facing charges. 15 month-old found unresponsive in the care of a baby-sitter a woburn couple is speaking out about the investigation into his death. the parents say someone intentionally harmed their son. only fox 25 investigates reporter kerry kavanaugh shares their story as they fight for justice for baby noah. reporter: the family says in court friday dcf determined it was safe for their other children to return to their home. they say they hope now they can begin grieving as a family. they told me they re prevent another family from suffering a devastating loss like theirs. the snugliest baby. he s just the sweetest. he was no stranger to a set of arms. reporter: lindsay keen says 15 month-old noah was his happy smiling self the morning of august 15th when she dropped him and his twin sister amelania at their baby-sitters at this woburn apartment. that afternoon the call came. your whole world stops. reporter: the sitter said noah and amelania were on our
ashland it. happened a short time ago in pleasant street. fox 25 s jacqui heinrich just arrived scene with the breaking details. jacqui? reporter: mark, vanessa, police chief just told me there will be no charges in this case, speed was not a factor and alcohol was not involved. the driver did stay scene after the crash. he told police those two girls just jumped out in front of his car and he didn t have enough time to stop. that driver a 24-year-old male was given a ride home by police and the student was taken to the hospital. her friend was not hurt. both families have been notified of what happened tonight. although police couldn t say the extent of the girl s injuries they say she was talking and alert when she was transported. police say it s a reminder for pedestrians and drivers to use caution. they just misjudged it. if there s any take away cars may be going a little faster than you think they you cross the street. reporter: the speed limit here is about 30
