The sentencing hearing, which is still taking place on the second floor of the hall of justice behind me here in San Francisco was just in recess. It is back in session. It is expected that the judge will sentence Jose Ines Garcia zarate to the maximum three years in prison after being convicted of a firearm possession in the death of kate steinle. Again, that sentencing has not taken place yet, this is what legal experts are expecting. Hes likely fulfilled that sentence given time served. Zarate was acquitted in the 2015 shooting death of steinle at San Franciscos pier 14. This is after the jury decided he was not guilty of murder and manslaughter charges. This morning, his defense team will argue for a retrial on that possession conviction. His lawyers claim the jury was not informed about transitory possession, thats the idea that Garcia Zarate held the weapon briefly but not long enough to call it possession. The prosecution filed a motion this week arguing that that claim is bogus

Investigators say he tried to cut a deal with investigators and surrendered to police today but this was a no go from the Police Department. Without a deal in place, he allegedly tried to run to San Francisco and avoid capture which didnt work either. Surrendering when we are about to arrest you doesnt really make us change the manner in what we are doing. The suspect did not give the victim a choice, we certainly were not going to allow this suspect to dictate how we were going to take him into custody. Chief eddie garcia says without a surrender deal in place, it is headed to San Francisco where he cut his hair in an attempt to avoid capture. The San Francisco Police Department made the arrest last night. Investigators say this is the same man seen here seen here in a surveillance video. Here we are august 1st already, summer flying by, hottest time of the year. We will see temperatures in the lower 90s. We are waking up, somewhat on the comfortable side. It is warm. Mid 70s in philadelphia at the airport. 76 degrees. Nice 60s showing up north and west allentown at 64. Sixtyseven in reading. South jersey we will go also in the lower 07s in wildwood right now. There are the suburbs quakertown a cooler spots and pottstown coming in at 64 degrees at this hour. The wind are shifting out of the southwest. That keeps heat around. Humidity levels slightly higher then yesterday but still not too bad for early august, and we will look at those dew point temperatures in yesterday and they were in the lower 60s and 50s and little bit high tore day.
