Bill revising use-of-force standard gets final approval

DOVER, Del. (AP) The state House on Tuesday gave final approval to legislation revising the standard under which the use of force, whether lethal or nonlethal, is justified under Delaware law.
Under current law, the use of deadly force by a police officer, or anyone else, is justified if the person believes it is necessary to protect himself or others from death, serious physical injury, rape or kidnapping.
The bill approved Tuesday requires that such a belief must be “reasonable.”
Supporters of the bill have said Delaware is one of only three states, along with Tennessee and Arizona, in which the law allows police officers to use deadly force whenever they believe it to be justified, regardless of whether such a belief is reasonable.

William Freeborn and Rebecca Walker, have been indicted in separate cases involving misconduct in office.
Theindictment alleges that between February 1, 2019 and May 17, 2020, Freeborn – who at that time was Executive Director of the Wilmington Neighborhood Conservancy Land Bank – knowingly accepted at least $28,000 in unauthorized cash deposits for properties that did not belong to the Land Bank.
Freeborn was charged Monday with Theft by False Promise and Misapplication of Property, both Class G Felonies, and with Official Misconduct, a Class A Misdemeanor. If convicted, Freeborn could face up to five years in prison.
Freeborn left the Land Bank post in 2020. Freeborn is a former member of the Wilmington City Council and has worked as a business consultant and association director. Freeborn said he was unable to comment on the charges.

Georgia authorities hesitated to call the murders, committed by a white man, hate crimes, drawing anger from members of Asian and Pacific Islander communities, who argue such incidents targeting their demographic are already underreported. New Jersey saw a significant spike in bias incidents in 2020, particularly against Black, Asian, and Hispanic residents, though officials also cautioned their tally was likely an undercount.
