More than 2,000 women in Utah will be diagnosed with breast cancer, and 320 Utah women will die from it, according to the American Cancer Society.

(New York, March 30, 2023) - Today, U.S. District Judge Reed OConnor issued a nationwide injunction striking down a key component of the Affordable Care Act, the U.S. Preventative Services Taskforce, retroactively to the inception of ACA in March of 2010. The basis is that the advisory committee was created in violation of the Appointments Clause in the Constitution. He also enjoined HHS from enforcing the USPSTF moving forward.

This post summarizes some of the key issues related to the U.S. District Court's March 30 ruling in Braidwood Management v. Becerra, which imposes new limits on the government's ability to enforce preventive service requirements nationwide.
