CHICAGO (Legal Newsline) - Netflix, Hulu and other video streaming services have asked a federal appeals court to reverse a judge’s order sending a dispute over franchise fees back to state court in Indiana, saying the case belongs in federal court because it is a class action, not an attempt to collect state taxes.
The difference matters, the streaming services say, because the Class Action Fairness Act requires class actions seeking more than $5 million to be heard in federal court. Indianapolis and several other cities, represented by private lawyers working on contingency, sued to collect franchise fees from the video services and structured the case as a class action on behalf of every other Indiana municipality.

Over the past several months, our Indiana team has been intervening in a proceeding before the Indiana Utility Regulatory Commission (IURC) to examine Duke Energy Indiana’s coal self-commitment practices. Self-commitment refers to a process by which a utility instructs the regional market within which it operates – in this case, the Midcontinent Independent System Operator (MISO) – to dispatch the utility’s own resource unit regardless of whether or not it is the cheapest available at the time. Many vertically integrated utilities have been using this mechanism to run their expensive coal plants more frequently than economics would otherwise dictate. They do this because it is not their shareholders who suffer financial losses, but rather their captive ratepayers: When the cost to operate these units exceeds the market clearing price, utilities pass along the difference to customers, in part through fuel adjustment clause proceedings. INDIANAPOLIS (Inside INdiana Business) The Indiana-based gas utility for CenterPoint Energy Inc. (NYSE: CNP) in Texas is requesting a rate increase for its natural gas service territory. Indiana Gas Company says the request, which would be its first rate increase in 13 years, follows the completion of a seven-year, $725 million natural gas pipeline modernization plan.
CenterPoint Energy says the pipeline project led to a 33% reduction in methane emissions since 2013. The rate increase request, filed with the Indiana Utility Regulatory Commission, seeks to recover about 20% of the cost of the project.
“Through these infrastructure investments, CenterPoint Energy is committed to complying with federal mandates and continuing to safely and reliably deliver natural gas service to our customers,” said Richard Leger, vice president of natural gas distribution in Indiana and Ohio for CenterPoint. “W
