No human rights without the right to know

Access to information legislation was first seen in Sweden in 1766, with parliamentary interest to access information held by King Adolf Frederick. Finland followed suit and adopted similar legislation in 1951, the United States in 1966, and finally, Norway in 1970. Today, there are 98 sovereign states with access laws; of these, more than 50 are incorporated into their respective constitutions. The Inter-American Court of Human Rights in 2006 and the European Court of Human Rights in 2009 both ruled that access to information is a human right, which was confirmed in July 2011 by the United Nations Human Rights Committee, a sine qua non of 21st-century democracy. Global civil society movements have been promoting transparency, with activists and journalists reporting daily on successes in obtaining information and denouncing obstacles and frustrations in the implementation of this right. Human Rights Watch Submission on the Republic of Malawi to the UN Human Rights Committee 131st Session March 2021 We write to you ahead of the United Nations Human Rights Committee’s upcoming review of the Republic of Malawi to highlight key areas of concern in relation to sexual orientation and gender identity that Human Rights Watch hopes will inform this aspect of the Committee’s consideration of the government of Malawi’s compliance with the International Covenant on Civil and Political Rights. This submission covers the lack of progress made on key concerns related to sexual orientation highlighted by the Committee during its last review of Malawi in 2014, including criminalisation of consensual adult same-sex sexual conduct, violence against lesbian, gay, bisexual and transgender persons, stigma and discrimination in access to health care services and responsibilities of the Malawi Human Rights Commission.
