Maine Court Says Tourette’s Patient Can Sue for Being Denied Procedure January 20, 2021 A woman who has Tourette’s syndrome may proceed with her lawsuit against a surgeon who declined to repair her injured shoulder because of her disability, the state Supreme Court ruled. The doctor performed surgery on Carol Cutting’s injured shoulder but opted not to repair her torn rotator cuff because he thought her uncontrolled arm movements linked to her disability would cause the repair to fail. The problem was that he never explained that to Cutting until after the surgery was over, preventing the patient from knowing all the options and risks, and having any say in them, said her attorney, Laura White.

OCR Provides Technical Assistance to Ensure Crisis Standards of Care Protect Against Age and Disability Discrimination

Today, the Office for Civil Rights (OCR) at the U.S Department of Health and Human Services (HHS) is announcing it has worked collaboratively with the State of North Carolina, the North Texas Mass Critical Care Guidelines Task Force, the Southwest Texas Regional Advisory Council, and the Indian Health Service to revise each entity’s crisis standards of care ( CSC ) guidelines to reflect best practices for serving individuals with disabilities and the elderly. This builds on OCR s prior work regarding discrimination concerns during COVID-19. OCR enforces a number of federal antidiscrimination laws, including Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, the Age Discrimination Act of 1975, Title II of the Americans with Disabilities Act, Section 1557 of the Patient Protection and Affordable Care Act, and conscience and religious freedom laws.

Springston has served as Indiana University’s director of institutional equity and Title IX since 2018, and as the university Title IX coordinator since 2014. She will assume her position at UVA March 1. UVA’s Office for Equal Opportunity and Civil Rights works to ensure equal opportunity and to protect the civil rights of University community members through proactive outreach, education, effective response, and resolution under UVA’s policies on Sexual and Gender-Based Harassment and Other Forms of Interpersonal Violence, Preventing and Addressing Discrimination and Harassment, and Preventing and Addressing Retaliation.
