President Biden's pardons of simple marijuana possession charges will not apply to members of the military, who were charged under the Uniform Code of Military Justice.

The punishment for lying on a Bureau of Alcohol, Tobacco, Firearms & Explosives (ATF) Form 4473 is "up to 10 years imprisonment and/or up to a $250,000 fine.”

A marijuana possession charge carries a potential penalty of dishonorable discharge, forfeiture of pay and a two-year maximum punishment.
