Appeals court rules to resentencing hearing after assault plea

TOLEDO - An appeals court judge has ordered a Fremont man to be resentenced after he pleaded guilty to felonious assault in February 2020. Kyle Porter was sentenced to five years in prison after he was alleged by police to have fired a gun at his father-in-law stemming from a 2019 incident. Porter, 48, pleaded guilty to one count of felonious assault in exchange for a second count of felonious assault and gun specifications to be dropped. In his assignment of error, Porter argued that he was not informed his plea was not bound by sentencing agreement between Porter and the prosecution. He said the trial court erred in imposing a term greater than the maximum agreed upon between the two parties.
