it's not complicated. president obama, we've got this big debt crisis. president obama, two things -- number 1, months ago, he put out a detailed plan. it's in print, and it's online, of how to resolve this fiscal crisis. no. 2, the republicans said we are not going to deal with it. we will take seven weeks off. we will have an election and let the people decide. president obama went out in front of the american people. there was one issue, the central issue. it wasn't the war in iraq iran's nuclear possibility of iran getting nuclear weapons it wasn't peace in the middle east. it wasn't immigration reform. the number 1 was issue was president obama said very clear, we want the wealthiest two percents of americans to pay more in tax after having 12 years of a special tax break, which was only supposed to be temporary. if you say yes vote for me. mitt romney says, no, we are going to caudle, protect that top 2%. we are not going to raise their taxes. so if you say no, vote for me. that was a choice. the american people overwhelmingly, overwhelmingly, margin of 5 million, voted for president obama. john boehner is acting as if we never had an election in the first place and the election doesn't mean anything. is the senator has passed a tax break and john boehner is saying no, we will let 98% of americans pay $2,000 more in taxes. we will give a tax increase. we will raise taxes on 98% of americans unless you give us another tax break for our buddies and millionaires and billionaires, the top 2% in the country. you can't blame even mitch mcconnell any more. it's john boehner who is standing in the way. he did so again the republicans give this babble. the president says what's your plan? what do you want to cut? close loopholes. what loopholes? they won't say. to them, nothing. a detailed plan versus nothing. you've got a existed in in president obama versus a lose her in john boehner. and here is boehner again yesterday, on fox news sunday saying, when he looked at the president's proposal, oh my god. >> i was flabbergasted. >> flabbergasted. >> he can't be serious. i just have never seen anything like it. we've got seven weeks between election day and the end of the year three weeks have been wasted with the nonsense. who is flabbergasted anymore? have you ever heard that word? >> peter: an old word. >> 1920s called. they weren't there. >> bill: yeah, my great aunt madeline used to say, "flabbergasted" she was 90 then. >> i was waiting for him to say we got beat, it was a slobberknocker. >> maybe they say that in the bar. the other thing is t flabbergasted? he has known about this plan. you can check it out. this is nothing to be flabbergasted about. this was out there long since the election and ever since. >> a non--serious proposal. the president was asking for $1.6 trillion worth of new revenue over 10 years, twice as much aziz been asking for in public. stimulus spending in here exceeded the amount of new cuts that he was willing to consider. >> boehner -- >> it was not a serious offer. >> not a serious offer. wait a minute, the president has offered a detailed offer. right? not to get too technical but it's a $4 trillion plan, been out there a long time 1.6 trillion over the next years, cutting the deficit, 1.6 cutting the tax cuts for the wealthiest for americans, and medicare and medicaid and farm subsidies and other, $1 trillion in additional spending cuts that the house, the senate and the white house have already agreed to and then $800,000,000,000 in new spending new revenue from cuts and spending because of ending the war in iraq and in afghanistan. the president's budget is out there. on the republican side, there is nothing. i am going to get back to it. here it is, also guy in the way is boehner. you have heard me say this, that boehner is not a bad guy. i used to think that and if you let him go, he would make a deal. i don't believe that any more. i think boehner is out to -- he doesn't care about the middle class, and his goal is to let this country go over the fiscal cliff because he wants the economy to fail because he wants president obama to fail. john boehner, again, i think the worst speaker ever, it's a time for leadership, not for playing political games. american people have spoken. this is a time for leadership. i think if john boehner is unwilling to lead, we've got to put pressure on him to get the hell out of the way. fish or cut bait. get the hell out of the way. he has no backbone. he has no balls. he is a lousy, lousy leader. he is a looser. i think we ought to start putting the pressure on him. let's pick a fight today with john boehner. it's not picking a fight with boehner. it's just doing something to save this country. so, peter, how do people -- i call on you join me in call okay john boehner lead or get out of the way. >> peter: if you want to send him an e-mail speaker.gov/contact. you can send it to him. if you are on twitter >> bill: speaker.gov spiritists we are tweeting this as well. if you are on twitter he is tweeting @speakerboehner, @ speakerboehner. or call the office of the speaker, 202-225-0600. you can call the office of the speaker right there. >> bill: 2 on 5? >> bill: well, you know, we are trying to this morning, here, rachel. some others are, too. but here is with a i would say. i wish president obama would do what we are doing this morning and call out john boehner and just identify him as the villain because he is. he is the guy. he is the one guy. it's already passed the senate, the tax cut for 98% of americans has passed the senate. as much as we would like to blame mitch mcconnell and john boehner, it's out of mcconnell's hand. john boehner is the one standing in the way of putting that tax cut for the 98% up