woman's car still on the sidewalk. this whole incident happened shortly after 7:00. the woman behind the wheel was driving at one point in time the wrong way down pine which is a one way street. and as you said earlier, aimed the car directly at the officers. this all started as a stolen vehicle investigation. they approached the woman at a near by gas station. as they approached that vehicle, the woman took off, turned up pine westbound on pine. then did a u turn on a one way street. the officers then drove up on to the sidewalk at one point and back up the street several times in about a 50-yard stretch. as she got back close to the officers they say she aimed her car directly at them and hit her gas. that's when the two officers on scene both fired their guns hitting and killing the woman behind the wheel. >> officers are authorized to discharge their firearm if they're in fear for their safety or the safety of another individual. being this close to van nuys obviously the vehicle already made it on to the sidewalk, off to the sidewalk several times. drove at them. they felt that they needed to use the force they did. >> reporter: now if you take a look you can see the investigation is ongoing here at this chevron station. that again is where the officers initially approached the woman about what started out as a stolen vehicle investigation. she turned out, started going westbound up pine which is a one way street. you may also be able to make out there's construction on this street so it's narrowed down to two lanes instead of three. going the wrong way up pine going up on a sidewalk and aiming the vehicle at the officers. at this point we're hearing no one else was injured although we hear one motorcyclist had to jump off his motorcycle to avoid being hit. authorities are still trying to identify the woman who was in the car. they tell me she was alone at the time of this incident. again, she appears to be the only injury and the only fatality in this incident. >> all right, so roads closed in the area. just the one behind you. is it partially shutdown or all the way shutdown? >> reporter: pine shutdown while police finish up their investigation on the scene. federal agents are looking for the person who sent a letter to the white house that contained cyanide. the secret service says the envelope was delivered yesterday to an off-site male screening facility. today those tests came positive. at this point it's unclear who sent the letter but the letter may have been -- a bat was found to have rabies. the bat was discovered in a grassy area. it was alive when it was found and turned over to animal control workers. experts say it's not surprising to see bats in this area. >> these bats are spread all along here. these are older neighborhoods, a lot of terra cota tiles and there's just a lot of places for bats to live. >> reporter: the principal of niles elementary has sent letters to parents and vector officials say they plan to sent out letter warning people in the area not to touch any bats if they come upon them. the water board has approved new restrictions for water use as the drought drags on. jana katsuyama has the story, these new rules affect all of us. >> reporter: whether eating out at a restaurant or just at home trying to save water. in case you think you've heard this all before, there are some new restrictions that the board is putting into place this year. it's a question you will hear more now when you sit down at a restaurant. >> water? >> reporter: new california restrictions announced today will require customers to ask for water. instead of being automatically served. >> since california is in the drought, i think it's actually a good idea like for me right now, i would rather just have hot tea. >> reporter: conserving water one glass at a time. the statewide restrictions are issued as california comes out of a fourth year in a drought. >> the goal was to reduce over all water consumption by 20%. and in calendar year 2014, we achieved that. >> reporter: statewide watering lawns and plants will be limited to twice a week. >> we have been trying to reduce water. even myself trying to do it once a week. >> reporter: residents must use hoses with automatic shut-off valves. >> the linens are all set up here. >> reporter: hotel workers must have signs telling customers they can decline service. >> this could save up to 30% of the water. >> reporter: at the mission lodge, managers say that they do that already and are about to install water saving fixtures. and also new this year the state is requiring that local water districts report their enforcement attempts to the state. jana katsuyama, ktvu news. caltrain is working to get service back to normal tonight after a man was killed on the tracks in mountain view. a caltrain spokeswoman says it was an apparent suicide. witnesses say the man jumped right in front of the northbound train at the san antonio station around 4:40 this afternoon. the train was an express train and passes through that station without stopping. trains had to be single tracked for about four hours causing mayor delays. this is the ninth death on caltrain tracks so far this year. a high speed chase that began in solano county came to a stop in los altos. the highway patrol said the spike strip was actually deployed in fremont and it flattened several tires but they