked under the Prevention of Damage to Public Property Act (PDPP).
The bail application of three more activists, who were booked by the police, will come up for the consideration of the Judicial First Class Magistrate on Friday, said the counsel for the accused.