for a vote. why? because he is protecting his -- the only people he cares about is the top 1 or 2%. i will get back to your calls but one more question. bill kristol was on fox news yesterday and he is telling you, the republican party, do you realize what you look like under boehner's leadership? it's pretty simple to me it seems to me if they scheduled a vote in the house of representatives on the tax cut, continuing tax cut for 98% of americans, it would probably pass. don't you think? >> i am not entirely certain about that. i mean the -- i think the democrats have started coming around on their messaging a little bit. at the beginning of this, they were talking about, president obama, too, were talking about extending tax breaks for 98% of americans, 97% of small businesses. >> that's not true. the tax breaks for any -- for income under $250,000 extends to 100% of americans. everybody gets it. >> the president said that friday in pennsylvania. >> obama had started to talk about how everybody would get these tax breaks with the other income. i think that's a pretty effective message. we will see whether or not they are able to convince anybody of it. republicans in the house are getting a lot of pressure from folks sort of the most rabidly anti-tax, grover norquist's good and a couple of other folks saying allowing any revenue, any rates to increase qualifies as a tax hike. >> yeah. but that's been their position all along. that was the central issue. taxes go up on the top 2% or they don't. right? it was obama versus romney. he keep come back to this that you heard bill crystal say what the hell are we doing as a party? even tom kohl said let's buy in 98% and get it out of the way and take credit for it. why is bajner refuse to go schedule a boat on that proposal. >> obtain doesn't have the votes. simple math, this is sort of the reality of washington. >> doesn't have the votes to block it? >> he doesn't have the votes to pass any kind of tax reform from his own caucus. they operate by a rule called the majority of the majority. effectively the house republicans will do whatever the majority of their caucus says is okay with. you know, they don't have that majority. >> if they deck -- okay. i am trying to understand where boehner is coming from. right? >> yeah. >> bill: because i think this is a time for sleepered. i am say that. not you. if he allowed that the democrats would vote for it. they don't need that many republicans. it seems to me that the pressure, then, on the republicans, a good number of them, would be you are going to stand up against -- a tax cut for 100% of the american people? really? really? i mean, this whole exercise here, somebody made this case to me last week that i thought was real smart the exercise democrats are going is to try to give john boehner cover. he needs this political cover needs to consider his own politics which is, you know he's got somebody in his number 2, eric cantor who would be willing and eager to take over the speakership if and when that opportunity presents itself. boehner, himself, has to eliminate the -- cantor's ability to take that opportunity. so he's got to be -- he's got to take the hard line there. so his own politics, he's got to be where you can see democrats trying to find a way to give obtain cover to claim a victory for his own base so he can find some middle ground there. >> meanwhile, i guess we should be happy that john boehner has found a spot for a woman among the republican leadership, the committee chairs? or is there something bigger here? >> well, it's the sort of -- first of all, the biggest crack-up in my opinion was with the national football lealing for allowing them to play this game. >> playing anyway? >> it shouldn't have happened if you look at the timeline by 8:00 a.m., johan belcher kills the mother of his child. by 10:00 a.m. he kills himself flovrpt his head coach scottie pioli and his defensive coordinator. by 10:00 a.m., the n.f.l. is telling the panthers to make the trip to kansas city. by 3:00 p.m., there is a hastily worded releases that say no, the decision was actually by the kansas city chiefs and head coach rom yes purnell and it's best for the team for the healing processes to go ball and play. now, en if you do believe that -- and frank, i don't. but even if you do believe that that it was the decision of the chiefs and their captains why is that even their decision to make? this seems like more an issue for mental health professionals than anymore. jaf javon belcher was a teammate and they had to process that he was a murderer and a suicide all in the matter of minutes and then had to play a violent game 24 hours later. it shouldn't have happened. it's a sham that it did happen. shame on the n.f.l. because they have such a high cultureal platform and the message that they are sending to their fans is that their schedule their multi-billion dollar training, that needs to run on time is more important than any kind of perspective about the terrible loss of life that took place. >> right. >> yeah. >> god forbid that they cancel a game and it may be lose any money? right? >> exactly. >> yeah. >> it's a terrible history that the n.f.l. has on this question. >> with his troubles, again, does this point to a bigger issue in the n.f.l.? is there any connection? or is this just an isolated incident where a guy just lost it? what do you say? >> well, here is the problem is that it's the -- it's the fourth suicide in the last year of former n.f.l. players. and there are people who started to come forward even in the last 24 hours to say that belcher was dealing with head injuries in the same kind of a way that the other people who had taken their own lives were dealing with. so we are