Since 2004, the state of Idaho has lost eight cases involving a law passed by the legislature that was challenged for being unconstitutional. And at least one bill passed during last year’s session is currently in legal limbo. The fees for these court cases are paid by Idaho taxpayers through the Constitutional Defense Fund, which was created in 1995 to defend the state’s legal rights against the federal government.
Now, some legal experts have formed a group to combat what they say is unconstitutional legislation. They want to stop the use of the fund to defend laws they say do not pass legal muster.
