The defendant NHS Trust had breached s 242(1B)(b) and (c) of the National Health Service Act 2006 by failing to make arrangements which had secured that service users had been involved: (i) in the development and consideration of the proposals for the designation of the hospital as a ‘Green site’ (namely that there would be no Covid-19 related treatment on the site); and (ii) in the making of the decision itself. The Administrative Court, in allowing the claim in part and in construing the relevant section of the Act, held that, ultimately, the question was whether the arrangements, looked at as a whole, had secured the opportunity for meaningful involvement or participation in the specified matters, and that the relevant duty contemplated service user involvement before the event, and at the formative stage. The court held that, on the facts, it was just and convenient to grant the claimant service user declaratory relief.

There have been 346 coronavirus cases in Greater Lincolnshire and two COVID-related deaths last week – a small decrease compared to 337 cases and eight deaths the previous week.
The first two days of May saw the government’s COVID-19 dashboard recorded 40 new cases in Lincolnshire, 34 in North Lincolnshire and six in North East Lincolnshire.
The figures are a 2.6% weekly drop in case numbers and a 75% drop in deaths.
Across the bank holiday weekend, one death was registered in North Lincolnshire. These figures include deaths both in and out of hospitals, as well as residents in hospitals outside the county. Fluctuations in data can occur for a variety of reasons including corrected data, misdiagnoses or wrong addresses.

April has seen 1,633 COVID-19 cases for the entire month in Greater Lincolnshire down 63% on March’s figure of 4,493.
The county’s death rate has also sharply plummeted from 100 in March to 14 this month a drop of 86%.
So far this week, there have been 266 coronavirus cases in Greater Lincolnshire and one COVID-related deaths – compared to 251 cases and five the previous week.
The government’s COVID-19 dashboard on Friday recorded 37 new cases in Lincolnshire, seven in North Lincolnshire and one in North East Lincolnshire.
Amazing buskers and singing window cleaner perform on Lincoln High Street
A musical weekend in Lincoln
Two buskers performed together for only the second time ever as they wowed Lincoln shoppers, along with a local singing window cleaner on Friday.
Brad Ryan, 23, from Sheffield and a Glasgow-born singer known as Adum, 21, have been in contact with each other for three years due to their love of music.
They met in person for the first time recently before singing together in Leicester on Wednesday. Their voices harmonised together on the streets of Lincoln on Friday, before a local window cleaner got involved.