going to know more in the days ahead about what took place. but we do know that given the facts that we know for a fact that thousand now link firmly concussions and a condition that's known as post-concussive syndrome to things like agrees suicidal tendencies spousal abuse, all of these things are linked together with this kind of brain injury. given javon belcher had no history of violence no history of violence against women and nothing that would give a cue that such a thing would take place, i think in the days ahead, certainly we are going to hear more and more about that. >> i saw one official of the chiefs last night say that javon bell sher had nol history of head injury but he was playing football. >> the owner of the team who, unprompted said that, that there is no history of concussions. with all due respect to mr. hunt i would not take that pronouncement very seriously. >> you probably saw bob costas last night raised another issue which was the gun issue. other incidents, we tend to -- we tend to overlook the fact that with so many of the murders and suicides, they are using a gun? >> william -- >> shouldn't it be a no-brainer? >> it puts republicans in a corner who wants to vote against a bill that extends a middle class tax cut? nobody but of course republicans make the argument, well we can't just extend it. we have to extend all of them. with the economy, it isn't fair blah, blah, blah. we have heard this for months. longs longer than months. now that obama won, he has this new leverage. he's got a lot going for him finally, and he has the cojones to put a deal on the table as a starting bid in the negotiations that isn't already caving. this is the first. republicans are acting like we were saying during break that john boehner was flabbergasted by the proposal the democrats put forward. i think if anyone who has been following this is flabbergasted at anything, it's that obama put forward plan that is look a true wish list instead of an already- half-caved starting point. >> here is boehner on fox"fox news sunday," his reaction to the president's plan and jay carney showed us last week has been out there for a long time. >> right. >> it's in print. it's online. if they have electricity, they could read it and john boehner says: >> i was just flabbergasted. i looked. you can't be serious. i have just never seen anything like it. we have seven weeks between election day and the end of the year. and three of those weeks have been wasted with this nonsense. >> okay. thank you, granted paw. >> he said "flabbergasted". >> flabbergasted. >> this is so silly. everybody knows this is posturing. everything is posturing. anyone reading into it, what is it? i think john boehner wants to make a deal. they all want to make a deal at the top level but they have to save some face. they can't just swallow this giant turned that is the democratic package and walk away looking like they have won anything. so republicans have to figure out what they are willing to concede. so is it a question of just swallowing all of the bush tax cuts for the wealthy letting them expire? i think they are going to have to -- i think they are going to end up putting something out there whether either they lower the percentage that -- that the bush tax cuts for the wealthy will be drawn at. the light a which they are cut off. this is great area with how much of those are cut you know. >> was i hearing correctly, did jennifer just call this a giant turned? lafayette, elissa harrington, cbs 5. >> thank you. another sinkhole opened up yesterday. this one in the santa cruz mountains on vine hill road near the summit and highway 17. it's big as well one entire lane is gone and the remainder of the road is in jeopardy because there's nothing underneath supporting the pavement now. it's not clear how long that road will stay closed. one north bay school is closed today because of damage from the storm. cbs 5 reporter cate caugiran is in fairfax where crews will be clearing out flooding. good morning. >> reporter: good morning. yeah, there will be no school for white hill middle school students today. you can take a look at this video we shot earlier this morning. this weekend's stormy weather prompted school leaders to make this decision last night. according to the san anselmo patch, a letter was sent to parents that stated that white hill middle school had significant flooding in some classes including parts of the library. the principal said the staff needed time to clean up and relocate the classes. there is no word -- [ signal breakup ] classes tomorrow, as well. but parents were told to check the school's closure hotline later this afternoon. that number we have here up on your screen: (415)721-4751. now, in that letter the principal says he is hopeful that school can reopen by tuesday again but they are going to have to assess the damage from the weekend storm today. live in fairfax, cate caugiran, cbs 5. it's not just the heavy rain. powerful winds also caused some problems. this broken power pole in san francisco's sunset district left 8500 people without electricity. it was just one of several incidents where trees or power poles brought down electrical lines. several cities are still without power. more than 650 in the north bay, more than 600 in the east bay and around 600 in the south bay. sonoma county has the largest outage with 3,000 still in the dark. three firefighters are recovering after a major crash. the accident happened on highway 24 in orinda during yesterday morning's storm. the firefighters were helping victims of another crash when an suv clipped their truck and slammed into them. they are all in stable condition. rain opened a large pothole on westbound 4 in pittsburg. it's blamed for flattening the tires of about two dozen cars yesterday. crews shut down the lane while they made emergency repairs and it's now open again. 