Hotels and restaurants are in a legal battle with the Union government on whether service charge can be imposed compulsorily, or if it must be paid voluntarily.
Service Charge: Justice Prathiba M Singh, presiding over the case, emphasized that all establishments affiliated with FHRAI, including restaurants and hotels, must prominently display a notice on their menu cards. This notice will inform patrons that tipping is not obligatory once the staff contribution has been paid.
The Delhi High Court has directed the members of Federation of Hotel and Restaurant Associations of India to only use the term “Staff Contribution” for the amount being charged as “service charge”.
