cbic: CBIC raises threshold for filing appeals before CESTAT and courts

The Central Board of Indirect Taxes and Customs (CBIC) has increased the threshold for filing appeals before the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) by ten times to Rs 50 lakh, aiming to reduce litigations. The thresholds for appeals in high courts and the Supreme Court have been doubled to Rs 1 crore and Rs 2 crore, respectively.

​Earlier on September 5, the CGST issued summons to the petitioner in regard to avail of Input Tax Credit (ITC) by allegedly using fake invoices. Subsequently, on September 8, Saiyed was arrested and was remanded to judicial custody. On September 18, a show cause notice (SCN) was issued to the petitioner for cancellation of the registration. The CGST also attached his bank accounts.

In its judgement dated September 20, the court sent the case back to the assessing authority to examine the evidence provided by the petitioner irrespective of the difference in GSTR-2A and GSTR-3B forms.