6:04. flood warnings for the napa river were canceled. some residents prepared for the worst though emptying sandbags around their properties. heavy rainstorms of course brought the water level within three feet of going over its banks. but it did not crest. this was the russian river in guerneville over the weekend. flood warnings were also canceled there. the river crested at 16 feet about an hour ago. the highest recorded flood in guerneville occurred in 1986 when that river reached a monstrous number of feet, 49 feet. that must have been something. and the flood threat for the truckee river in california, nevada, is over, as well. the storm turned out to be colder than expected turning a lot of the rain to snow and dropping snow levels down to 7,000 feet. truckee river is now expected to crest below flood stage. the good news is i think we are getting a break from all this weather. >> yeah. no rain today. we are going to get some showers during the week but nothing like over the weekend. >> no. i mean, those were amazing totals we saw from the storms, almost 16" in some of the mountains around the bay area. you can see why all the rivers are full. but the good news is they are going to stay within their banks. right now a much-needed break outside. still a lot of clouds out there. it's chilly in spots, too, down to 39 degrees right now in santa rosa. 45 in san jose. 49 in san francisco and 42 degrees in concord. here's the storm sweeping through yesterday. what a storm it was. some of the gusts there 50 and 60 miles per hour. not to mention all that rain. but now high pressure building in behind the system means we are going to dry things out at least for a day. passing clouds overhead and a mix of sun and clouds of sunshine. the temperatures not too bad. mid-60s into san jose, 46 in livermore, 46 in san francisco and about 63 degrees in santa rosa. there's another storm morning. no metering lights just yet but traffic is slow as you work your way towards the pay gates ther in the cash lanes. fastrak okay towards the toll plaza. no problems on the upper deck into san francisco. in san francisco we have reports of trouble on northbound one at third. an accident that vehicle hit the guardrail blocking the right lane on northbound 101 at 3rd. traffic is building on the northbound side of 101. now, if you are heading on the westbound side of 80 eastshore freeway commute not showing too many problems. traffic still moving okay as you hid towards the bay bridge. 880 an easy ride northbound. more cars on the southbound side of 880 mostly in hayward if you are connecting over to the san mateo bridge. you might see some slight delays on the connector roads. great highway closed as well for storm clean-up. that's in effect between sloat boulevard and lincoln way. no word yet on when that lane or those lanes should reopen. again we'll keep you posted but again completely shut down in both directions. that's traffic. back to you guys. >> thank you. new this morning, two chp officers were injured after their patrol cruiser rolled during a chase in livermore. it happened just before 4 a.m. on eastbound 580 between greenville and north flynn roads. officer was chasing the speeding car when the patrol car flipped. the driver sped away. other officers caught up with that car in tracy and pulled it over. two officers in the flipped car are taken to the hospital with just minor injuries. also this morning, a police chase in campbell ended with a car nearly crashing into a home there. this is on central avenue. police say they tried to stop the car for a traffic violation. the driver took off crashing into a fence next to the house. the driver got out and took off. he was later caught. police say the car involved was stolen. and take a look at this. a chase all the way from san jose to oakland. hot pursuit there. chp officers began pursuing that car because they didn't have any headlights. at times they reached speeds of 90 miles per hour. they finally used a spike strip to get the car to stop. that driver was arrested without further incident. chp says he will be charged with recklessly evading police officers. one of the safest big cities in america has hit a homicide milestone. on friday, san jose police responded to the city's 43rd killing of the year. a 17-year-old boy was gunned down in a neighborhood. last year the city saw 41 homicides. later this morning, a teenager from vallejo will be arraigned on charges of at the same time murder, kidnapping -- attempted murder, kidnapping and sexual assault. police say the 14-year-old abducted a 65-year-old woman at gunpoint from a shopping center parking lot last month. they say he forced her to drive several miles before sexually assaulting and beating her. police believe it was a random act. former bart police officer johannes mehserle is expected back in court this morning trying to get his conviction overturned into the 2009 shooting death of oscar grant an unarmed man who had been detained by police. mehserle already served his two- year prison term for involuntary manslaughter but wants to clear his name. lawyers for grant's family will argue against overturning the conviction. it could be as soon as this morning when the u.s. supreme court announces whether it will take on same-sex marriage cases. one is an appeal from supporters of prop 8, california's voter-approved measure that limits marriage to male and female couples. it was previously struck down by a u.s. appeals court. some challenges to the federal defense of marriage act are also being considered. and newly elected members