said the suv continued on its rims until it's front axel literally fell apart. the driver took off hitting speeds in some cases of 95 miles per hour. new at 10:00, the fight over a struggling eastern golf course. the owners of pine meadow golf course in martinez say they can no longer operate. as heather holmes reports their plans for the 27 acres face significant opposition. >> reporter: at the pine meadows golf course in martinez, the ping of an iron hitting a golf ball may soon fade from the fair way. after years of losing money, the owners say they can't stay the course. >> business has been bad. we're going through some really difficult types. >> reporter: christine towerdine was hoping to come to an agreement with the city or take richmond after talking to musicians tonight and amber he says he's heartbroken. >> reporter: yes he is, and richmond police tell me they have two detectives working on this case. but the musician tells me he doesn't feel safe because the thieves have not been arrested. >> ♪ ♪ >> reporter: jay kirkland says playing music kept him safe as a young boy growing up in richmond. >> gun violence. i've lost three friends that aren't here because of it. >> reporter: music kept him in tune with what's important. but the guitar he uses to perform and teach at risk youth for a nonprofit guitars not guns were stolen a week ago. he asked us not to show his face. >> completely shock, disbelief. brokenhearted. >> reporter: on friday a woman was caught on surveillance camera at the guitar center in emeryville with one of kirkland's guitars. he was trying to sell it. a friend of the musician that worked at the store recognized the guitar and called police. emeryville police cited the woman but she was not arrested. >> that's why i don't want to show my face until this gets handled. i don't know if it's going to get handled. >> reporter: police say it's a misdemeanor if the stolen item is valued at less than $500. they rushed to the store. >> i was disgusted. i could not believe it. i never felt like that in my life. i just felt like i had been punched in the stomach. >> reporter: barbara runs guitars not guns. she told us that the guitar the woman was trying to sell has been returned but three other electrical guitars are still missing. one that looked like this one. one in a taup color and one not pictured in a black and white tiger stripe. >> how could they do that without any regard. >> reporter: the woman and two others seen at the store were seen last week trying to break into kirkland's home. >> i want these people caught. i don't want this to happen to anyone else. at all. >> reporter: police are now processing the fingerprints found in kirkland's home to see if they match those of the people detainedded at the guitar center. >> amber, thank you. two men charged with killing an oakland mother appeared in court today. shelton mcdonald and jerry hamilton have been arrested. a total of three men are now behind bars in connection with this case. police say they were involved in a gunfight that left 30-year- old shamile pierce dead in front of a west oakland home monday. pierce was struck by a stray bullet as she tried to shield her two children ages 7 and 9 and get them to safety. the third suspect 19-year-old anthony sims was arrested a week ago. he was wounded in that shoot out. police say he has admitted to being involved. now to the election in israel. election results had him tied with his challenger herzog. but a short time ago, mr. netanyahu pulled ahead. in israel's system, voters select parties and the leaders form alliances with smaller partys to create a coalition government. earlier today mr. netanyahu made a play for votes saying right wing rule was in jeopardy and warning that israel's citizens were voting in droves. >> to prevent the rise in power of the left wing party, there's only one thing to do. close the gap. >> his opponent had been leading the polls just a few days ago. now mr. netanyahu seems to be on his way to a third term. the nfl responded today a decision by linebacker chris boreland to retire from the 49ers after his rookie season. azenith tells us he's walking away from america's most popular sport due to concerns about his safety on the feel. chris boreland was by all accounts on his way to becoming one of the nfl's great. the 24-year-old is walking away from a reported $4 million three year contract for one reason. his health saying the violent sport isn't worth it. >> it doesn't to me it doesn't permit people from loving the game. it's a gladiator sport. >> reporter: daryl pollard played 11 seasons in the nfl winning two super bowls with the 49ers in the 1980s. he says nfl players are more aware of the dangers associated with head trauma and the sports long term effects yet it's a decision that's personal and unique to each and every player. >> i don't think it's going to demise or slow down the game very much. i mean, the nfl probably most of this came about when the lawsuits came. >> reporter: dr. long is the chief of brain injuries at the santa clara center. she's treated athletes for their concussions and say they can often lead to serious brain injuries. she knows many in the medical field talk about not having their own children play sports like football. >> his decision to retire at this stage of his career is certainly a difficult one for him i