(Press photo by Ken Grosjean) A decision by the Wood County Common Pleas Court that imposed a prison sentence for a man found guilty of attempted pandering of sexually-oriented material has been reversed. The Ohio Sixth District Court of Appeals has ruled the lower court erred when it sentenced Randy Merer, Perrysburg, to 36 months in prison on each of seven pandering counts and 12 months for a charge of possessing criminal tools. The pandering counts were to be served concurrently and the criminal tool possession count was to be consecutively served to the pandering counts for an aggregate prison term of 48 months.

The Ohio Sixth District Court of Appeals has ruled the common pleas court must schedule a hearing to determine if Charles Tingler is eligible for expungement and if so, whether he is entitled to expungement. In March 2015, Tingler was found guilty of two counts of inducing panic, which are second degree felonies; one count of disrupting public services, a fourth degree felony, and one count of aggravated menacing, a first degree misdemeanor.

Charles Tingler s expungement hearing sent back to trial court

TOLEDO - A Salem Township man convicted of making threats to Ottawa County schools won an appeal to have his case back in court to determine if his conviction can be expunged. In his appeal, Charles Tingler argued that his record should be expunged and records in his 2014 case sealed, because the trial court did not provide a detailed explanation for denying his motion. Tingler was charged in April 2014 after make bomb and gun threats at schools, including threats to shoot up Port Clinton Middle School, and was later convicted during a March 2015 trial of two counts of inducing panic, disrupting public services, and aggravated menacing.

Appeals court upholds rulings in two Sandusky County sex-crime cases

TOLEDO - The Ohio Sixth District Court of Appeals upheld the Sandusky County Common Pleas Court s sentencings in two separate sex-related crimes, one of which landed a man in prison for life. Daymond Milligan, 59, was sentenced to life in prison after being convicted of two counts of rape in January 2020. According to court records, Milligan had sexual contact with a girl younger than 10 years old stemming from incidents from 2018 and 2019. Milligan previously was convicted for the same type of conduct with the victim s mother when she was 11 or 12, the report said. In Milligan s appeal, he argued the lower court erred in not granting a mistrial after a violation of a court order regarding testimony about Milligan s prior conviction.