of the state legislature will all be sworn in today in sacramento. the assembly will go first with a ceremony at noon. that is followed by the state senate at 3:30. both houses of course reshaped by last month's election as voters gave democrats two- thirds of majority that allowed them to raise taxes if they choose without any republican support. on capitol hill, there are just 29 days left for lawmakers to get together and find a way of avoiding the so-called "fiscal cliff." if a budget plan is not approved by year's end, automatic tax hikes and across- the-board spending cuts will take effect. but democrats and republicans seem to keep digging in their heels speaking on the sunday news talk shows. >> the president and the white house have had three weeks and this is the best we've got? >> what we can't do is try to figure out what works for them. they have to tell us. >> if congress doesn't act, america will ring in the new year with $110 billion in spending cuts and a $500 billion tax increase. >> "fiscal coast guard investigation into suspected smuggling off the santa barbara county coast has turned deadly. a small boat deployed by the coast guard was rammed by a smuggler's vessel around dawn. the crash threw two coast guard members into the water near the channel islands. one was killed, the other injured. contract talks between clerical workers of the ports of los angeles and long beach and shippers have resumed. today the strike enters its 7th day. clerical workers who have been without a contract now for two years walked out on the job last week bringing the ports of l.a. and long beach to a standstill. right now, ships are being diverted to the port of oakland up our way. the southern california ports are the busiest in the state taking in about $1 billion worth of goods every day. they have to get that settled. many north beach residents are not happy with muni's central subway decision. right now the $1.6 billion project is supposed to run from the south of market to stockton and washington streets. the plan would also require digging up a section of columbus avenue in north beach to extract equipment when the project is done. merchants and residents complain it will wreck the neighborhood and ruin business. a group of businesses has already filed a lawsuit over plans to dig the massive hole in north beach. stay tuned there. >> no kidding. 6:15. let's check caltrain and your ferries all on time. nice ride this morning. no delays through san jose. 280 a nice ride so far, so good along guadalupe parkway, as well. no trouble spots there this morning. not in. you can see the next storm system off the coastline. bringing with it a chance of rain not as strong as storms we have just had. temperatures around the bay area, 60s in the afternoon. breezy at the beaches. inland not bad. 63 in the napa valley. drying out in the north bay 36 degrees there in santa rosa and 62 degrees in daly city. next couple of days, a break today and better part of the you. >> thank you. the japanese government says 49 highway tunnels will be inpicked immediately in the wake of a deadly accident. investigators say missing bolts may have caused concrete ceiling slabs to fall on cars in a highway tunnel killing nine people. yesterday's accident happened deep inside a three-mile-long tunnel about 50 miles west of tokyo. we have got a warning on our next story the video may be disturbing for young children. a california magician suffered serious burns during a tv appearance in the dominican republic. here it is. cameras were rolling last week when the tv show host pours flammable cologne on the comedian. and that does burst into flames. it's not clear why the host doused hutchins with the liquid or what ignited it. much inis in the hospital. he says the host's actions were completely unexpected and he considers it a criminal act. he is still recovering. ford motor company recalling thousands of cars because of a fire hazard on two of their vehicles. ford says there have been reports of overheating and fires in the ecoboost engines and some of the 2013 models. so it's now recalling nearly 90,000 ford escapes and fusions. they are working to fix the problems and asking the owner to call a dealer as soon as possible to arrange for a free loaner vehicle. they will take care of the problem. 6:20. fighting to stop the slide. the raiders looking rain is over for now. but boy, what a mess to clean up now. >> no kidding! one of the biggest is a large sinkhole on mountain view drive in lafayette. cbs 5 reporter elissa harrington explains it's a road hazard as well as a health and safety issue. elissa? >> yeah, good morning. this is some of the most extreme storm damage we have seen. a 20-foot sinkhole that opened in the lafayette neighborhood that's right near the downtown. and look how close it got to some homes. it's practically in this house's front yard. now, this happened yesterday afternoon following some heavy rain. the storm overflowed a creek which then saturated the ground. that eroded the street and caused part of it to suddenly drop. nobody was hurt, but that sinkhole is just steps away from homes and it's caused some very big hazards. the sinkhole's blocking two lanes but also put pressure on a water main so some homes had their water cut off last night. at least one house was without gas. pg&e and city trucks as well as sanitation crews are on scene this morning for what's going to be a very long day of clean- up and back live, i want to show you a few things. over here, i want to show you this line. this is a sewage line. i spoke with a sanitation worker and told me that they have had to redirect the sewage while crews worked underground and, of course, other crews come out today and