The jury that found Mark Smich guilty of helping his once-close friend Dellen Millard murder an ex-lover was not properly told how to balance the evidence against him, his lawyer argued before Ontarios highest court Monday.

When Dellen Millard and Mark Smich make their appeals before Ontarios highest court starting Monday, they will be entitled to reduced sentences for their multiple murder convictions -- cutting 50 years and 25 years off their respective parole ineligibility periods.
