May 09, 2021 THE Philippine College of Physicians-Central Visayas chapter (PCP-CV) renewed its support and expression of solidarity to its two colleagues who have been indicted for reckless imprudence resulting to homicide by reposting its official statement dated September 2020 on its official Facebook page on Saturday, May 8, 2021. The same statements would still hold true even to this day. We stand in solidarity with our colleagues and all frontliners. Our enemy is Covid-19, the PCP-CV said.
The colleagues the group is referring to are Chong Hua Hospital Doctors Elfleda Hermandez, an infectious disease specialist, and Yvonne Bettina Montejo, a pulmonologist who handled and provided medical care to the late Barili Mayor Marlon Garcia before he died on September 6, 2020.

Metro Manila (CNN Philippines, May 8) – Two doctors will be put on trial for alleged medical negligence in the death of Cebu Gov. Gwen Garcia s younger brother.
In a 34-page resolution dated March 1, the Cebu City Prosecutor s office found probable cause to indict Dr. Elfleda Hernandez and Dr. Yvonne Bettina Montejo for the death of former Barili town mayor Marlon Garcia.
Prosecutors recommended suing the two doctors for reckless imprudence resulting to homicide. Verily, the causation of death as having been admitted as hospital-acquired bacterial infection lends credence to the complainant s allegation that there was lack of standard care expected of the attending physicians, read the court resolution penned by Asst. City Prosecutor Verna Merelos and approved by Cebu City Prosecutor Liceria Lofranco-Rabillas.

CEBU CITY – Two doctors from a private hospital here will face trial for the death of Barili, Cebu Mayor Marlon Garcia last year.
The Office of the Cebu City Prosecutor found probable cause to indict Dr. Elfleda A. Hernandez, an infectious disease specialist, and Dr. Yvonne Bettina E. Montejo, a pulmonologist, for reckless imprudence resulting in homicide.
Mayor Garcia’s wife Jima filed the charges against the two doctors who who attended to the late local chief executive at the Chong Hua Hospital (CHH).
The brother of Cebu Gov. Gwendolyn Garcia was admitted to CHH last Aug. 5 where he was later found to be COVID-19 positive.

The charges, however, do not extend to Chong Hua Hospital (CHH) and the latter is not liable for damages, the Office of the Cebu City Prosecutor ruled in a resolution dated March 1, 2021.
In a text message to SunStar Cebu, a representative of CHH said the hospital was preparing a statement. He did not say when it will be issued.
In a 34-page resolution, the prosecution recommended the filing of criminal charges in court against Dr. Elfleda A. Hernandez, an infectious disease specialist, and Dr. Yvonne Bettina E. Montejo, a pulmonologist.