try and repair this street. now, a section of mountain view drive is closed this morning but detours are in place. in lafayette, elissa harrington, cbs 5. >> thank you. this morning, road crews will be assessing the damage from another sinkhole that opened up yesterday in the santa cruz mountains on vine hill road near the summit of highway 17. the dirt underneath vine hill gave way around noon. now one entire lane is gone. and the remainedder of the road remains in jeopardy because there's nothing underneath supporting the pavement. one resident says he lost several trees in the collapse as debris rolled downhill. >> you can see that the whole road has been undermined, and there was a lot of water flowing through and we have lost, you know, half the roads. >> long-time residents say they have never seen anything like it. it's not clear how long the road will stay closed. >> one north bay school is closed today because of all the damage from the storm. cbs 5 reporter cate caugiran is in fairfax where crews will be clearing out all that flooded mess there. good morning. >> reporter: good morning, frank. yeah, crews have a lot of work to do but white hill middle school students will get to sleep in a little extra today because there is no school for them. we shot some video of damage to the school earlier. you can take a look on your screen right now. school leaders told parents in an email last night there was a lot of flooding in some classrooms and office spaces also in parts of the library. the principal wrote that the staff will take today to clean up and they are going to decide how to relocate some classes. now, there is a number for parents to call for updates. it's the district's school closure hotline. you can see it there on your screen: i called the hotline. it said that the school will be closed today for flooding but that hotline also wanted parents to call later in afternoon to see if the school will be closed again on tuesday. however, the principal said he is hopeful that the school will reopen again tomorrow. reporting live in fairfax, cate caugiran, cbs 5. flood warnings for the napa river were canceled. some residents prepared for the worst emptying sandbags around their properties. heavy rainstorms brought the water level within three feet of going over its banks. and this is the russian river in guerneville over the weekend. the flood warnings here were also canceled but it's expected to rise to 29 feet by 8 a.m. that's just three feet below flood stage. the highest recorded flood in guerneville occurred back in 1986 when the river reached 49 feet. and three firefighters are recovering after a major crash. the accident happened on highway 24 in orinda during yesterday's morning storm. the firefighters were actually helping victims of another crash when an suv clipped the truck and slammed into them. they are all in stable condition now. and powerful winds caused other problems around the bay area. this broken power pole in san francisco's sunset district left 85 people without electricity yesterday. it was just one of several incidents where trees or power poles were brought down by the storm. power outages on this monday morning: more than 650 pg&e customers without power up in the north bay; 600 in the east bay; around 600 in the south bay. sonoma county has the largest outages with 3,000 still in the dark. and i think they got most of the rain, too. so that makes sense. >> just shows you we're no match for nature. >> someone else who had some damage was lawrence. >> i was collecting shingles around my yard and frosty the snowman. >> poor frosty. >> no longer to get up again. so very sad for my little girl. the worst is over. we'll catch a break as high pressure is sneaking in at least for a day. temperatures beginning to build in in the 40s right now into concord. we have 41 and chilly in santa rosa, some fog now in the napa valley. 45 degrees in san jose. 50 in san francisco. here's the storm that slid through yesterday bringing that very heavy rainfall and the strong gusty winds. behind that, you get the sense, high pressure is building in. we'll still see a few clouds over the top of the ridge but no rain for today. we should stay nice and dry. temperatures outside will be in the 60s by the afternoon as high as 65 in san jose, 64 degrees and breezy into san francisco and 61 in heading into san francisco. that's clearing out of the right lane. still a little sluggish approaching the scene. also slow and go is that westbound 580 commute. 30 minutes now westbound from the altamont pass to 680. 22 miles per hour in some spots. just a little bit better as you work your way near el charro not too bad on 680 south 680 seeing delays out of pleasanton. westbound 4 loaded up as well through antioch. clears a bit into pittsburg and no delays on the eastshore freeway. stop and go westbound 237 between 880 and 101. and brake lights northbound 101 through san jose, 280, all the way two 237. about 13 minutes. no delays on 280 or highway 87. that's a look at traffic. back to you guys. >> thank you. new this morning, a chp patrol car flips over during a high-speed chase in livermore. it happened just before 4:00 this morning on eastbound 580 between greenville and north flynn roads. the officer was chasing a speeding car when the patrol car flipped. the driver sped away. other officers caught up to the car in tracy and then pulled it over. two officers in the flipped car were taken to the hospital with minor injuries. a police chase in campbell early this morning ended with a car nearly crashing into a home. this is on central avenue. police say they tried to stop the car for a traffic violation when the driver just took off crashing into a fence next to the house. the