A Great Falls couple filed a lawsuit at the Eighth Judicial District Court on Monday challenging the ban on cannabis dispensaries within city limits. 

The Montana Attorney General said it would not appeal a Lewis and Clark County District judge's ruling that Senate Bill 319 was illegal because it violated the one-topic rule set forth by the Montana Constitution.

Montana Gov. Greg Gianforte said that all documents pertaining to the legislative process and the decisions he makes is off-limits.

Commissioners voted to deny the appeal from dispensaries over a Safety Inspection Certificate and to bring forward a marijuana sales referendum.

The commission voted 4-1 to make a referendum and put it on the ballot for voters in November.