would believe. but he needs to weigh the risks and benefits. >> reporter: boreland's choice she says the more education the athlete has the better. given players concerns, more changes could happen in the nfl down the road. in regards to better teaching and how players can avoid risky plays. >> don't lead with your head. extend it to the back. there's ways of doing it. >> reporter: the nfl sent this statement surrounding its health and safety policy. it said in part by any measure football has never been safer. we continue to make changes with rule changes, tackling equipment, and medical care for players. the statement also said concussions were down 25% last year. in santa clara, i'm azenith smith, ktvu channel 2 news. the marin county board of supervisors revealed a new proposal. cyclists sometimes ride too fast and cause collisions with walkers and joggers on the millvalely sausalito path way. the current speed limit for bicyclists is 15 miles per hour. the measure before the board would have it reduced to 10- miles-an-hour. a public hearing on the lower speed limit is set for march 31st. and a nice looking night out there. mild conditions. there's no fog out at the coast. there's san francisco a live camera shot. you see the bay bridge and off in the distance this clarity gives you an indication of the clean sky we have. you can see everything moving from ocean to land. that's a different direction than what we were seeing last week. what we're going to see then is this continued mild weather with maybe some patchy coastal fog and that slight on shore flow. obviously nothing showing up on the radar and clear throughout the bay area tonight. again, it might be a little patchy fog in the morning but really nothing that should be a problem for travel or just getting to where you're going. the current numbers are in the upper 50s, concord 59 degrees. so just a clear 50. upper 40s, maybe a little bit of fog. this is just cool. for this time of year that's not that bad. that's about a little warmer than i might expect for the last week in winter. forecast highs tomorrow those yellows are 70s. so more 70s tomorrow than we saw today. a slightly warmer day for your day tomorrow. with those increased temperatures, we're talking about pollens and the tree pollens are they came up about two weeks ago, now they're working their way into a small range. anything blooming up front is what's getting you. grasses are starting to show up just a little bit on control street behavior. protesters with the streets are for everyone coalition lined up at the council meeting for public comment. business owners say a solution is needed because of people urinating in public, cooking on sidewalks, and sleeping in door ways. tonight oakland police are looking for a driver who ran away from the scene of an accident that seriously injured five members of one family including three children. it happened about this time last night. at 68th avenue and mcarthur boulevard. ktvu's katie utehs spoke to neighbors who hurried to the crash scene to help. >> people just of life to free an 8- year-old boy and 10-year-old girl still trapped in the mangled wreck. the vehicle was a tan suv and after it struck the victim's car it moved with such force it hit several others on the block including this one in front of me. then the men inside took off. >> reporter: gray followed the baby's ambulance to the children's hospital. while the condition of the other family members were not available, a family member told us today they're not doing well. police have not released any suspect information. >> they don't even know if she's going to make it. >> reporter: all heartbreaking news for the women who responded as if the family were their own. >> the first thing i thought about was my kids. i said if they ever get in an accident i want somebody to help them. >> reporter: katie utehs. kraft foods is recalling macaroni and cheese. kraft says eight people have reported finding metal fragments. the recall affects original flavor kraft macaroni and cheese. a multimillion dollars debate. the dilema facing one county into whether to funnel money into jails or divert it to programs to help inmates once they're out. the sudden death of a high school athlete, liu is in san jose where the teenagers friends and family are trying to cope here with the shock of this completely unexpected loss. cara. >> reporter: well students say it was a very tough day here at the campus. at many of the school's activities and games were cancelled for the day. >> reporter: a bouquet of flowers was left on the chain link fence near the track just one of many ways students at leland high honored tristan luien after collapsing during track practice. >> on facebook there was a m ovement. >> i think it's horrible like, from what i've heard he's a great person. and what he did he brought smiles to everyone's faces. >> reporter: friends tell us tristan was quiet and well liked. a good student with a great smile. the teen played football and was part of the track team throwing discus and shot put. >> we actually all gathered by the shot put pit today where tristan used to practice. and we had a silent memorial for him just to sort of remember him. >> reporter: teammates say the track season will be dedicated to him. >> it's really tragic and puts things into perspective. >> reporter: a