Governor Kay Ivey has awarded nearly $17 million to help provide broadband services in primarily rural, unserved areas of Alabama.
The 36 grants awarded by Governor Ivey to multiple broadband providers across the state is the largest amount and number awarded to date from the Alabama Broadband Accessibility Fund. The fund was created by the Alabama Legislature in 2018.
“The COVID-19 pandemic reinforced what we already knew; that Alabama’s broadband coverage is an issue we must continue addressing,” Governor Ivey said. “Yet, thanks to so many, we are making strides in helping to provide high-speed internet coverage throughout the state. That will make a vast difference for thousands in terms of education, economic development, health care services and everyday life.”

On April 5, 2021, the Eleventh Circuit reversed a district court’s denial of a defendant’s motion to compel arbitration in a Fair Credit Reporting Act (“FCRA”) lawsuit arising from a former Comcast customer’s re-application for services, holding that the FCRA claim related to a prior agreement that contained an arbitration provision. The case is noteworthy in that it involved a particularly sweeping arbitration provision applying broadly to
all disputes between the parties, even those arising after the services agreement was terminated that the Eleventh Circuit had not previously considered. The court ultimately did not reach the question of the provision’s enforceability, however, instead remanding the case to the district court to determine its enforceability in the first instance.

Comcast is breaking subscriber records both in its high-speed broadband and its four-year old wireless service as the cable behemoth continues to make its core network its “number one priority,” according to Comcast Chairman and CEO Brian Roberts.
Driven by broadband, Comcast’s Cable Communications segment had its best first-quarter result on record for total customer relationships, adding 380,000 new business and residential users. The segment now has 33.5 million customers. The company added 461,000 high-speed internet customers.

Hearn v. Comcast Cable Communications, LLC, the Eleventh Circuit Court of Appeals reversed a district court holding denying the defendant’s motion to compel arbitration regarding the plaintiff’s Fair Credit Reporting Act claim and remanded the matter for further proceedings.
In that case, the plaintiff obtained services from the defendant in 2016, and signed a subscriber agreement with an arbitration provision stating that “[a]ny dispute involving [the customer] and Comcast shall be resolved through individual arbitration.” The plaintiff terminated his services in 2017, but subsequently called the defendant in 2019 to “inquire about pricing and obtaining services” again. The plaintiff alleged that one of the defendant’s representatives impermissibly checked his credit information during the call, and his credit score consequentially dropped.
