Motion filed to dismiss case against Clayton County Sheriff
Gov. Kemp suspended Clayton County Sheriff Victor Hill in June, but his defense attorneys filed a motion say the criminal case against him is unconstitutional.
CLAYTON COUNTY, Ga. - Attorneys for Clayton County Sheriff Victor Hill said the criminal case against him is unconstitutional and they are asking a judge to toss it out.
Former federal prosecutor turned defense lawyer, Lyndsey Barron crafted the motion to dismiss the criminal case which was filed July 7. There has to be a case that puts him on warning that putting someone in a chair is a constitutional violation, Attorney Barron affirmed.

An interesting twist occurred this week with the federal four-count indictment against Clayton County’s controversial Sheriff Victor Hill. Lynsey M. Clayton County’s “Crime Fighting” Sheriff was indicted on April 19, 2021, on four counts of willfully depriving four detainees at the Clayton County jail of “the right to be free from the use of unreasonable force by law enforcement officers amounting to punishment,” in violation of 18 U.S.C. § 242.1.