spokesman for the district says the incident happened around 3:00 p.m. monday. one of the coaches started cpr right away. >> paramedics responded to the school. they continued to perform cpr on the student. transported him to the hospital and unfortunately, we lost our student later that afternoon. >> reporter: the principal stopped by each of tristan's classes today. the district crisis response team was also on campus. the death of this 16-year-old was sudden and unexpected and no word yet on what caused it. grief counselors will be back out here on campus tomorrow. >> cara liu in san jose tonight, thank you. the largest presbyterian church approved same-sex marriage today. presbyterian church have approved the change in wording. the new language says marriage is a commitment between two people traditionally between a man and a woman. joseph clancy told the house committee he didn't hear about the incident. two agents drove into a construction barrier with other agents were investigating a suspicious package. clancy was asked whether they were intoxicated after attending a party. >> were these people given a sobriety test. >> they were not, to my understanding. >> why not. >> sir, i can't answer that. >> who was asked not to do that. >> sir, i can't answer that either. >> clancy says he doesn't have the authority to fire people on the spot. authorities are facing a tough decision involving millions of the dollars. mike mibach tells realignment. he says his department gets 18 million of it to run county jails. and needs every cent due to the prison transfers. >> they're more sophisticated, gang activity, gang involvementand security issues at our jail. >> reporter: earlier this month the board of supervie meeting was interrupted. they demanded the supervisor allocate not the 18% but more to the proposals. >> can you get the votes. >> i think that we understand there's a need for more programs in the community. >> this isn't just people walking around like a hotel environment. we have to escort people to and from wherever they go. that includes religious services and programs. so when you cut down our budget that cuts down our staffing. >> reporter: andre wiley's program had less than 10 clients. >> they can the fire. similar celebrations are held around the world. the civic center in berkeley has held this celebration for the past 30 years. leap transit is launching a private bus service with four stops along the lombard street corridor and four stops downtown. leap says it buses are equipped with wifi and laptop bars. they'll run about every 10 minutes or 15 minutes. a single ride will cost $6. leap is looking to draw customers who are fed up with overcrowded public transit. facebook is making it possible to send money to your friend during a chat session. facebook said today that users will be able to link their debit cards to their messenger accounts and send money to people who are friend. this program will be slowly roll out over the next few months. it's the latest pier to pier money transfer services. there's also services by square and snap chat. the feds benchmark rate has been near zero since the recession began in 2008. many now expect the rate hike could come as soon as dead. more on the violent end to the bitter financial dispute between the two men. >> reporter: investigators combed through row after row of grapevines searching for evidence to the murder that happened here yesterday. iman tafiles called 911 for help claiming that his business partner dahl had shot him and was running through the vineyards. dahl turned the gun on himself. dahl had been returning this winery since 2002. this is him talking about the napa earthquake. >> actually created some wine. sold some wine. but in the process, the whole enterprise went bad. >> reporter: lewis perdue is the editor of a trade magazine. he's been following the lawsuit that dahl has been a part of for the last five years. dahl came to napa escaping financial trouble. some of his investors investors accused him of taking money out of one business and putting it into another. >> it's kind of a ponzi scheme. >> reporter: last year dalh sued tafilis for unfair lending practices a judge threw the case out. tafilis sued dalh to get his money back. >> there's a whole series of really increasingly bitter e- mails that are part of the court record between imad and dahl. >> reporter: tafilis, dahl and their attorneys were supposed to meet to work out how dahl would pay back the 1.2 million he owed. >> dalh was going to lose everything right there. >> reporter: dahl made a last minute change and asked if he could meet at his vineyard instead of san francisco. the attorneys were on the phone, the two men were at the winery when the conflict broke out and shortly afterward is when that shooting happened. allie rasmussen. elsewhere in napa a man's naked body would you say found inside a large freezer today. police are trying to determine if it's a suicide or homicide. police went to the man's apartment on brown street after they say a relative requested a welfare check. they say the man was 54 years old hadn 't been seen since late february. police say the man may have suffered from mental illness and possibly put himself in the freezer on purpose. the man's name is being withheld until family members are notified. astronomers say an electromagnetic -- are
