Deputy Health and Disability Commissioner Rose Wall today
released a report finding a rest home in breach of the Code
of Health and Disability Services Consumers’ Rights (the
Code) after a woman suffered serious injuries in their care
in 2018.
The woman, who had an intellectual disability
and limited communication skills, was a resident at Radius
Elloughton Gardens in Timaru which is operated by Radius
Residential Care Limited (Radius).
Sometime during the
night or the next morning, the woman suffered a right
shoulder dislocation and fractures on the two bones of her
lower left leg. These injuries were most likely the result

Health and Disability Commissioner Morag McDowell today released a report finding a District Health Board and a speech language therapist in breach of the Code of Health and Disability Services Consumers’ Rights (the Code) for failures in their care of a man with throat cancer.
The man, in his mid-sixties, was referred to the Counties Manukau District Health Board’s (CMDHB) Otorhinolaryngology (ORL) service as his voice had become hoarse. Instead of being booked for an appointment with both an ORL clinician and speech language therapist, the man was mistakenly booked with a speech language therapist only.

The man, aged in his eighties, had a CT scan at a public hospital to investigate abdominal pain and diarrhoea he was experiencing.

Health and Disability Commissioner Morag McDowell today released a report finding a radiology service and radiologist in breach of the Code of Health and Disability Services Consumers’ Rights (the Code) for the care provided to a woman later diagnosed with liver cancer.
The report discusses the care provided to the woman, aged in her fifties at the time, prior to her diagnosis of liver cancer and, in particular, errors that occurred during a CT scan of her abdomen and pelvis. The radiologist should have reported that the liver lesions identified on the woman’s CT scan were difficult to characterise, and therefore he should have offered a differential diagnosis and recommended further imaging, Ms McDowell said.