driver got out and ran. he was later caught. police say the car involved was stolen. another car chase started in san jose ended up in oakland this morning. chp officers began pursuing that car right there because it didn't have any headlights. chp says at times they reach speeds of 90 miles per hour. a spike strip finally forced the car to stop. the drive was arrested at the scene. officers say he will be charged with recklessly evading police officers. four more fire stations in contra costa county could be closed. the county supervisors are considering plans now to shut down stations in walnut creek, clayton, martinez, and lafayette. it's to save money. the district was hoping for a tax hike but it failed to pass in november. closing the stations will save $3 [ male announcer ] this december, remember -- what starts with adding a friend... ♪ ♪ ...could end with adding a close friend. ♪ the lexus december to remember sales event is on, offering some of our best values of the year. will not hear appeals on california's prop 8..today instead.. it appears they'll discuss the cases again in r next we are following breaking news now. new word this morning. the u.s. supreme court will not hear appeals on california's prop 8 today. instead, it appears they will discuss the cases again in their next scheduled conference and that's scheduled for next friday. the announcement just came down from washington, d.c. five challenges to the federal defense of marriage act will also not be considered today. a local boy scout forced to leave his moraga troop because he is gay will be honored in sacramento this afternoon. 18-year-old ryan andresen will be recognized for his bravery by state assembly speaker john perez as the new legislative session opens today. 6:44 now. the newly elected members of the state legislature will all be sworn in today and they are all ready to get to work. >> the democrats plan to put their new supermajority power to out while they can and "san francisco examiner" columnist melissa griffin is here with the change they want to make to a long-standing law. first, good morning. >> reporter: good morning. thanks for having me. they are not wasting any time. the day they are getting sworn in, the state senator mark leno is proposing a constitution amendment that would make it easier for localities to put parcel taxes before voters so they can raise money for schools. a parcel tax is a flat rate say $10, $100, whatever it iser, per parcel unrelated to the value of a home. these could be put before the voters. if they get 66% of the vote, they go into law. mark leno's constitutional amendment would reduce that amount to 55%. what he propose is two-thirds of the vote to get on the ballot, once it's on the ballot then voters would have to endorse it. but that's what he is dag the first day on the job. >> but they are not even sworn in. and they are already flexing their muscle. why do they have to do it right away? what's the -- you know -- rush? >> reporter: for all the power of the supermajority, actually the assembly and senate democrats are only going to have the supermajority until about april. two members of the state senate have been elected to congress and two members of the assembly plan to run for their seats and there's a bunch of shuffling and special elections throughout the year in 2013. if the senate democrats and assembly democrats don't move before april, they are probably not going to have a supermajority again until january of 2014 when all the shuffling is settled so they only have a short window of time. this will give them an opportunity to smoke out moderate democrats who they need to work on so they can move forward with the more ambitious agenda in 2014 when they do have the full complement and they are going to have it for two years. >> do parcels taxes fail? >> they usually pass. so in this past election there were 25 parcel taxes proposed on the ballot. 15 of them passed. had this amendment been the law, 7 additional ones would have passed so about a one- third difference. the state senator mark leno's district san francisco always passes parcel taxes by huge majorities. he certainly isn't doing it for san francisco where we kind of love parcels tax and have never turned one down. so he is doing it a leader of the senate democrats. >> say it gets on the ballot, will they go for it? >> in 1990 voters made it easier for bonds to be issued for education and so it stands to reason there is an appetite among voters to increase their own taxes. >> thank you. find more on cbssf.com/mornings. fresh sign of a rebounded for chrysler and their anticipation that the latest report on u.s. manufacturing will be positive. here to talk about it, jason brooks with kcbs and cbsmoneywatch.com on a monday. good morning. >> reporter: good morning. if chrysler is right about things, november will have been the best month for auto sales this year. chrysler says it sold 123,000 cars and trucks in the u.s. that was a 14% gain and its strongest november since 2007. chrysler also forecasting that industrywide sales in the u.s. of 15.3 million vehicles and that would be a million above the average that we saw through october. stock market focused on "fiscal cliff" talks as always, nothing new to report there except the stalemate over the weekend. and that will continue to drive the market going forward. manufacturing also a key today. we'll hear from the institute for slide management in a few minutes. an earlier report coming from markets purchasing managers index was positive and that was key after getting positive manufacturing reports out of china and europe with the market going in the right direction this morning. let's take a look at the numbers. the dow is up by 34 points. nasdaq gaining 12. s&p moving higher by 4 points. back to you guys. >> we'll take it. jason brooks with kcbs and cbsmoneywatch.com, thank you. well, a new study says that when you got to go, social media apparently goes with you. [ laughter ] around the bay area, finally catching a break in the stormy weather. this is some good news. can't take much more. it was a fierce storm that moved through the weekend again. right now high-def doppler radar showing you the skies are clear of raindrops. and we are getting that much- needed break right now. just a few high clouds drifting overhead. patchy fog in the valleys but look at all the rain we had over the weekend. we had totals from wednesday to sunday to 16" almost in have venado. 