A bench of Justice Devendra Kumar Upadhyay and Justice Saurabh Lavania had passed the order and said OBC will be given reservation only after a dedicated commission is formed

The triple test formula was suggested by the Supreme Court to provide OBC reservation in urban local body (ULB) elections.

In a significant decision that is set to affect Uttar Pradesh politics by large, the Allahabad High Court on Tuesday quashed the state governments draft notification regarding urban body elections, and ruled that the polls will take place without OBC (Other Backward Classes) reservation. A bench of Justice Devendra Kumar Upadhyay and Justice Saurabh Lavania passed the order and said OBC will be given reservation only after a dedicated commission is formed.

The Patna High Court on Tuesday struck down the reservation provided for Other Backward Class (OBC) and Extremely Backward Class (EBC) in Bihar State municipal body elections.

A Bench of Justices AM Khanwilkar, AS Oka and JB Pardiwala took exception to the State Election Commission issuing a fresh election program to include reserved seats for OBCs despite its earlier orders.

Leader of Opposition Devendra Fadnavis (BJP) on Wednesday alleged that the Maha Vikas Aghadi government has murdered the OBC quota in civic and local bodies in Maharashtra as it didn't submit the empirical data to the apex court. ‘’Had the MVA government done the triple test in time, OBC reservation would have been applicable in Maharashtra as well,’’ he opined.

Another challenge before the SEC is to implement the Supreme Court’s decision that says that reservation should not exceed the 50% limit.
