RICHMOND âThe Virginia Supreme Court will hear arguments Tuesday in two cases aimed at barring the removal of Richmondâs Robert E. Lee monument, the last Confederate memorial remaining on Monument Avenue in the wake of George Floydâs death.
Last June, Gov. Ralph Northam ordered the monument moved from state property at North Allen and Monument avenues. The General Assembly appropriated money to do so and in a budget amendment repealed the 1889 law that accepted the deed for the land and agreed to protect the monument in perpetuity.

The Supreme Court of Virginia has agreed to take up an appeal in the Robert E. Lee Monument case.
Groups appealing the lower-court s ruling want to keep the statue, on Richmond s Monument Avenue, standing.
Governor Ralph Northam ordered the statue’s removal in early June, days after Black Lives Matter protests began in Richmond.
A Richmond Circuit Court judge ruled in favor of the state back in October 2020, but kept a restraining order in place pending an appeal by the residents who filed the lawsuit to protect the statue. State officials erected fencing around Richmond’s Robert E. Lee monument today, in preparation to remove the statue. The area now enclosed was dubbed Marcus-David Peters Circle by racial justice protesters this summer.
The traffic circle around Lee has been a site of protest since last summer, when thousands took to the streets of Richmond following the police killing of George Floyd in Minneapolis. The New York Times recently ranked the Lee statue, transformed by spray-painted messages, as the No. 1 piece of American protest art since World War II.
