4 days ago A case originally brought in Orange County Superior Court by five substance use disorder treatment providers against Anthem Blue Cross Life and Health Insurance Company and affiliates will proceed in federal court, per a notice of removal filed Tuesday in the Central District of California.
The Discovery House LLC, Discovery Transitions Outpatient Inc., DHP Heights LLC, MT Golden Corporation, and MT Process LLC, all out-of-network providers of services, including residential treatment, inpatient and outpatient care, therapy, and medication management, filed a complaint Jan. 19, alleging denial of Employee Retirement and Income Security Act (ERISA) benefits; breach of implied, oral, and written contract; breach of covenant of good faith and fair dealing; promissory estoppel; and unfair competition against the defendants.

Californian Judge Craig Griffin rejected and dismissed the lawsuit as well as the attempt to apply Israeli laws in his Orange County Superior Court. In his ruling,
the judge also granted Palestinian Suhair Nafal s anti-SLAPP motion and said that Rumshiskaya must pay the defendant s legal costs. The anti-SLAPP laws are designed to deter people from using the US courts, and potential threats of a lawsuit, to intimidate people who are exercising their First Amendment rights to free speech. A

A former member of the U.S. Women’s National Gymnastics Team filed a lawsuit against former U.S. Women’s Olympic Gymnastics coach Don Peters in Orange County Superior Court this week, accusing him of sexually abusing her while she was training as a minor.
The lawsuit filed Tuesday does not name defendants due to a law requiring a judge’s approval prior to the disclosure of identities, but the plaintiff’s attorney, John Manly, confirmed those involved as Peters and SCATS Gymnastics in Huntington Beach.
In the complaint, plaintiff Doe Yamashiro accuses Peters of repeatedly sexually abusing her while she was training at SCATS Gymnastics and while on national and international trips for competitions. The lawsuit claims Yamashiro was sexually harassed and abused at SCATS and in training facilities, gyms, hotels and other places on at least 10 separate occasions, from 1986 to approximately 1988.
