‘Extreme’ 107-year prison term upheld for Black driver who shot Pa. troopers during wild gun battle Updated Dec 17, 2020; Although it called the punishment “extreme” a state Superior Court panel has upheld the 53 ½- to 107-year prison sentence for a driver who shot and seriously wounded a state trooper during a shoot-out with several officers after a speeding stop. Daniel Clary, who was himself shot several times, claimed he opened fire on the troopers in self-defense during the violent incident on Route 33 in Northampton County on Nov. 7, 2017. As Judge Mary Jane Bowes noted in the state court’s opinion, the defense attorney during Clary’s trial portrayed him as a frightened young Black man who panicked after being tased by the police.