4.5 in concord. 16" at mount umunum. you get the idea, rivers and streams can't take much more. mostly cloudy at the coast. areas of fog. mostly sunny and dry by the afternoon. another round of rain is coming our way. it doesn't look to be as strong as the previous storms. the ridge of high pressure sliding in across the bay area. this next storm system still off the coastline. it's going to pay a visit as early as late tomorrow and overnight tomorrow night into wednesday. so enjoy the sunshine and a few clouds while we have them. 60s outside should be dry into the south bay. 60s a little breezy at the coastline. east bay temperatures also up into the 60s this afternoon. and inside the bay, we'll keep you not too bad, dry but 63 in oakland. and 64 degrees in san francisco. next couple of days, it looks like a return to rainfall especially tuesday night into wednesday. maybe one to two inches of rain and then we catch a much-needed break again on thursday, friday and saturday. we'll dry out as we head into the weekend. one of our hot spots now at the bay bridge toll plaza. no surprise here. the metering lights are on. you're backed up almost to the maze. busy conditions as you head through there. san mateo bridge looks a lot better. live ak at that now and you can see on the san mateo bridge, things are better. not actually not a delay in sight. only 14 minutes between 880 and 101 right now. we do have an accident along the peninsula. northbound 101 at embarcadero, it's actually a stalled vehicle stuck in lanes. look at the backup. it's slow as you work your way towards the scene. tow trucks arriving on scene to clear it out of the way. in the meantime, very busy. use 280 as an alternate if you want to avoid that mess along 101 near embarcadero. earlier accident we had at 3rd street. that's now been cleared. easy ride north 101 into san francisco. no delay. southbound along 280 we are seeing slight delays as you head out of san francisco towards daly city. brake lights lots of them westbound 580 altamont pass to 680, 32 minutes slow and go southbound 680. we have an accident south 680 at treat. not blocking lanes. but again sluggish there, as well. that's traffic. back to you. >> thank you. it's all caught on tape a girl being bitten while feeding a dolphin. >> fortunately the 8-year-old is recovering well. the bite happened 12 days ago at seaworld in orlando and the girl's father caught the incident on camera. looks like it hurt. the bottlenosed dolphin bit after the girl moved the paper plate that held the fish she was feeding. >> think it was going to haul me into the water. it was crazy. i thought it was going to eat my manned off. >> it's a good thing her hand is mostly ahead from the puncture wounds. her parents complained that seaworld didn't explain ahead of time why it's important to keep the plate on that wall. the park says it's taking the incident seriously and so we have been asking you all morning who do you think is to blame for the girl being bitten ? we are getting a lot of responses this morning. mornings at cbs 5 dot com. time : a >> comment on facebook or twitter, or email us at mornings@cbs5.com. >> if you have a plate of food near an animal, be careful. it is 6:53. coming up, a final check of your top stories including this mess. what it's going to take to clean up this massive sinkhole when we come back. at bank of america, we're continuing to lend and invest in the people, businesses, and organizations that call the bay area home. whether it's helping a nonprofit provide safe, affordable housing within the city, supporting an organization that's helping kids find jobs and stay in school, or financing the expansion of a local company that's creating healthier workplaces, what's important to the people of the bay area is important to us. and we're proud to work with all those livermore. it happened just before 4 ts mornin betwee welcome back. 6:57 now. a high-speed chase caused a chp patrol car to flip over in livermore. it happened just before 4:00 this morning on eastbound 580 between greenville and north flynn road. other officers caught up to that car in tracy and pulled it over. two officers in that flipped car were taken to the hospital with minor injuries. there's a large sinkhole right now in the east bay. it opened up yesterday afternoon on mountain view drive in lafayette, and it presence health and safety issues because the washout ruptured water and sewage service. and this is a live look right now from the scene in lafayette. you can see the crews out there. they have directed a sewer line temporarily and they will start efforts to repair the road later today. but you can see, that's a big sinkhole there and they have a lot of work to do. white hill middle school, canceled today with flooded classes and office. crews are working to clean up the mess. faculty are meeting to discuss whether classes will resume tomorrow. >> just for the storm into perspective, an inch of rain equals about a foot of snow?
