live, from the cbs bay area studios, this is kpix5 news. a man is pulled over for a traffic stop. then, san jose police pull out batons. tonight, claims of excessive force. that man says he was beaten by three rookie cops in san jose for no reason. and he claims to have video to prove it. joe vasquez shows us the video and the man s lawyer is saying about this. reporter: the dark surveillance video shows construction worker eliel paulino sitting calmly talking to police quite a few minutes. his attorney says it gets ugly once paulino realizes he is about to get arrested and he yells at his father in spanish to lock up his truck. at that point, one of the officers tells him to shut up and gets closer. he explained all i m telling him to do is lock my truck up. reporter: paulino says they started to strike him with their batons. you see as he is face down on the ground, not trying to fight. he is defenseless at that point. reporter: in their written report, the
